A July 1 closure has been stayed until July 10 while Judge <strong>Eliza Ovrom<\/strong> ponders the merits of the case. She&#8217;s scheduled final arguments for the 10th, leaving Argosy teetering on a precipice. Judge Ovrom calls the stay &#8220;breathing room&#8221;\u00a0while she combs through the pros and cons.\u00a0<span style=\"color: #222222;\">&#8220;I don&#8217;t think there&#8217;s significant harm to any other party by this brief stay,&#8221; she said.<\/span><\/p>\n<p>Penn attorneys made the argument that no one was being harmed by keeping the casino open until Aug. 1. An attorney for\u00a0<span style=\"color: #222222;\"><strong>Hard Rock Hotel &amp; Casino Sioux City<\/strong> responded,\u00a0\u00a0&#8220;The court can&#8217;t give them what they don&#8217;t have, which is an agreement with a [nonprofit].&#8221; Ovrom&#8217;s timeline still gives Penn time to appeal to the<strong> Iowa Supreme Court<\/strong> before Aug. 1.\u00a0Iowa Assistant Attorney General <strong>John Lundquist<\/strong> faulted Penn for being dilatory in appeal its shutdown date, precipitating the crisis: &#8220;&#8221;If this harm was so great and apparent going forward, why weren&#8217;t we litigating this case weeks ago, rather than wait to today?&#8221;<\/span><!--more--><\/p>\n<p>Penn attorney <strong>Mark Weinhardt<\/strong> had a surprise\u00a0up his sleeve, when he &#8220;<span style=\"color: #222222;\">told the court if a more permanent stay of the IRGC action were granted, Argosy would restart revenue-sharing to [<strong>Missouri River Historic Development<\/strong>]. That would ensure that the nonprofit was not harmed by the boat staying open, he said.&#8221; Penn&#8217;s endgame is to stay open indefinitely, even though acknowledges that Hard Rock will probably become the premier casino in the market, which it thinks will grow.<\/span><\/p>\n<p><strong>Three idiots<\/strong> in the great state of <strong>New Jersey<\/strong> <a href=\"http:\/\/cdcgamingreports.com\/pals-who-tossed-1-million-lotto-ticket-sue-new-jersey-for-cash\/\" target=\"_blank\" rel=\"noopener noreferrer\" class=\"broken_link\">threw out a winning lottery ticket<\/a>. Now they want the Garden State to rectify their mistake. They&#8217;re suing Gov. <strong>Chris Christie<\/strong>, among other parties for not being more tech-savvy. The plaintiffs&#8217; argument that\u00a0\u201cwe do everything on our phones and computers now,\u201d strikes me as less than compelling. Christie, meanwhile, has <a href=\"http:\/\/cdcgamingreports.com\/new-jersey-legislators-make-one-more-try-on-sports-betting-law\/\" target=\"_blank\" rel=\"noopener noreferrer\" class=\"broken_link\">a bill to permit unregulated sports wagering<\/a> sitting on his desk.<\/p>\n<p><strong><a href=\"https:\/\/www.lasvegasadvisor.com\/stiffs-and-georges\/wp-content\/uploads\/2014\/06\/Scarlet-Pearl.jpg\"><img loading=\"lazy\" class=\"alignleft size-medium wp-image-13944\" src=\"https:\/\/www.lasvegasadvisor.com\/stiffs-and-georges\/wp-content\/uploads\/2014\/06\/Scarlet-Pearl-300x192.jpg\" alt=\"Scarlet Pearl\" width=\"300\" height=\"192\" srcset=\"https:\/\/www.lasvegasadvisor.com\/stiffs-and-georges\/wp-content\/uploads\/2014\/06\/Scarlet-Pearl-300x192.jpg 300w, https:\/\/www.lasvegasadvisor.com\/stiffs-and-georges\/wp-content\/uploads\/2014\/06\/Scarlet-Pearl-150x96.jpg 150w, https:\/\/www.lasvegasadvisor.com\/stiffs-and-georges\/wp-content\/uploads\/2014\/06\/Scarlet-Pearl.jpg 600w\" sizes=\"(max-width: 300px) 100vw, 300px\" \/><\/a>D&#8217;Iberville<\/strong>, <strong>Mississippi<\/strong>, has joined the ranks of casino towns on the <strong>Gulf Coast<\/strong>, after <strong>Scarlet Pearl Casino<\/strong> <a href=\"http:\/\/www.sunherald.com\/2014\/06\/26\/5670482\/approved-construction-to-start.html\" target=\"_blank\" rel=\"noopener noreferrer\" class=\"broken_link\">was approved for construction<\/a>. The $250 million project&#8217;s scheduled amenities include 36 holes of miniature golf. Mindful of recent declines in revenue, <strong>Mississippi Gaming Commission<\/strong> Executive Director <strong>Allen Godfrey<\/strong> said saturation was not his board&#8217;s concern, Mississippi being a free-market state with unlimited licenses. &#8220;That&#8217;s the market [the state] chose.&#8221; A <strong>Jacobs Entertainment<\/strong> casino project in <strong>Diamondhead<\/strong> <a href=\"http:\/\/www.clarionledger.com\/story\/news\/2014\/06\/26\/gulf-casino-rulings\/11411377\/\" target=\"_blank\" rel=\"noopener noreferrer\" class=\"broken_link\">got the thumbs-down<\/a>, however &#8230; <a href=\"http:\/\/cdcgamingreports.com\/gulf-casino-moves-ahead-while-second-rejected\/\" target=\"_blank\" rel=\"noopener noreferrer\" class=\"broken_link\">for being too far inland<\/a>. Back to the drawing board, fellas.<\/p>\n<p><strong>A lawsuit<\/strong> against <strong>Boyd Gaming<\/strong> has been certified for class-action status. It involves half-dozen employees (but potentially thousands more) <a href=\"https:\/\/www.lasvegasadvisor.com\/stiffs-and-georges\/wp-content\/uploads\/2011\/04\/boyd-gaming-200.jpg\"><img loading=\"lazy\" class=\"alignleft size-full wp-image-6232\" src=\"https:\/\/www.lasvegasadvisor.com\/stiffs-and-georges\/wp-content\/uploads\/2011\/04\/boyd-gaming-200.jpg\" alt=\"boyd-gaming-200\" width=\"80\" height=\"80\" \/><\/a>who accuse Boyd of shorting them on overtime pay. The company also stands accused of rounding down employee timesheets to the lower quarter-hour. The lawsuit also alleges that, in a <strong>Walmart<\/strong>-style move, Boyd has required employees to work off the clock. <strong>The Orleans<\/strong> and <strong>Gold Coast<\/strong> are identified as the sites of some of the alleged abuses.<\/p>\n<p>U.S. District Court <strong>James Mahan<\/strong> found that Boyd &#8220;deprives hourly, non-exempt employees of wages for time worked &#8230;\u00a0\u00a0the plaintiffs have made a sufficient showing to justify a collective action for all hourly, non-exempt, cash-handling employees at <strong>The Orleans<\/strong> and <strong>Gold Coast<\/strong> casinos.\u201d What plaintiffs failed to prove, Mahan wrote, was the existence of a company-wide policy of wage deprivation.
