According to <em>Forbes<\/em>, <a href=\"http:\/\/www.forbes.com\/sites\/antoinegara\/2015\/03\/17\/mgm-resorts-surges-activist-reit-las-vegas-macau-taxes\/\" target=\"_blank\" class=\"broken_link\">MGM is expected to return to <\/a><a href=\"https:\/\/www.lasvegasadvisor.com\/stiffs-and-georges\/wp-content\/uploads\/2015\/02\/MGM_Cotai.jpg\"><img loading=\"lazy\" class=\"alignright size-medium wp-image-15489\" src=\"https:\/\/www.lasvegasadvisor.com\/stiffs-and-georges\/wp-content\/uploads\/2015\/02\/MGM_Cotai-300x189.jpg\" alt=\"MGM_Cotai\" width=\"300\" height=\"189\" srcset=\"https:\/\/www.lasvegasadvisor.com\/stiffs-and-georges\/wp-content\/uploads\/2015\/02\/MGM_Cotai-300x189.jpg 300w, https:\/\/www.lasvegasadvisor.com\/stiffs-and-georges\/wp-content\/uploads\/2015\/02\/MGM_Cotai-150x94.jpg 150w, https:\/\/www.lasvegasadvisor.com\/stiffs-and-georges\/wp-content\/uploads\/2015\/02\/MGM_Cotai.jpg 625w\" sizes=\"(max-width: 300px) 100vw, 300px\" \/><\/a><a href=\"http:\/\/www.forbes.com\/sites\/antoinegara\/2015\/03\/17\/mgm-resorts-surges-activist-reit-las-vegas-macau-taxes\/\" target=\"_blank\" class=\"broken_link\">profitability this year<\/a> and &#8220;some of\u00a0those expected profits will leak into government coffers.&#8221; REITs are tax-exempt, which is what&#8217;s making them so sexy to the gaming sector right now. One of the planks in Litt&#8217;s platform is asset sales and not even <strong>Macao<\/strong> is sacred. According to a statement release from his <strong>Land &amp; Buildings<\/strong> fund, &#8220;spinning out or monetizing <strong>MGM China<\/strong> would focus investors on attractive domestic trends.\u201d<\/p>\n<p>However, in <strong>Las Vegas Sands<\/strong> director <strong>Jason Ader<\/strong> <em>Forbes<\/em> has finally found someone who will address the <!--more-->elephant in the middle of the room: the imperative to return 90% of taxable earnings to shareholders. He told the magazine what you and I already know: &#8220;casinos are notoriously capital intensive businesses that might not be a great fit for REIT structures.&#8221; Or, in Ader&#8217;s own words,\u00a0\u201cit\u2019s short-term financial alchemy that\u00a0can create long-term problems.\u201d<\/p>\n<p>Throttling the capex budget in this fashion would be particularly problematic for MGM, <a href=\"https:\/\/www.lasvegasadvisor.com\/stiffs-and-georges\/wp-content\/uploads\/2014\/04\/MGM-Springfield-detail.jpg\"><img loading=\"lazy\" class=\"alignleft size-medium wp-image-13326\" src=\"https:\/\/www.lasvegasadvisor.com\/stiffs-and-georges\/wp-content\/uploads\/2014\/04\/MGM-Springfield-detail-300x196.jpg\" alt=\"MGM Springfield detail\" width=\"300\" height=\"196\" srcset=\"https:\/\/www.lasvegasadvisor.com\/stiffs-and-georges\/wp-content\/uploads\/2014\/04\/MGM-Springfield-detail-300x196.jpg 300w, https:\/\/www.lasvegasadvisor.com\/stiffs-and-georges\/wp-content\/uploads\/2014\/04\/MGM-Springfield-detail-150x98.jpg 150w, https:\/\/www.lasvegasadvisor.com\/stiffs-and-georges\/wp-content\/uploads\/2014\/04\/MGM-Springfield-detail.jpg 380w\" sizes=\"(max-width: 300px) 100vw, 300px\" \/><\/a>which has a raft of capital-intensive projects in train, including <strong>MGM Cotai<\/strong> (<em>above<\/em>), <strong>MGM Springfield<\/strong>\u00a0(<em>left<\/em>) and <strong>MGM National Harbor<\/strong>. Besides, maintaining a slew of high-end hotels on the <strong>Las Vegas Strip<\/strong> doesn&#8217;t come cheap. Ader also sees a pitfall in putting an arms-length relationship between MGM&#8217;s properties and their management. As <em>Forbes<\/em> puts it, &#8220;a lodging business separated from its real estate and paying occupancy costs\u00a0might need to negotiate hard on rents and capital plans to find\u00a0spending room.&#8221;<\/p>\n<p>Land &amp; Buildings has handwaved away such concerns. That may be one of the many reasons that <strong>Wall Street<\/strong> analysts put little stock (pun intended) in Litt&#8217;s attempt to force CEO <strong>Jim Murren<\/strong>&#8216;s hand.<\/p>\n<p>* By repealing state laws pertaining to sports betting, is <strong>New Jersey<\/strong> trying to institute sports betting at racinos and casinos? That&#8217;s the argument made to the <strong>Third Circuit Court of Appeals<\/strong> by <strong>NCAA<\/strong> and major-league sports attorney <strong>Paul Clement<\/strong>. It&#8217;s also a <a href=\"https:\/\/www.lasvegasadvisor.com\/stiffs-and-georges\/wp-content\/uploads\/2013\/11\/New-Jersey-flag.jpg\"><img loading=\"lazy\" class=\"alignright size-full wp-image-12131\" src=\"https:\/\/www.lasvegasadvisor.com\/stiffs-and-georges\/wp-content\/uploads\/2013\/11\/New-Jersey-flag.jpg\" alt=\"New Jersey flag\" width=\"166\" height=\"183\" srcset=\"https:\/\/www.lasvegasadvisor.com\/stiffs-and-georges\/wp-content\/uploads\/2013\/11\/New-Jersey-flag.jpg 166w, https:\/\/www.lasvegasadvisor.com\/stiffs-and-georges\/wp-content\/uploads\/2013\/11\/New-Jersey-flag-136x150.jpg 136w\" sizes=\"(max-width: 166px) 100vw, 166px\" \/><\/a>line of reasoning called &#8220;Orwellian&#8221; by former U.S. Solicitor General <strong>Ted Olson<\/strong> (representing the Garden State) because it stands the state&#8217;s action on its head. <a href=\"http:\/\/www.northjersey.com\/news\/three-judge-panel-hears-appeal-of-n-j-sports-betting-1.1290631\" target=\"_blank\" class=\"broken_link\">Yesterday was the much-anticipated Third Circuit throwdown<\/a> between the major leagues and New Jersey, with high-powered legal talent in each corner.<\/p>\n<p>The Third Circuit had visited this question earlier, when sports betting was explicitly legal, and opened a loophole that racetrack <strong>Monmouth Park<\/strong> is trying to exploit. Invoking that noted jurist <strong>Dr. Seuss<\/strong>, legislative emissary <strong>Michael Griffinger<\/strong> said,\u00a0&#8220;I want to channel <em>Horton Hears a Who<\/em>: &#8216;I meant what I said, and I said what I meant&#8217;: We followed your guidance 100%.&#8221;<\/p>\n<p>&#8220;This doesn&#8217;t mean that Monmouth Park will be the Wild, Wild West of sports betting,&#8221; said track attorney <strong>Ron Riccio<\/strong>, trying to make the case that the tracks can police themselves. Despite some expression of skepticism, Judge <strong>Julio Fuentes<\/strong> concluded,\u00a0&#8220;<em>Laissez faire<\/em>, no licensing whatsoever.\u00a0I guess it&#8217;s not for us to say if that&#8217;s good or bad,&#8221; gladdening the hearts of free-market theorists everywhere. Now that arguments have been heard, the court will keep us on tenterhooks, not rendering an opinion until May.<\/p>\n<p>*\u00a0&#8220;Following the tremendous losses of <strong>Hurricanes Katrina<\/strong> and <strong>Rita<\/strong> in 2005, insurance companies quit offering policies in counties located on the hurricane-prone <strong>Texas<\/strong> Gulf <a href=\"https:\/\/www.lasvegasadvisor.com\/stiffs-and-georges\/wp-content\/uploads\/2015\/03\/Deshotel.jpg\"><img loading=\"lazy\" class=\"alignleft size-full wp-image-15746\" src=\"https:\/\/www.lasvegasadvisor.com\/stiffs-and-georges\/wp-content\/uploads\/2015\/03\/Deshotel.jpg\" alt=\"Deshotel\" width=\"100\" height=\"140\" \/><\/a>coast. Instead the homeowner&#8217;s only option was to purchase insurance through the high-risk pool system offered by [<strong>Texas Windstorm Insurance Association<\/strong>].\u00a0Since 2008&#8217;s <strong>Hurricane Ike<\/strong> hit the Gulf Coast with such severity and monetarily devastated the fund, TWIA is operating with a huge deficit. It was nearly $137 million short in 2013,&#8221; said Texas state Rep. <strong>Joe Deshotel<\/strong> (D, <em>left<\/em>).<\/p>\n<p>What&#8217;s that got to do with gambling? It&#8217;s Deshotel&#8217;s rationale for <a href=\"http:\/\/www.chron.com\/news\/local\/article\/Vegas-on-the-Texas-coast-6138637.php#photo-5741206\" target=\"_blank\">introducing a bill to legalize casino gambling in Texas<\/a>. The booty would come with some geographic constraints. &#8220;Full <strong>Las Vegas<\/strong>-style casinos will be permitted within a first-tier coastal county or second-tier county or in a county where its county seat is within 100 miles from a first- or second-tier county,&#8221; Deshotel told the <em>Houston Chronicle<\/em>. No need for Las Vegas Sands to fuel the corporate jet and fly\u00a0<strong>Sheldon Adelson<\/strong> to <strong>Austin<\/strong> just yet: Deshotel has no House co-sponsors and no Senate sponsors for his bill, which must be eventually passed by voters as a constitutional amendment to become law.
