{"id":13671,"date":"2014-05-29T14:06:03","date_gmt":"2014-05-29T22:06:03","guid":{"rendered":"https:\/\/www.lasvegasadvisor.com\/stiffs-and-georges\/?p=13671"},"modified":"2014-05-29T14:40:38","modified_gmt":"2014-05-29T22:40:38","slug":"stations-waning-clout-off-the-rez-with-scotus","status":"publish","type":"post","link":"https:\/\/www.lasvegasadvisor.com\/stiffs-and-georges\/stations-waning-clout-off-the-rez-with-scotus\/","title":{"rendered":"Station&#8217;s waning clout; Off the rez with SCOTUS"},"content":{"rendered":"<p><strong><a href=\"https:\/\/www.lasvegasadvisor.com\/stiffs-and-georges\/wp-content\/uploads\/2011\/04\/Horne.jpg\"><img loading=\"lazy\" class=\"alignright  wp-image-6256\" src=\"https:\/\/www.lasvegasadvisor.com\/stiffs-and-georges\/wp-content\/uploads\/2011\/04\/Horne.jpg\" alt=\"Horne\" width=\"146\" height=\"159\" \/><\/a>Station Casinos<\/strong>&#8216; insistence on re-litigating the issue of slot parlors in Nevada <a href=\"http:\/\/www.reviewjournal.com\/business\/casinos-gaming\/push-bill-draft-define-restricted-gaming-locations-fails\" target=\"_blank\">seems to have finally driven some officials to the end of their patience<\/a>.\u00a0Assembly Majority Leader <strong>William Horne<\/strong> (D, right),\u00a0the industry&#8217;s primary water carrier, tried to plump for a bill to define how much gambling is or isn&#8217;t &#8220;incidental&#8221; to a tavern&#8217;s revenue stream &#8212; an issue that had been thrashed out during the 2013 Legislature, at least to the extent of requiring <strong>Dotty&#8217;s<\/strong>-style operations <a href=\"https:\/\/mail.google.com\/mail\/u\/0\/#inbox\/1463fbecf0ca42e7\" target=\"_blank\">to make more than a pretense<\/a> of offering food and drink.<\/p>\n<p>Noting the recency of that law, tavern owner <strong>Randy Miller<\/strong> sensibly suggested that the lawmakers give it time to take effect. Station ally <strong>Steve Sisolak<\/strong> painted a picture of <!--more-->mini-casinos infiltrating neighborhoods <em>en masse<\/em>. (But what, then, of slot routes?) Station, mind you, has its own set of off-brand, mini-casinos (<strong>Wildfire<\/strong>, etc.) and finds itself in the position of the pot that called the kettle black.<\/p>\n<p>Complaining that the issue has\u00a0\u201cbeen vetted many, many times,\u201d\u00a0<strong>Nevada Gaming Commission<\/strong> Chairman <strong>Peter Bernhard <\/strong>said that\u00a0\u201cloud and persistent <a href=\"https:\/\/www.lasvegasadvisor.com\/stiffs-and-georges\/wp-content\/uploads\/2010\/06\/station1.jpg\"><img loading=\"lazy\" class=\"alignleft size-thumbnail wp-image-3383\" src=\"https:\/\/www.lasvegasadvisor.com\/stiffs-and-georges\/wp-content\/uploads\/2010\/06\/station1-150x112.jpg\" alt=\"station1\" width=\"150\" height=\"112\" srcset=\"https:\/\/www.lasvegasadvisor.com\/stiffs-and-georges\/wp-content\/uploads\/2010\/06\/station1-150x112.jpg 150w, https:\/\/www.lasvegasadvisor.com\/stiffs-and-georges\/wp-content\/uploads\/2010\/06\/station1-300x225.jpg 300w, https:\/\/www.lasvegasadvisor.com\/stiffs-and-georges\/wp-content\/uploads\/2010\/06\/station1.jpg 340w\" sizes=\"(max-width: 150px) 100vw, 150px\" \/><\/a>competitor has continued to bring this to everyone\u2019s attention,\u201d he said of Station.\u00a0\u201cThe county commission and city councils should make those decisions &#8230;\u00a0Just because you happen to see them more than you\u2019ve seen them before, it is because people with a competitive interest have brought them to our attention.\u201d <a href=\"http:\/\/cdcgamingreports.com\/election-betting-proposal-nixed-by-nevada-panel\/\" target=\"_blank\" class=\"broken_link\">He suggested deleting &#8220;incidental,&#8221;<\/a> whereby the statute would ban taverns\u00a0\u201cif the operation of slot machines is &#8230;\u00a0the primary business.\u201d<\/p>\n<p>Added\u00a0<strong>Gaming Control Board<\/strong> Chairman <strong>A.G. Burnett<\/strong>,\u00a0\u201cWe really have heard enough on this issue.\u201d Station, it would seem, is trying the endurance\u00a0of regulators. Ironically, it has a point: How many Dotty&#8217;s would survive without their 15 slot machines apiece? Then again, how many of Station&#8217;s hole-in-the-wall\u00a0operations would, either? Station could always just up and buy out Dotty&#8217;s but that would put it in contradiction with itself, now wouldn&#8217;t \u00a0it?<\/p>\n<p><strong>In other business<\/strong>, a proposal to allow wagering on election results was found to be in bad taste.\u00a0\u201cFrankly, I think that something as import as elections, as opposed to games, should not be the subject of wagering in our state,\u201d state Sen. <strong>Greg Brower<\/strong> (R) lectured colleague <strong>Tick Segerblom<\/strong> (D). It could still be resurrected in the 2015 Lege, so maybe the third time will be the charm for Segerblom, who tried this gambit last year.<\/p>\n<p><strong>Happy 20th anniversary<\/strong> to casinos in <strong>Missouri<\/strong>, which &#8212; despite a few<br \/>\n<a href=\"https:\/\/www.lasvegasadvisor.com\/stiffs-and-georges\/wp-content\/uploads\/2014\/05\/Retired_Admiral_casino_ship.jpg\"><img loading=\"lazy\" class=\"alignleft size-medium wp-image-13675\" src=\"https:\/\/www.lasvegasadvisor.com\/stiffs-and-georges\/wp-content\/uploads\/2014\/05\/Retired_Admiral_casino_ship-300x225.jpg\" alt=\"Retired_Admiral_casino_ship\" width=\"300\" height=\"225\" srcset=\"https:\/\/www.lasvegasadvisor.com\/stiffs-and-georges\/wp-content\/uploads\/2014\/05\/Retired_Admiral_casino_ship-300x225.jpg 300w, https:\/\/www.lasvegasadvisor.com\/stiffs-and-georges\/wp-content\/uploads\/2014\/05\/Retired_Admiral_casino_ship-150x112.jpg 150w, https:\/\/www.lasvegasadvisor.com\/stiffs-and-georges\/wp-content\/uploads\/2014\/05\/Retired_Admiral_casino_ship-1024x768.jpg 1024w, https:\/\/www.lasvegasadvisor.com\/stiffs-and-georges\/wp-content\/uploads\/2014\/05\/Retired_Admiral_casino_ship.jpg 1600w\" sizes=\"(max-width: 300px) 100vw, 300px\" \/><\/a>false starts and many constitutional amendments (<a href=\"http:\/\/www.stltoday.com\/news\/local\/govt-and-politics\/political-fix\/missouri-s-casino-industry-turns-today-is-it-a-winner\/article_79d0b57f-bfcc-5733-bc\" target=\"_blank\" class=\"broken_link\">see timeline<\/a>) &#8212; began operating two decades ago. It&#8217;s outlived the first riverboat &#8212; the <em>Admiral<\/em> &#8212; and also a failed <strong>Boyd Gaming<\/strong> casino in <strong>Kansas City<\/strong>. Along the way it&#8217;s been <a href=\"http:\/\/www.stltoday.com\/missouri-casinos-map-and-chart\/image_65bad22d-a977-56fe-ae0b-9702a4def802.html\" target=\"_blank\">a boon to the state&#8217;s tax base<\/a>, although not as much as it used to be.<\/p>\n<p><span style=\"color: #000000;\">\u201cIt\u2019s different than what I had hoped it would have been,\u201d laments state Rep. <strong>Herbert Fallert<\/strong> (D), one of the industry&#8217;s founding fathers.\u00a0\u201cI wish it would have helped the smaller communities.\u00a0I\u2019m happy that it\u2019s helped economic development and it\u2019s helped education. But it kind of got away from the original idea\u201d of bringing wealth to rural Missouri, agglomerating instead around the big cities. Gaming proceeds <a href=\"http:\/\/www.stltoday.com\/missouri-gaming-revenue-chart\/image_e3f692d9-630a-507d-bc7f-36e910cbe5fd.html\" target=\"_blank\">having peaked<\/a>, the recrimination is utterly predictable.<\/span><\/p>\n<p>* The <strong>Supreme Court<\/strong> \u00a0has carved a big notch in the <strong>Indian Gaming Regulatory Act<\/strong>. Under the terms of <a href=\"http:\/\/www.washingtontimes.com\/news\/2014\/may\/27\/supreme-court-says-mich-cant-block-indian-casino\/\/\" target=\"_blank\" class=\"broken_link\">this week&#8217;s bombshell decision<\/a>, only <a href=\"https:\/\/www.lasvegasadvisor.com\/stiffs-and-georges\/wp-content\/uploads\/2014\/05\/Schuette.jpg\"><img loading=\"lazy\" class=\"alignright size-full wp-image-13674\" src=\"https:\/\/www.lasvegasadvisor.com\/stiffs-and-georges\/wp-content\/uploads\/2014\/05\/Schuette.jpg\" alt=\"Schuette\" width=\"201\" height=\"251\" srcset=\"https:\/\/www.lasvegasadvisor.com\/stiffs-and-georges\/wp-content\/uploads\/2014\/05\/Schuette.jpg 201w, https:\/\/www.lasvegasadvisor.com\/stiffs-and-georges\/wp-content\/uploads\/2014\/05\/Schuette-120x150.jpg 120w\" sizes=\"(max-width: 201px) 100vw, 201px\" \/><\/a>casinos on reservation land are subject to IGRA. Buy some acreage off the rez and the feds can&#8217;t touch you, sayeth SCOTUS (<a href=\"http:\/\/www.mlive.com\/lansing-news\/index.ssf\/2014\/05\/us_supreme_court_rules_in_favo.html\" target=\"_blank\" class=\"broken_link\">which left open the question of whether the plot in question is indeed Indian land<\/a>\u00a0but implied it was not). Instead of frontally attacking the <strong>Bay Mills Indian Community<\/strong>&#8216;s casino, <strong>Michigan<\/strong> Attorney General <strong>Bill Schuette<\/strong>\u00a0(<em>right<\/em>) will &#8220;<span style=\"color: #000000;\">target individual tribal members for civil and criminal penalties. This is in line with Justice <strong>Elena Kagan<\/strong>&#8216;s majority opinion that\u00a0<span style=\"color: #363636;\">&#8220;<em>Michigan must therefore resort to other mechanisms, including legal actions against the responsible individuals, to resolve this dispute<\/em>.&#8221;<\/span><\/span><\/p>\n<p>Schuette tried to spin the ruling as a win: &#8220;<span style=\"color: #363636;\"><em>Today the <strong>U.S. Supreme Cour<\/strong>t affirmed the state&#8217;s ability to restrain the illegal expansion of tribal gaming on state lands.\u00a0The 5-4 decision upheld the injunctive power of states to sue tribal leaders to shut down illegal casinos, and reaffirmed the states&#8217; authority to bring criminal charges against anyone engaging in illegal gaming on state lands<\/em>.&#8221; The\u00a0<strong>Sault Ste. Marie Tribe of Chippewa Indians<\/strong>, however, implied it was going to move ahead with a downtown <strong>Lansing<\/strong> casino on the strength of the Bay Mills ruling.<\/span><\/p>\n<p><span style=\"color: #000000;\">Justice <strong>Antonin Scalia<\/strong> had voted with the majority in the 1998 decision upon which this week&#8217;s ruling rested.
