Last <a href=\"https:\/\/www.lasvegasadvisor.com\/stiffs-and-georges\/wp-content\/uploads\/2015\/11\/Baker.jpg\"><img loading=\"lazy\" class=\"alignleft size-full wp-image-17220\" src=\"https:\/\/www.lasvegasadvisor.com\/stiffs-and-georges\/wp-content\/uploads\/2015\/11\/Baker.jpg\" alt=\"Baker\" width=\"225\" height=\"224\" srcset=\"https:\/\/www.lasvegasadvisor.com\/stiffs-and-georges\/wp-content\/uploads\/2015\/11\/Baker.jpg 225w, https:\/\/www.lasvegasadvisor.com\/stiffs-and-georges\/wp-content\/uploads\/2015\/11\/Baker-150x150.jpg 150w\" sizes=\"(max-width: 225px) 100vw, 225px\" \/><\/a>weekend, Baker tried a little DraftKings wagering himself and concluded,\u00a0\u201cI\u2019m convinced it\u2019s legal in Massachusetts, I don\u2019t have a problem with that &#8230; It\u2019s a new enterprise, it\u2019s a new business, it\u2019s a new way of engaging people in these games of skill.\u201d Disparaging his own skill at picking winning players, Baker said,\u00a0\u201cI was so intimidated by it that I don\u2019t think we\u2019ll ever have to worry about me spending a lot of time on it.\u201d<\/p>\n<p>He&#8217;s the second high-profile Bay State ally in DraftKings&#8217; corner, state Attorney General <strong>Maura Healey<\/strong> being mainly concerned with consumer protections rather than <!--more-->legality. Meanwhile, the <strong>Massachusetts Gaming Commission<\/strong> has decided that getting involved with DFS lies outside its mandate, although Baker hinted he might extend that remit to include DFS rather than leave it unregulated.<\/p>\n<p>There&#8217;s an iota or two of difference between Baker and Healey but the discrepancy is more cosmetic than substantive. The AG has called <a href=\"https:\/\/www.lasvegasadvisor.com\/stiffs-and-georges\/wp-content\/uploads\/2014\/04\/healey_maura.jpg\"><img loading=\"lazy\" class=\"alignright size-full wp-image-13300\" src=\"https:\/\/www.lasvegasadvisor.com\/stiffs-and-georges\/wp-content\/uploads\/2014\/04\/healey_maura.jpg\" alt=\"healey_maura\" width=\"200\" height=\"250\" srcset=\"https:\/\/www.lasvegasadvisor.com\/stiffs-and-georges\/wp-content\/uploads\/2014\/04\/healey_maura.jpg 200w, https:\/\/www.lasvegasadvisor.com\/stiffs-and-georges\/wp-content\/uploads\/2014\/04\/healey_maura-120x150.jpg 120w\" sizes=\"(max-width: 200px) 100vw, 200px\" \/><\/a>DFS &#8220;gambling&#8221; but added,\u00a0\u201cJust because it\u2019s gambling doesn\u2019t make it illegal.\u201d Her spokeswoman clarified Healey&#8217;s remarks by adding,\u00a0\u201cThe attorney general has said that she does not believe we should use our criminal statutes, which never envisioned daily fantasy sports, to shut this entire industry down.\u201d (That&#8217;s part of the problem with DFS: It seemingly came out of nowhere and <a href=\"http:\/\/www.bostonglobe.com\/business\/2015\/11\/12\/time-running-out-fantasy-sports-betting\/cvO6zITAjLKPQOs79ChsbI\/story.html?p1=Article_Related_Box_Article_More\" target=\"_blank\">everyone&#8217;s struggling to get their arms around the phenomenon<\/a>.)<\/p>\n<p>Meanwhile, <strong>FanDuel<\/strong> and DraftKings &#8212; in a slightly comic development &#8212; are attempting to stage a protest rally in <a href=\"https:\/\/www.lasvegasadvisor.com\/stiffs-and-georges\/wp-content\/uploads\/2015\/10\/Schneiderman.jpg\"><img loading=\"lazy\" class=\"alignleft size-full wp-image-16994\" src=\"https:\/\/www.lasvegasadvisor.com\/stiffs-and-georges\/wp-content\/uploads\/2015\/10\/Schneiderman.jpg\" alt=\"Schneiderman\" width=\"183\" height=\"275\" srcset=\"https:\/\/www.lasvegasadvisor.com\/stiffs-and-georges\/wp-content\/uploads\/2015\/10\/Schneiderman.jpg 183w, https:\/\/www.lasvegasadvisor.com\/stiffs-and-georges\/wp-content\/uploads\/2015\/10\/Schneiderman-100x150.jpg 100w\" sizes=\"(max-width: 183px) 100vw, 183px\" \/><\/a><strong>Manhattan<\/strong>. (It&#8217;s not exactly a serious civil-rights issue.) More seriously, DraftKings thinks it has found a 2007 <strong>New Jersey<\/strong> <a href=\"http:\/\/www.bostonglobe.com\/business\/2015\/11\/12\/gov-baker-fantasy-sports-legal-game-skill-not-gambling\/YvPO1eIGPxfvlDmXoMXTbI\/story.html\" target=\"_blank\">case that gives it the legal precedent<\/a> to overturn New York Attorney General <strong>Eric Schneiderman<\/strong>&#8216;s (<em>left<\/em>) ban on DFS. In the Jersey case, a federal judge ruled that, because DFS prizes were guaranteed, paying an entry fee did not constitute making a wager. DraftKings attorney <strong>Randy Mastro<\/strong> argues that Empire State and Garden State laws are congruent in this respect. Schneiderman has given DraftKings and FanDuel through Sunday to close up shop, so Mastro&#8217;s first order of business is probably to obtain a temporary restraining order and let the games continue.<\/p>\n<p>* \u201cThis year\u2019s Thanksgiving will have a much different meaning for our tribe,\u201d said <strong>Mashpee Wampanoag<\/strong> Tribal Council Chairman <strong>Cedric Cromwell<\/strong>. How so? The federal government <a href=\"http:\/\/www.capecodtimes.com\/article\/20151112\/NEWS\/151119791\/-1\/NEWS39\" target=\"_blank\" class=\"broken_link\">has officially transferred over 320 acres of land into trust for the tribe<\/a>. This <a href=\"https:\/\/www.lasvegasadvisor.com\/stiffs-and-georges\/wp-content\/uploads\/2013\/07\/Mashpee-4.jpg\"><img loading=\"lazy\" class=\"alignright size-medium wp-image-11160\" src=\"https:\/\/www.lasvegasadvisor.com\/stiffs-and-georges\/wp-content\/uploads\/2013\/07\/Mashpee-4-300x200.jpg\" alt=\"Mashpee 4\" width=\"300\" height=\"200\" srcset=\"https:\/\/www.lasvegasadvisor.com\/stiffs-and-georges\/wp-content\/uploads\/2013\/07\/Mashpee-4-300x200.jpg 300w, https:\/\/www.lasvegasadvisor.com\/stiffs-and-georges\/wp-content\/uploads\/2013\/07\/Mashpee-4-150x100.jpg 150w, https:\/\/www.lasvegasadvisor.com\/stiffs-and-georges\/wp-content\/uploads\/2013\/07\/Mashpee-4.jpg 738w\" sizes=\"(max-width: 300px) 100vw, 300px\" \/><\/a>includes acreage in <strong>Mashpee<\/strong> that already serves several purposes, including that of tribal cemetery. More important, the Mashpee Wampanoag gain access to 151 acres in <strong>Taunton<\/strong> earmarked for <strong>Project First Light Casino &amp; Resort<\/strong>. The path finally seems clear for the tribe to submit the project to the <strong>Massachusetts Gaming Commission<\/strong> for study. Rival casino developer <strong>Neil Bluhm<\/strong> continues to warn of legal challenges to Project First Light but the Mashpee can afford to call his bluff: According to the <em>Cape Cod Times<\/em>, &#8220;no legal challenge has been filed to challenge the land decision.&#8221;<\/p>\n<p>* You&#8217;d think a company as big as <strong>MGM Resorts International<\/strong> could do as it pleased with regard to its <strong>Springfield<\/strong> project. Nope. MGM&#8217;s proposed downsizing of the $800 million megaresort has to <a href=\"https:\/\/www.lasvegasadvisor.com\/stiffs-and-georges\/wp-content\/uploads\/2014\/04\/MGM-Springfield-detail.jpg\"><img loading=\"lazy\" class=\"alignleft size-medium wp-image-13326\" src=\"https:\/\/www.lasvegasadvisor.com\/stiffs-and-georges\/wp-content\/uploads\/2014\/04\/MGM-Springfield-detail-300x196.jpg\" alt=\"MGM Springfield detail\" width=\"300\" height=\"196\" srcset=\"https:\/\/www.lasvegasadvisor.com\/stiffs-and-georges\/wp-content\/uploads\/2014\/04\/MGM-Springfield-detail-300x196.jpg 300w, https:\/\/www.lasvegasadvisor.com\/stiffs-and-georges\/wp-content\/uploads\/2014\/04\/MGM-Springfield-detail-150x98.jpg 150w, https:\/\/www.lasvegasadvisor.com\/stiffs-and-georges\/wp-content\/uploads\/2014\/04\/MGM-Springfield-detail.jpg 380w\" sizes=\"(max-width: 300px) 100vw, 300px\" \/><\/a><a href=\"http:\/\/www.masslive.com\/business-news\/index.ssf\/2015\/11\/mgm_springfield_decisions_due_over_the_n.html\" target=\"_blank\" class=\"broken_link\">jump through a series of hoops<\/a>, gaining the approvals of the city&#8217;s economic-development and planning departments, the city council and Mayor <strong>Domenic Sarno<\/strong>. And the <strong>Massachusetts Gaming Commission<\/strong> has to ultimately decide if the changes are OK\u00a0or if they were sold a pig in a poke. It&#8217;s not clear what will happen if any of these five bodies says, &#8220;No&#8221; to MGM. It frankly seems inconceivable that MGM could be forced to go back to its original design for <strong>MGM Springfield<\/strong>, especially as it has presented Plan B as a <em>fait accompli<\/em> (which is an effective way to keep opponents playing defense, trying to salvage as much of the project as they can).<\/p>\n<p>MGM, to its credit, is going to brave the potential wrath of Springfield at a Nov. 18 meeting, at which it will present its project <a href=\"https:\/\/www.lasvegasadvisor.com\/stiffs-and-georges\/wp-content\/uploads\/2015\/02\/Michael-Mathis.jpg\"><img loading=\"lazy\" class=\"alignright size-full wp-image-15469\" src=\"https:\/\/www.lasvegasadvisor.com\/stiffs-and-georges\/wp-content\/uploads\/2015\/02\/Michael-Mathis.jpg\" alt=\"Michael Mathis\" width=\"159\" height=\"195\" srcset=\"https:\/\/www.lasvegasadvisor.com\/stiffs-and-georges\/wp-content\/uploads\/2015\/02\/Michael-Mathis.jpg 159w, https:\/\/www.lasvegasadvisor.com\/stiffs-and-georges\/wp-content\/uploads\/2015\/02\/Michael-Mathis-122x150.jpg 122w\" sizes=\"(max-width: 159px) 100vw, 159px\" \/><\/a>changes to Sarno and other city fathers.\u00a0&#8220;We appreciate the opportunity that Mayor Sarno has provided us by setting the stage for a public update of MGM Springfield,&#8221; said President <strong>Michael Mathis<\/strong>, trying to accentuate the positive. The one drawback to the forum is that the public is barred from asking Mathis (or anyone) questions.
