{"id":17588,"date":"2016-01-14T15:36:07","date_gmt":"2016-01-14T23:36:07","guid":{"rendered":"https:\/\/www.lasvegasadvisor.com\/stiffs-and-georges\/?p=17588"},"modified":"2021-01-20T07:37:31","modified_gmt":"2021-01-20T15:37:31","slug":"moment-of-truth-for-dfs-surprise-champion-for-i-poker","status":"publish","type":"post","link":"https:\/\/www.lasvegasadvisor.com\/stiffs-and-georges\/moment-of-truth-for-dfs-surprise-champion-for-i-poker\/","title":{"rendered":"Moment of truth for DFS; Surprise champion for i-poker"},"content":{"rendered":"<p><strong>Massachusetts<\/strong> Attorney General <strong>Maura Healey<\/strong> has come forth with <a href=\"http:\/\/www.thedailybeast.com\/articles\/2016\/01\/13\/can-massachusetts-kill-draftkings.html\" target=\"_blank\" rel=\"noopener noreferrer\">her much-anticipated set of rules<\/a> by which daily fantasy sports will be <a href=\"https:\/\/www.lasvegasadvisor.com\/stiffs-and-georges\/wp-content\/uploads\/2014\/11\/Healey.jpg\"><img loading=\"lazy\" class=\"alignleft size-full wp-image-14929\" src=\"https:\/\/www.lasvegasadvisor.com\/stiffs-and-georges\/wp-content\/uploads\/2014\/11\/Healey.jpg\" alt=\"Healey\" width=\"200\" height=\"250\" srcset=\"https:\/\/www.lasvegasadvisor.com\/stiffs-and-georges\/wp-content\/uploads\/2014\/11\/Healey.jpg 200w, https:\/\/www.lasvegasadvisor.com\/stiffs-and-georges\/wp-content\/uploads\/2014\/11\/Healey-120x150.jpg 120w\" sizes=\"(max-width: 200px) 100vw, 200px\" \/><\/a>conducted in the Bay State. It&#8217;s not definitive yet (a public-comment period is forthcoming) and there may be some wiggle room, but as the first regulatory regimen devised for DFS in the <strong>United States<\/strong>, Healey&#8217;s example is bound to be influential. As one observer noted,\u00a0\u201cMaura Healey is a powerful law-enforcement officer.\u00a0And <strong>DraftKings<\/strong> is headquartered in Massachusetts. To some extent, they have to play ball with Healey.&#8221;<\/p>\n<p>That doesn&#8217;t mean DraftKings or <strong>FanDuel<\/strong> have to like the new rules. They include:<!--more--><\/p>\n<ul>\n<li style=\"list-style-type: none;\">\n<ul>\n<li>No participation by anyone under 21, consistent with casinos (this is sure to draw loud squawks from within the DFS industry).<\/li>\n<li>No insider participation.<\/li>\n<li>A $1,000\/month loss limit.<\/li>\n<li>One account per user.<\/li>\n<li>No use of scripts. This also certain to be unpopular as it would weed out the high rollers and their practice of &#8220;bumhunting.&#8221;<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<p>Already Draft Kings is groaning that life under Healey&#8217;s Law,\u00a0\u201cwill have a significant effect on the industry, and will be costly and complicated to implement.\u201d Considering that we&#8217;re dealing with some of the best minds in DFS, who have access to considerable capital, we think they can handle it &#8212; although there is some question as to whether DFS operators are sufficiently sapient to detect scripts when they&#8217;re in play.<\/p>\n<p><strong>Fantasy Sports Trade Association<\/strong> Chairman\u00a0<strong>Peter Schoenke<\/strong> wrung his hands and said banning scripts will &#8220;hurt innovation in our industry.&#8221; Since scripts are used only being used by a tiny percentage of the DFS player base, that would appear to be a pretty leaky argument. While the <strong>Massachusetts Gaming Commission<\/strong> would seem like the logical next place for the DFS ball to be thrown, it&#8217;s not yet clear who will be enforcing Massachusetts&#8217; new status quo.<\/p>\n<p>* DFS is also be revisited in <strong>Washington State<\/strong>, the only state in the\u00a0nation where <strong>Internet<\/strong> gambling is actually a crime. (Lighten up, guys.) It&#8217;s a felony if one\u00a0\u201cknowingly transmits or receives gambling information by telephone, telegraph, radio, semaphore, the Internet, a telecommunications transmission system, or similar means\u201d and if DFS is deemed to be <a href=\"https:\/\/www.lasvegasadvisor.com\/stiffs-and-georges\/wp-content\/uploads\/2016\/01\/Washington.png\"><img loading=\"lazy\" class=\"alignright size-full wp-image-17589\" src=\"https:\/\/www.lasvegasadvisor.com\/stiffs-and-georges\/wp-content\/uploads\/2016\/01\/Washington.png\" alt=\"Washington\" width=\"291\" height=\"173\" srcset=\"https:\/\/www.lasvegasadvisor.com\/stiffs-and-georges\/wp-content\/uploads\/2016\/01\/Washington.png 291w, https:\/\/www.lasvegasadvisor.com\/stiffs-and-georges\/wp-content\/uploads\/2016\/01\/Washington-150x89.png 150w\" sizes=\"(max-width: 291px) 100vw, 291px\" \/><\/a>gambling, that&#8217;s very bad news for the industry indeed. Ergo, a coalition of legislators is pushing a bill <a href=\"https:\/\/www.casino.org\/news\/washington-state-online-poker-and-dfs-bills-introduced\" target=\"_blank\" rel=\"noopener noreferrer\">that would explicitly classify DFS as a game of skill<\/a>. They&#8217;re bucking precedent, since Washington&#8217;s 2011 prosecution of <strong>Fantasy Thunder<\/strong> is the only successful case brought against a DFS site.<\/p>\n<p>State Rep. <strong>Sherry Appleton<\/strong>&#8216;s introduction of a bill to re-legalize online poker, meanwhile, <a href=\"https:\/\/www.casino.org\/news\/washington-state-gets-online-poker-bill\" target=\"_blank\" rel=\"noopener noreferrer\">came out of left field<\/a>. Industry observers were so focused on similar efforts in <strong>California<\/strong> and <strong>Pennsylvania<\/strong> that they didn&#8217;t bank\u00a0on Washington State getting into the fray. Nobody in the latter state actually prosecutes anyone for playing i-poker so\u00a0there may at least be sentiment for downgrading it from a Class C felony. At present, the Appleton bill lacks a bad-actor clause and doesn&#8217;t address the issue of taxation, but its fate in the Washington Lege will be followed with interest.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Massachusetts Attorney General Maura Healey has come forth with her much-anticipated set of rules by which daily fantasy sports will be conducted in the Bay State.
