A federal appeals court <a href=\"http:\/\/www.bostonherald.com\/business\/business_markets\/2015\/02\/fed_judge_nixes_caesars_suit\" target=\"_blank\" rel=\"noopener noreferrer\">ruled in favor<\/a> of the <strong>Massachusetts Gaming Commission<\/strong> and cleared Chairman <strong>Stephen Crosby<\/strong> of any charges of untoward conduct. Judge <strong>David Souter<\/strong> ruled that the MGC had &#8220;highly discretionary&#8221; powers, particularly when the license carried &#8220;substantial risks of commercial and social harm.\u201d Citing recent <strong>Supreme Court<\/strong> precedent, it also answered Caesars&#8217; claim of deprivation of property rights through an\u00a0\u201carbitrary exercise of government power&#8221; by ruling that submission of a casino bid does not a property right create. To quote the legalese, \u00a0<!--more-->would &#8220;Massachusetts law recognize in the request for action by the commission a source of expectable value sufficiently reliable to be protected as property\u201d? \u201cThe licensing cases point to a negative answer, and the casino licensing law does the same with unmistakable emphasis.\u201d<\/p>\n<p>On another front, Caesars <a href=\"http:\/\/www.uspoker.com\/blog\/caesars-pokerstars-join-forces-oppose-adelson\/9549\/\" target=\"_blank\" rel=\"noopener noreferrer\" class=\"broken_link\">is teaming up with another industry giant<\/a> (and sometime rival), <strong>PokerStars<\/strong>, to push back against <strong>Sheldon Adelson<\/strong>&#8216;s campaign to outlaw <strong>Internet<\/strong> wagering. &#8220;The alliance between PokerStars and Caesars &#8230;\u00a0is a clear <a href=\"https:\/\/www.lasvegasadvisor.com\/stiffs-and-georges\/wp-content\/uploads\/2014\/03\/Chaffetz.jpg\"><img loading=\"lazy\" class=\"alignright size-full wp-image-13058\" src=\"https:\/\/www.lasvegasadvisor.com\/stiffs-and-georges\/wp-content\/uploads\/2014\/03\/Chaffetz.jpg\" alt=\"Chaffetz\" width=\"207\" height=\"243\" srcset=\"https:\/\/www.lasvegasadvisor.com\/stiffs-and-georges\/wp-content\/uploads\/2014\/03\/Chaffetz.jpg 207w, https:\/\/www.lasvegasadvisor.com\/stiffs-and-georges\/wp-content\/uploads\/2014\/03\/Chaffetz-127x150.jpg 127w\" sizes=\"(max-width: 207px) 100vw, 207px\" \/><\/a>indication that they are taking Sheldon Adelson\u2019s lobbying efforts seriously,&#8221; writes <strong>Steve Ruddock<\/strong>. \u00a0&#8220;And well they should.&#8221; \u00a0The &#8220;Restoration of America&#8217;s Wire Act&#8221; bill, believed to \u00a0have been written\u00a0by Adelson&#8217;s lackeys, has been reintroduced in the <strong>House of Representatives<\/strong> by Rep. <strong>Jason Chaffetz<\/strong> (R, <em>right<\/em>). Hey Jason, we know you Utahns frown upon gambling, but do you have to lay your negative trip on the whole country?<\/p>\n<p>As Caesars&#8217; <strong>Jan Jones Blackhurst<\/strong> said, online-gambling companies have enemies and &#8220;clearly it\u2019s not <strong>Amaya<\/strong> and PokerStars. They are a strong ally in the space.\u201d Amaya spokesman Eric Hollreiser echoed Blackhurst&#8217;s comments, saying, &#8220;intends to work closely with Caesars and others to promote the U.S. online gaming industry and support responsible regulation at the state and federal levels.\u201d<\/p>\n<p>Meanwhile, back in <strong>Washington, D.C.<\/strong>, Sen. <strong>Lindsey Graham<\/strong> (R, <em>below<\/em>) <a href=\"http:\/\/www.reviewjournal.com\/news\/nevada\/ag-nominee-lynch-unlikely-reverse-doj-course-web-gambling\" target=\"_blank\" rel=\"noopener noreferrer\">was trying to back<\/a> Attorney General Designate <strong>Loretta Lynch<\/strong> into a corner on the <strong>Justice Departmen<\/strong>t&#8217;s 2011 reinterpretation of the <strong>Wire Ac<\/strong>t, the one which opened the door to Internet gambling. Lynch offered to examine the ruling but noted that a reversal would be an extraordinary act, <a href=\"https:\/\/www.lasvegasadvisor.com\/stiffs-and-georges\/wp-content\/uploads\/2014\/11\/Graham.jpg\"><img loading=\"lazy\" class=\"alignleft size-full wp-image-14976\" src=\"https:\/\/www.lasvegasadvisor.com\/stiffs-and-georges\/wp-content\/uploads\/2014\/11\/Graham.jpg\" alt=\"Graham\" width=\"199\" height=\"253\" srcset=\"https:\/\/www.lasvegasadvisor.com\/stiffs-and-georges\/wp-content\/uploads\/2014\/11\/Graham.jpg 199w, https:\/\/www.lasvegasadvisor.com\/stiffs-and-georges\/wp-content\/uploads\/2014\/11\/Graham-117x150.jpg 117w\" sizes=\"(max-width: 199px) 100vw, 199px\" \/><\/a>caused only if the 2011 decision were found to be &#8220;unreasonable.&#8221; Prior to the 2011 reconsideration, the Wire Act had a carve-out for parimutuel wagering. Sen. <strong>Dianne Feinstein<\/strong> (D) offered that the case could be made that the original Wire Act could be interpreted to ban <em>all<\/em> forms of gambling. (At present, only sports betting is nixed.) That would certainly be unpopular in the 12-plus\u00a0states which have taken their lotteries online.<\/p>\n<p>\u201cBecause OLC helps the president fulfill his constitutional obligation to take care that the law be faithfully executed, it is my understanding that the Office strives to provide an objective assessment of the law using traditional tools of statutory interpretation,\u201d stated Lynch, which certainly doesn&#8217;t make it sound like a re-reinterpretation of the Wire Act is in the offing. She suggested that Graham take the matter into his hands, saying,\u00a0\u201cI would, of course, welcome the opportunity to work with you and other members of Congress to address concerns about online gambling through legislation.\u201d<\/p>\n<p>* In <strong>California<\/strong>,\u00a0the <strong>Rincon Band of Luise\u00f1o Indians<\/strong>,\u00a0the <strong>United Auburn Indian Community<\/strong>,\u00a0the <strong>Pala Band of Mission Indians<\/strong> and 20 card rooms renounced their support for a &#8220;bad actor&#8221; clause (in a nuanced sort of way) in Internet-gaming legislation\u00a0, &#8220;recognizing\u00a0that control of an entity may change over time in a way that resolves\u00a0regulatory concerns.&#8221; That&#8217;d be a big boost for PokerStars, as it acknowledged in a statement. However, as long as the <strong>Pechanga<\/strong> and <strong>Agua Caliente<\/strong> bands remain opposed to PokerStars, its Golden State aspirations are seen as an uphill climb.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Caesars Entertainment&#8216;s last hopes for a Massachusetts casino are slipping through its fingers.
