In a warrantless search, G-men cut the <strong>Internet<\/strong> access to <strong>Paul Phua<\/strong>&#8216;s high-roller villa at <strong>Caesars Palace<\/strong>, then took a peek at the premises under the pretense (and guise) of being repairmen. Simply put,\u00a0&#8220;The government violated the defendant&#8217;s Fourth Amendment rights,&#8221; said U.S. District Judge <strong>Andrew Gordon<\/strong>. While the case against Phua is still alive, it&#8217;s on life support.<\/p>\n<p>As Judge Gordon wrote,\u00a0&#8220;Permitting the government to create the need for the occupant to invite a third party into his or her home would effectively allow the government to conduct warrantless searches of the vast majority of residences and hotel rooms in America.&#8221; The best the government could do by way of pushback was for the prosecution&#8217;s <strong>Kimberly Frayn<\/strong> to argue,\u00a0&#8220;There is not a constitutional right to <!--more-->DSL.&#8221; Ironically, while Phua will probably escape Uncle Sam&#8217;s wrath, six other defendants, including his son Darren, pled out to petty charges, forfeited cash and accepted five-year banishments from the U.S. It is unclear whether Judge Gordon&#8217;s ruling will change their fate.<\/p>\n<p>* Another state&#8217;s resistance to casino-style gambling is buckling at the knees. Lawmakers in <strong>Wyoming<\/strong> have embarked on a study that will look into &#8220;instant racing&#8221; (presumably for the benefit of <strong>Wyoming Downs<\/strong>), pokers, perhaps even full-fledged casinos. The state already has tribal gaming.\u00a0\u201cIf the <strong>Management Council<\/strong> decides that\u2019s where we want to go, or if this committee wants to push something like that through, we\u2019re looking at a two-year project,\u201d said\u00a0Sen. <strong>Leland Christensen<\/strong>, referring to a regulatory apparatus. Lawmakers also want to know <a href=\"http:\/\/trib.com\/business\/lawmakers-will-continue-studying-gambling-before-session\/article_e1b74603-8497-5ce6-b88e-c43a2faffeb8.html\" target=\"_blank\" rel=\"noopener noreferrer\">what is wagered on various games in other states<\/a>. If it&#8217;s\u00a0following the money with that much diligence, Wyoming&#8217;s fledgling effort must be taken seriously.<\/p>\n<p>* By contrast, a shift to the right in the Lege and a budget surplus are dooming attempts to expand gaming in <strong>Texas<\/strong>. That hasn&#8217;t deterred a flurry of bills from being filed. Most far-<a href=\"https:\/\/www.lasvegasadvisor.com\/stiffs-and-georges\/wp-content\/uploads\/2015\/04\/Nevarez.jpg\"><img loading=\"lazy\" class=\"alignleft size-full wp-image-15888\" src=\"https:\/\/www.lasvegasadvisor.com\/stiffs-and-georges\/wp-content\/uploads\/2015\/04\/Nevarez.jpg\" alt=\"Nevarez\" width=\"183\" height=\"275\" srcset=\"https:\/\/www.lasvegasadvisor.com\/stiffs-and-georges\/wp-content\/uploads\/2015\/04\/Nevarez.jpg 183w, https:\/\/www.lasvegasadvisor.com\/stiffs-and-georges\/wp-content\/uploads\/2015\/04\/Nevarez-99x150.jpg 99w\" sizes=\"(max-width: 183px) 100vw, 183px\" \/><\/a>reaching is\u00a0Rep. <strong>Carol Alvarado<\/strong>&#8216;s proposal to open the entire state to private-sector and tribal casinos. More circumscribed are\u00a0Rep. <strong>Senfronia Thompson<\/strong>&#8216;s attempt to extend tribal gaming to the\u00a0<strong>Ysleta del Sur Pueblo<\/strong> and <strong>Alabama-Coushatta<\/strong> tribes.\u00a0Rep. <strong>Poncho Nevarez<\/strong> (D, <em>left<\/em>) wants to bump up <strong>Kickapoo Lucky Eagle Casino<\/strong> to Class III status, while Rep. <strong>Richard Raymond<\/strong> (D) would have controversial &#8220;eight-liners&#8221; voted upon at the local level. Rep.\u00a0<strong>Joe Deshotel<\/strong> (D) is pushing for casinos in <strong>Galveston<\/strong> and other coastal areas, to fund disaster relief (thereby putting the casinos in the path of greatest danger from hurricanes and other foul weather). Unfortunately, all these proposals are coming from the left side of the aisle and Texas is likely to continue missing out on a multi-billion-dollar business for some time to come.<\/p>\n<p>* In less than a year, <strong>Hard Rock Sioux City<\/strong> has racked up $8,000 in fines for catering to self-excluded gamblers. They&#8217;ll have to do better than that.<\/p>\n<p>* If you&#8217;re playing at <strong>Harrah&#8217;s New Orleans<\/strong>, better stub out that cigarette. A challenge to <strong>New Orleans<\/strong>&#8216; smoking ban by a litany of bars, strip joints and by <strong>Caesars Entertainment<\/strong> was quashed. Opponents of the ban say it will cost the city $3 million in lost revenue and enforcement.<\/p>\n<p>* It may become easier to bet at state-approved online casinos now that a new transaction code has been added, getting punters around the dreaded 7995 coding. <strong>Paddy Power<\/strong> President\u00a0<strong>Eamonn Toland<\/strong> says the new code, which &#8220;crucial [to satisfying banks] &#8230;\u00a0may be necessary but not sufficient.\u201d Experts say that, legalities aside, the minute nature of the U.S. <strong>Internet<\/strong>-gambling market gives them no incentive to accept transactions of that nature.\u00a0\u201cI don\u2019t think it\u2019s going to be a silver bullet,\u201d <a href=\"http:\/\/www.pressofatlanticcity.com\/business\/new-credit-card-code-may-help-online-gambling\/article_2c543a88-e53c-11e4-bdcc-577dfdd4be33.html\" target=\"_blank\" rel=\"noopener noreferrer\">gloomily predicts<\/a> <strong>CAMS<\/strong> CEO <strong>Matthew Katz<\/strong>, whose online platform supports <strong>New Jersey<\/strong> casinos, echoing those who say the market isn&#8217;t big enough to make banks give a damn.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>A federal case against an unlicensed, do-it-yourself sports book collapsed like a pup tent when a federal judge tossed out both the premise of an FBI search and, by extension, the evidence gathered therefrom.
