While card counting may not be illegal, casinos aren't required to allow it on their premises and can use whatever (legal) countermeasures they want. Shuffling is one of the most effective countermeasures; the shuffle point is mandated by the policy of the particular casino (which, by the way, changes all the time, depending on which way the countermeasure winds are blowing). In short, the casino can shuffle up on you whenever it wants and neither the players nor the state has anything to say about it.
