Benjamin Goldgar<\/strong>, handing a victory to the second-tier debtors in the <a href=\"https:\/\/www.lasvegasadvisor.com\/stiffs-and-georges\/wp-content\/uploads\/2014\/10\/caesarscasino_1.png\"><img loading=\"lazy\" class=\"alignright size-full wp-image-14803\" src=\"https:\/\/www.lasvegasadvisor.com\/stiffs-and-georges\/wp-content\/uploads\/2014\/10\/caesarscasino_1.png\" alt=\"caesarscasino_1\" width=\"240\" height=\"240\" srcset=\"https:\/\/www.lasvegasadvisor.com\/stiffs-and-georges\/wp-content\/uploads\/2014\/10\/caesarscasino_1.png 240w, https:\/\/www.lasvegasadvisor.com\/stiffs-and-georges\/wp-content\/uploads\/2014\/10\/caesarscasino_1-150x150.png 150w\" sizes=\"(max-width: 240px) 100vw, 240px\" \/><\/a><strong>Caesars Entertainment<\/strong> bankruptcy. <a href=\"http:\/\/www.wsj.com\/articles\/caesars-junior-creditors-can-keep-voice-in-case-1425510784\" target=\"_blank\">Caesars had sought to have the creditors&#8217; watchdog committee dissolved<\/a> into one representing unsecured creditors. As the <em>Wall Street Journal<\/em> summarized, the committee has &#8220;challenged the legality of several prebankruptcy transactions [<strong>Caesars Entertainment Operating Co<\/strong>.]\u00a0made with its parent company.&#8221;<\/p>\n<p>At issue are transactions which transferred $6 billion in assets to other Caesars branches. Paradoxically, <a href=\"http:\/\/www.wsj.com\/articles\/bondholders-wary-of-caesars-bid-for-a-bankruptcy-examiner-1424989923\" target=\"_blank\">the second-tier lenders want to probe the matter on their own<\/a> while Caesars has called for an independent examiner. So has a group of bondholders and unsecured creditors represented by <strong>Wilmington Trust<\/strong>. The second-tier bondholders allege that <!--more-->Caesars\u00a0\u201crequested an examination of the challenged transactions, not to find out what they did or what they should do now to remedy their wrongs, but rather to forestall creditor investigations and access to documents.\u201d<\/p>\n<p>Caesars is offering the proposed examiner $10 million, provided it can get the job done in 120 days and creditors&#8217; examinations are put on hold. Wilmington Trust wants to nix that, citing a 1993 judicial precedent that read,\u00a0\u201cone cannot think of a solid reason why a debtor would request an investigation of its own affairs unless it is used as a strategic move to prevent a harsher alternative.\u201d<\/p>\n<p>Although inclined to approve some form of investigation, Judge Goldgar hasn&#8217;t delved into the paperwork yet and said he&#8217;s not consequently ready to rule. He did, however, OK Caesars&#8217; request to keep paying employees and vendors. He set to one side for the time being creditors&#8217; opposition to having\u00a0<strong>Kirkland &amp; Ellis LLP<\/strong> appointed to represent them. The objection is that the firm has &#8220;taken a dive,&#8221; having represented Caesars&#8217; owners, <strong>Texas Pacific Group<\/strong> and <strong>Apollo Management<\/strong>.<\/p>\n<p>* The <strong>Dotty&#8217;s<\/strong> imbroglio has become big enough news to attract the attention of the <em>Los Angeles Times<\/em>. Basically, having spurned absorption into <strong>Station Casinos<\/strong>, it has now <a href=\"https:\/\/www.lasvegasadvisor.com\/stiffs-and-georges\/wp-content\/uploads\/2014\/10\/Sisolak.jpg\"><img loading=\"lazy\" class=\"alignleft size-full wp-image-14730\" src=\"https:\/\/www.lasvegasadvisor.com\/stiffs-and-georges\/wp-content\/uploads\/2014\/10\/Sisolak.jpg\" alt=\"Sisolak\" width=\"210\" height=\"201\" srcset=\"https:\/\/www.lasvegasadvisor.com\/stiffs-and-georges\/wp-content\/uploads\/2014\/10\/Sisolak.jpg 210w, https:\/\/www.lasvegasadvisor.com\/stiffs-and-georges\/wp-content\/uploads\/2014\/10\/Sisolak-150x143.jpg 150w\" sizes=\"(max-width: 210px) 100vw, 210px\" \/><\/a>become Station&#8217;s Enemy Number One, with the dirty work being done by tame politicians like <strong>Clark County<\/strong> Commissioner <strong>Steve Sisolak <\/strong>(left). The <em>LAT<\/em> profiles the prototypical Dotty&#8217;s customer &#8212; Vegas executive assistant <strong>Becky Johnson<\/strong>, for whom Dotty&#8217;s workers &#8220;workers have studied her preference for <strong>Camel Crush<\/strong> cigarettes and sugarless <strong>Monster<\/strong> energy drinks.&#8221; It also lays out the Dotty&#8217;s model of decorous behavior, convenience food, sunlight through the windows and clocks on the wall. It&#8217;s basically the casino for people who don&#8217;t like casinos.<\/p>\n<p>That chafes other operators, whether giants like Station or one-offs such as aptly named <strong>Three Angry Wives<\/strong>. Having failed to squelch Dotty&#8217;s at the county level, it&#8217;s in the cross-hairs of the Lege this year. State Sen. <strong>Tick Segerblom<\/strong> (D, <em>below<\/em>) has introduced a bill to create a new, higher (naturally) tax category for Dotty&#8217;s. Hyperbole in full flood, Segerblom said,\u00a0\u201cIf <a href=\"https:\/\/www.lasvegasadvisor.com\/stiffs-and-georges\/wp-content\/uploads\/2014\/11\/Tick-Segerblom.jpg\"><img loading=\"lazy\" class=\"alignright size-full wp-image-15023\" src=\"https:\/\/www.lasvegasadvisor.com\/stiffs-and-georges\/wp-content\/uploads\/2014\/11\/Tick-Segerblom.jpg\" alt=\"Tick Segerblom\" width=\"198\" height=\"257\" srcset=\"https:\/\/www.lasvegasadvisor.com\/stiffs-and-georges\/wp-content\/uploads\/2014\/11\/Tick-Segerblom.jpg 198w, https:\/\/www.lasvegasadvisor.com\/stiffs-and-georges\/wp-content\/uploads\/2014\/11\/Tick-Segerblom-115x150.jpg 115w\" sizes=\"(max-width: 198px) 100vw, 198px\" \/><\/a>little old ladies want someplace other than a sports bar with its smoke and men, that\u2019s fine.\u00a0But this business model is causing us to lose the ability to earn revenues to help pay for gambling\u2019s negative societal impacts.** We can\u2019t allow Dotty\u2019s to get away scot-free and make gazillions of dollars.\u201d<\/p>\n<p>(** &#8212;\u00a0It&#8217;s interesting that a legislator would be moved to acknowledge problem gambling in <strong>Nevada<\/strong> &#8212; but only in order to squelch a vexingly successful business model.)<\/p>\n<p>Station Vice President for Government Affairs <strong>Mike Sloan<\/strong> sounds fatigued by the long-running Station vs. Dotty&#8217;s rivalry: &#8220;[Owner Craig Estey]\u00a0goes round and round, saying he\u2019ll do whatever to follow the law, but he never does.\u00a0He\u2019s like the Music Man, and there\u2019s trouble in River City.\u201d Considering the disastrous\u00a0Station bankruptcy, Sloan ought to think twice about invoking\u00a0trouble in River City.<\/p>\n<p>Sisolak colleague <strong>Chris Giunchigliani<\/strong> at least sees things from the Dotty&#8217;s perspective, saying,\u00a0\u201cIt\u2019s the ugly side of Nevada gaming politics.\u00a0If you are an entrepreneur who becomes too successful, you will be perceived as a threat.
