Rep. <strong>Joe Barton<\/strong> (R-TX, <em>left<\/em>) <a href=\"http:\/\/www.reviewjournal.com\/business\/casinos-gaming\/new-online-poker-bill-introduced-washington\" target=\"_blank\" rel=\"noopener\">revived a 2012 initiative<\/a>, in the form of his <strong>Internet Poker Freedom Act<\/strong>, legislation that he&#8217;s been promising for a couple of election cycles now. However, contrary to the hopes of <strong>Gary Loveman<\/strong> and like-minded members of Big Gaming, Barton doesn&#8217;t seek to legalize Internet at the federal level, although there would be a federal set of regulations which individual states could opt into or out. His bill, <a href=\"http:\/\/www.lasvegassun.com\/news\/2013\/jul\/11\/second-bill-legalize-web-poker-us-introduced\/#axzz2YotXzErF\" target=\"_blank\" rel=\"noopener\">much narrower in scope than rival legislation<\/a> by Rep. <strong>Peter King<\/strong> (R- N.Y.), would free up individual states to legalize <strong>Internet<\/strong> poker without fear of federal interference. Ergo, it&#8217;s still a state-by-state issue. However, that very narrowness ought to give King&#8217;s bill a better chance at passage. The <strong>American Gaming Association<\/strong> kicked off its post-Fahrenkopf era by saying it was &#8220;pleased&#8221; by the news, but remained exquisitely noncommittal &#8212; poker-faced, you might say.<\/p>\n<p><strong>Everybody wins<\/strong>. A federal appellate court in the <strong>District of Columbia<\/strong> has tossed out an inane <strong>IRS<\/strong> policy whereby <!--more-->overseas players were taxed on every bet they make in U.S. casinos (<a href=\"http:\/\/www.reuters.com\/article\/2013\/07\/10\/us-usa-tax-gambling-idUSBRE96901820130710\" target=\"_blank\" rel=\"noopener\">yes, even when they lose<\/a>). The court deemed the taxmen&#8217;s justifications a &#8220;non-sequitur.&#8221; The news should be welcome to everyone except the tax collector.<\/p>\n<p><strong>Gambling for charity?<\/strong> Although the idea didn&#8217;t work for the failed <strong>Foxwoods Resorts Casino<\/strong> project in <strong>Philadelphia<\/strong>, that&#8217;s not stopping <strong>Penn National Gaming<\/strong> from proposing that two-thirds of its would-be Philly casino be placed in non-profit ownership. A corresponding portion of EBITDA (<em>not<\/em> profit) would go right into the coffers of the City of Philadelphia&#8217;s pension fund and school district. According to company spokeswoman <strong>Karen Bailey<\/strong>, &#8220;Penn Hollywood&#8217;s proposal sets itself apart from the rest of the applicants, and this is something we want the general public to know. No other applicant is providing two-thirds of its cash flow from their proposed casinos to city schools and pension funds, and no other applicant can even match that.&#8221;<\/p>\n<p><strong>With so much EBITDA<\/strong> being offloaded into civic coffers (to say nothing of <strong>Pennsylvania<\/strong>&#8216;s stiff tax rates), it&#8217;s a good thing Penn is keeping its planned investment to $480 million. It&#8217;s going to have recoup its investment on suddenly attenuated cash flow. Then again, on Penn&#8217;s budget, it will be easier to break than will the highly budgeted <strong>Wynn Resorts<\/strong> and <strong>Isle of Capri Casinos<\/strong> proposals.<\/p>\n<p><strong>Penn got good news<\/strong> from the <strong>Nevada Gaming Control Board<\/strong>, <a href=\"http:\/\/cdcgamingreports.com\/penn-national-real-estate-move-could-become-industry-standard-lvrj\/?utm_source=The+Flash+-+July+11%2C+2013&amp;utm_campaign=Flash+-+June+7%2C+2013&amp;utm_medium=email\" target=\"_blank\" rel=\"noopener\" class=\"broken_link\">which approved its split<\/a> into a REIT and a casino-management company. Since 90% <img loading=\"lazy\" class=\"alignleft size-full wp-image-5083\" title=\"penn-national-gaming\" src=\"https:\/\/www.lasvegasadvisor.com\/stiffs-and-georges\/wp-content\/uploads\/2010\/11\/penn-national-gaming.jpg\" alt=\"\" width=\"195\" height=\"45\" srcset=\"https:\/\/www.lasvegasadvisor.com\/stiffs-and-georges\/wp-content\/uploads\/2010\/11\/penn-national-gaming.jpg 195w, https:\/\/www.lasvegasadvisor.com\/stiffs-and-georges\/wp-content\/uploads\/2010\/11\/penn-national-gaming-150x34.jpg 150w\" sizes=\"(max-width: 195px) 100vw, 195px\" \/>of the former&#8217;s taxable income has to go straight to shareholders, the onus to make capital improvements at Penn&#8217;s casino will fall upon the management entity. The REIT hangs onto fast-fading Penn properties in <strong>Perryville<\/strong> and <strong>Baton Rouge<\/strong> and leases everything else to the management company.<\/p>\n<p><strong>Displaying a shaky grasp<\/strong> of history, Commission Chairman <strong>A.G. Burnett<\/strong> &#8220;<em>said Penn\u2019s REIT was the first for the gaming industry and it might be a concept for other casino companies to explore<\/em>.&#8221; Uh, no it wasn&#8217;t A.G.: <strong>Barry Sternlicht<\/strong> did the same thing with the <strong>ITT Sheraton<\/strong> casino properties 15 years ago. Several other companies toyed with the notion &#8212; including <strong>Station Casinos<\/strong> &#8212; but &#8220;REITmania,&#8221; as I dubbed it at the time, was a short-lived phenomenon.<\/p>\n<p><strong><em>Casino Life<\/em> magazine takes<\/strong> a look at <strong>MGM Resorts International<\/strong>&#8216;s <a href=\"http:\/\/content.yudu.com\/Library\/A29h1l\/casinolifemagazineJu\/resources\/index.htm?referrerUrl=http%3A%2F%2Fwww.casinolifemagazine.com%2F\" target=\"_blank\" rel=\"noopener\">latest experiment with &#8216;new urbanism.&#8217;<\/a> Don&#8217;t ask me why that picture of MGM&#8217;s <strong>Springfield<\/strong> project is the lead image is in the story.
