{"id":13644,"date":"2014-05-27T09:33:20","date_gmt":"2014-05-27T17:33:20","guid":{"rendered":"https:\/\/www.lasvegasadvisor.com\/stiffs-and-georges\/?p=13644"},"modified":"2014-05-27T09:33:20","modified_gmt":"2014-05-27T17:33:20","slug":"massive-tribal-victory-in-scotus-bad-day-at-hard-rock","status":"publish","type":"post","link":"https:\/\/www.lasvegasadvisor.com\/stiffs-and-georges\/massive-tribal-victory-in-scotus-bad-day-at-hard-rock\/","title":{"rendered":"Massive tribal victory in SCOTUS; Bad day at Hard Rock?"},"content":{"rendered":"<p>We should probably brace ourselves for dramatic new interpretations of the <strong>Indian Gaming Regulatory Act<\/strong>, following a surprising <strong>Supreme Court<\/strong> <a href=\"https:\/\/www.lasvegasadvisor.com\/stiffs-and-georges\/wp-content\/uploads\/2014\/05\/Court.jpg\"><img loading=\"lazy\" class=\"alignright size-full wp-image-13645\" src=\"https:\/\/www.lasvegasadvisor.com\/stiffs-and-georges\/wp-content\/uploads\/2014\/05\/Court.jpg\" alt=\"Court\" width=\"271\" height=\"186\" srcset=\"https:\/\/www.lasvegasadvisor.com\/stiffs-and-georges\/wp-content\/uploads\/2014\/05\/Court.jpg 271w, https:\/\/www.lasvegasadvisor.com\/stiffs-and-georges\/wp-content\/uploads\/2014\/05\/Court-150x102.jpg 150w\" sizes=\"(max-width: 271px) 100vw, 271px\" \/><\/a>decision. The State of <strong>Michigan<\/strong> had been trying to get rid of a <strong>Bay Mills Indian Community<\/strong> casino that was 90 miles from reservation land. <a href=\"http:\/\/cdcgamingreports.com\/supreme-court-says-mich-cant-block-indian-casino\/\" target=\"_blank\" class=\"broken_link\">No go, says SCOTUS<\/a>: &#8220;<em>Michigan argued that the Bay Mills tribe opened the casino in 2010 without permission from the U.S. government and in violation of a state compact. The tribe had purchased land for the casino with earnings from a settlement with the federal government over allegations that it had not been adequately compensated for land ceded in 1800s treaties<\/em>.&#8221;<\/p>\n<p>Writing for the majority, Justice\u00a0<strong>Elena Kagan<\/strong> opined that <!--more-->tribal immunity applies, regardless of whether the casino was on- or off-reservation. Commercial activities off-reservation also fall under the umbrella of immunity. Responding for the minority, Justice <strong>Clarence Thomas<\/strong> wrote that the trouble stemmed from a 1998 SCOTUS affirmation of tribal immunity and \u201ctribal commerce has proliferated and the inequities engendered by unwarranted tribal immunity have multiplied.\u201d<\/p>\n<p>Expect the ramifications of today&#8217;s decision to pile up like leaves in autumn.<\/p>\n<p>* A looming, <a href=\"http:\/\/cdcgamingreports.com\/unions-call-june-1-strike-for-9-downtown-hotels\/\" target=\"_blank\" class=\"broken_link\">June 1 strike<\/a> had a catalytic effect on negotiations between <strong>Boyd Gaming<\/strong> and the <strong>Culinary Union<\/strong>. Both parties <a href=\"http:\/\/www.reviewjournal.com\/business\/casinos-gaming\/2-downtown-boyd-casinos-reach-deal-culinary-bartender-unions\" target=\"_blank\">agreed to new, five-year contracts<\/a> whose terms were described as being similar to those already accepted by the <strong>Golden Nugget<\/strong>. Like the Nugget, Boyd&#8217;s <strong>Main Street Station<\/strong> and <strong>Fremont Hotel<\/strong> are part of a big company that can absorb the higher health-plan costs in the Culinary deal. Whether that can be said for the septet of independent casinos without Culinary pacts remains to be seen.<\/p>\n<p>* <strong>Warner Gaming<\/strong> may have really stepped in it when it banned <strong>Ben Affleck<\/strong> from the <strong>Hard Rock Hotel &amp; Casino<\/strong> for counting cards. By barring such a <a href=\"https:\/\/www.lasvegasadvisor.com\/stiffs-and-georges\/wp-content\/uploads\/2014\/05\/Gaming-casino-croupier.jpg\"><img loading=\"lazy\" class=\"alignleft size-medium wp-image-13646\" src=\"https:\/\/www.lasvegasadvisor.com\/stiffs-and-georges\/wp-content\/uploads\/2014\/05\/Gaming-casino-croupier-300x300.jpg\" alt=\"Gaming-casino-croupier\" width=\"300\" height=\"300\" srcset=\"https:\/\/www.lasvegasadvisor.com\/stiffs-and-georges\/wp-content\/uploads\/2014\/05\/Gaming-casino-croupier-300x300.jpg 300w, https:\/\/www.lasvegasadvisor.com\/stiffs-and-georges\/wp-content\/uploads\/2014\/05\/Gaming-casino-croupier-150x150.jpg 150w, https:\/\/www.lasvegasadvisor.com\/stiffs-and-georges\/wp-content\/uploads\/2014\/05\/Gaming-casino-croupier.jpg 1024w\" sizes=\"(max-width: 300px) 100vw, 300px\" \/><\/a>well-known public figure, Warner ensured that the practice of <a href=\"http:\/\/triblive.com\/aande\/gambling\/6148684-74\/million-says-adams#axzz32quEWzD5\" target=\"_blank\" class=\"broken_link\">&#8220;backing off&#8221; advantage players achieved national awareness<\/a>, particularly with a younger generation that was reared on interactive gaming and has a certain expectation of skill translating into winning. Those, at least, are the nostrums of gaming pundit <strong>Ken Adams<\/strong> and I can&#8217;t say I disagree.<\/p>\n<p>It&#8217;s an elitist notion that the casino deserves to have an edge or, as Adams puts it,\u00a0<span style=\"color: #000000;\">\u201cYou [players] have to walk in and submit to losing &#8230; There&#8217;s a whole generation of people he represents, and they&#8217;re being told \u2018We don&#8217;t want your play.&#8217; \u201d Adams&#8217; proposed solution is for the industry to come up with more games like poker, where the house takes a &#8216;rake&#8217; and the players compete with one another. But I don&#8217;t see that happening: The money&#8217;s not big enough and casinos aren&#8217;t likely to settle for a percentage of your bankroll when they could have the whole thing.
