Do it and you&#8217;re out the door. This archaic &#8212; to say nothing of sexist &#8212; policy <a href=\"http:\/\/www.cbsnews.com\/news\/atlantic-city-casino-can-regulate-waitresses-weight-new-jersey-borgata-babes\/\" target=\"_blank\" rel=\"noopener noreferrer\">was passively reaffirmed<\/a> when the <strong>New Jersey Supreme Court<\/strong> refused to hear the case. <strong>Boyd Gaming<\/strong> &#8220;is pleased <a href=\"https:\/\/www.lasvegasadvisor.com\/stiffs-and-georges\/wp-content\/uploads\/2016\/01\/borgata_exterior_sunset.jpg\"><img loading=\"lazy\" class=\"alignright size-medium wp-image-17630\" src=\"https:\/\/www.lasvegasadvisor.com\/stiffs-and-georges\/wp-content\/uploads\/2016\/01\/borgata_exterior_sunset-300x224.jpg\" alt=\"borgata_exterior_sunset\" width=\"300\" height=\"224\" srcset=\"https:\/\/www.lasvegasadvisor.com\/stiffs-and-georges\/wp-content\/uploads\/2016\/01\/borgata_exterior_sunset-300x224.jpg 300w, https:\/\/www.lasvegasadvisor.com\/stiffs-and-georges\/wp-content\/uploads\/2016\/01\/borgata_exterior_sunset-150x112.jpg 150w, https:\/\/www.lasvegasadvisor.com\/stiffs-and-georges\/wp-content\/uploads\/2016\/01\/borgata_exterior_sunset.jpg 500w\" sizes=\"(max-width: 300px) 100vw, 300px\" \/><\/a>with the decision,&#8221; as well it might be, although it perpetuates a double standard in which women&#8217;s physical appearance is an essential criterion of her employment on the casino floor. On the one hand, the casino industry continues to treat women like Barbie dolls. On the other, the courts are guilty of allowing them to continue doing so. It&#8217;s difficult to say where blame should be affixed, although casinos like <strong>Borgata<\/strong> could make the first step and enter the 21st century when it comes to their attitudes toward women.<\/p>\n<p>The Supreme Court <a href=\"http:\/\/www.pressofatlanticcity.com\/news\/breaking\/state-supreme-court-declines-review-of-borgatababes-case\/article_ac730b08-c38b-11e5-8587-b361d9b1ff5c.html?_dc=657629549503.3264\" target=\"_blank\" rel=\"noopener noreferrer\">let stand a 2013 appellate court ruling<\/a> that\u00a0\u201cThe Borgata Babe position comprised more than a job serving drinks and washing glasses.\u00a0From its inception, an element of performance and <!--more-->a public appearance component was part of the described Borgata Babe position.&#8221; In other words, you&#8217;re on display gals, so be prepared to have some T&amp;A to please the patrons. According to <em>The Press of Atlantic City<\/em>, male cocktail servers at Borgata &#8220;must have broad shoulders and a slim waist.&#8221; We know of none who have bridled at this requirement, although in its rudiments it seems less draconian than the standard imposed on the Borgata Babes. The casino says &#8220;our policy is fair&#8221; but we beg to differ.<\/p>\n<p>* Daily fantasy sports <a href=\"http:\/\/www.casinoaffiliateprograms.com\/blog\/dfs-nightmare-continues-as-texas-calls-it-illegal-gambling\/\" target=\"_blank\" rel=\"noopener noreferrer\">could lose a quarter of its American audience<\/a>, depending on whether <strong>Texas<\/strong> legislators act upon an advisory opinion <a href=\"https:\/\/www.lasvegasadvisor.com\/stiffs-and-georges\/wp-content\/uploads\/2016\/01\/Paxton.jpg\"><img loading=\"lazy\" class=\"alignleft size-full wp-image-17631\" src=\"https:\/\/www.lasvegasadvisor.com\/stiffs-and-georges\/wp-content\/uploads\/2016\/01\/Paxton.jpg\" alt=\"Paxton\" width=\"192\" height=\"262\" srcset=\"https:\/\/www.lasvegasadvisor.com\/stiffs-and-georges\/wp-content\/uploads\/2016\/01\/Paxton.jpg 192w, https:\/\/www.lasvegasadvisor.com\/stiffs-and-georges\/wp-content\/uploads\/2016\/01\/Paxton-110x150.jpg 110w\" sizes=\"(max-width: 192px) 100vw, 192px\" \/><\/a>from Attorney General <strong>Ken Paxton<\/strong>. Noting that in Texas law, gambling involves an element of &#8216;partial chance,&#8217;\u00a0Paxton stated that it&#8217;s\u00a0\u201cbeyond reasonable dispute that daily fantasy leagues involve an element of chance regarding how a selected player will perform on game day.\u201d So if you had <strong>Rob Gronkowski<\/strong> on your fantasy team last weekend and he had pulled up lame, that&#8217;s gambling.<\/p>\n<p>Writing that DFS operators&#8217; rationalizations aren&#8217;t congruent with Lone Star law, Paxton continued,\u00a0\u201cSimply put, it is prohibited gambling in Texas if you bet on the performance of a participant in a sporting event and the house takes a cut.\u201d <strong>DraftKings<\/strong> quickly shot back, accusing Paxton of a &#8220;basic misunderstanding&#8221; of DFS, and arguing that the sport is a game of skill and therefore legal in Texas. The DFS leader said it would &#8220;continue to operate openly and transparently&#8221; in the Lone Star State.<\/p>\n<p>The goal of Paxton&#8217;s opinion, which <strong>Dallas Mavericks<\/strong> owner <strong>Mark Cuban<\/strong> denounced as part of a larger wave of &#8220;stupidity and hypocrisy,&#8221; appears less to have been to influence lawmakers than to head off the <strong>Texas Lottery<\/strong> at the pass. The lottery <a href=\"http:\/\/www.dallasnews.com\/news\/state\/headlines\/20160115-records-texas-lottery-was-in-hot-pursuit-of-fantasy-sports-game.ece\" target=\"_blank\" rel=\"noopener noreferrer\">had been in talks with DraftKings<\/a> <a href=\"https:\/\/www.lasvegasadvisor.com\/stiffs-and-georges\/wp-content\/uploads\/2015\/10\/Abbott.jpg\"><img loading=\"lazy\" class=\"alignright size-full wp-image-17058\" src=\"https:\/\/www.lasvegasadvisor.com\/stiffs-and-georges\/wp-content\/uploads\/2015\/10\/Abbott.jpg\" alt=\"Abbott\" width=\"183\" height=\"275\" srcset=\"https:\/\/www.lasvegasadvisor.com\/stiffs-and-georges\/wp-content\/uploads\/2015\/10\/Abbott.jpg 183w, https:\/\/www.lasvegasadvisor.com\/stiffs-and-georges\/wp-content\/uploads\/2015\/10\/Abbott-100x150.jpg 100w\" sizes=\"(max-width: 183px) 100vw, 183px\" \/><\/a>about incorporating some form of DFS into its games.\u00a0<strong>Texas Lottery Commission<\/strong> Executive Director <strong>Gary Grief<\/strong> caught grief from Gov. <strong>Greg Abbott<\/strong> (R, <em>right<\/em>) after commissioners went on a fact-finding mission to <strong>Delaware<\/strong>. It was more than a casual dalliance, as Grief wrote,\u00a0\u201cI want to put together a comprehensive proposal for a fantasy football game that can be run under the [commission&#8217;s] authority &#8230; The <strong>Cowboys<\/strong> have a relationship with <strong>FanDuel<\/strong> [<em>sic<\/em>] and they retain a lobbyist I know in <strong>Austin<\/strong>.\u201d DraftKings denies having ever been so much as in communication with the lottery commission (although Grief directed staffers to pursue a contract with DraftKings).<\/p>\n<p>Meanwhile, Grief sent emissaries to Delaware. It was under the misperception that Delaware&#8217;s sports betting is a form of lottery, rather than the parlay betting it actually is. When the <strong>Ethan Haskell<\/strong> scandal <a href=\"https:\/\/www.lasvegasadvisor.com\/stiffs-and-georges\/wp-content\/uploads\/2016\/01\/Krause.jpg\"><img loading=\"lazy\" class=\"alignleft size-full wp-image-17632\" src=\"https:\/\/www.lasvegasadvisor.com\/stiffs-and-georges\/wp-content\/uploads\/2016\/01\/Krause.jpg\" alt=\"Krause\" width=\"156\" height=\"200\" srcset=\"https:\/\/www.lasvegasadvisor.com\/stiffs-and-georges\/wp-content\/uploads\/2016\/01\/Krause.jpg 156w, https:\/\/www.lasvegasadvisor.com\/stiffs-and-georges\/wp-content\/uploads\/2016\/01\/Krause-117x150.jpg 117w\" sizes=\"(max-width: 156px) 100vw, 156px\" \/><\/a>broke, Grief wrote,\u00a0\u201cThe easy money may have already been made.\u201d But he continued to pursue DFS. One state that offers fantasy-sports betting in casinos\u00a0is <strong>Montana<\/strong> but it rakes in only $300,000 annually, chump change compared to the state&#8217;s lottery. Between Abbott lowering the boom on Grief, and Paxton&#8217;s opinion, the lottery board is staying on the sidelines of the DFS debate.\u00a0\u201cFrom now on, when somebody from the Legislature calls and says, \u2018We might be taking this up,\u2019 the first thing that\u2019s going to happen is going to be a call to governor\u2019s office.\u00a0We\u2019re not sticking our neck out for anything,\u201d\u00a0said Lottery Commission Chairman <strong>Winston Krause<\/strong> (above).\u00a0As for Paxton, he might want to remove <a href=\"http:\/\/www.texastribune.org\/2016\/01\/18\/analysis-ken-paxtons-legal-complications-multiply\/\" target=\"_blank\" rel=\"noopener noreferrer\">the securities fraud beam from his eye<\/a> before going after the DFS mote in Grief&#8217;s.<\/p>\n<p>The <em>Fort Worth Star-Telegram<\/em> argues that Abbott and Paxton are merely\u00a0acting within the letter of the law and that voters <a href=\"http:\/\/www.star-telegram.com\/opinion\/editorials\/article56157730.html\" target=\"_blank\" rel=\"noopener noreferrer\" class=\"broken_link\">have a simple solution<\/a>: Elect pro-gaming legislative candidates.<\/p>\n<p>* DFS is also under siege in <strong>Vermont<\/strong>, where Attorney General <strong>Bill Sorrell<\/strong> is trying to ban it. Social worker <strong>Steve May<\/strong> argues that <a href=\"https:\/\/vtdigger.org\/2016\/01\/25\/steve-may-online-gaming-needs-regulating-not-prohibition\/\" target=\"_blank\" rel=\"noopener noreferrer\">this tactic will be counterproductive<\/a>. He adds, &#8220;It\u2019s time that we address the actual harms caused by betting, increasing treatment resources and programming for pathological gamblers instead of wringing our hands and moralizing about the choices that consenting adults make.&#8221;<\/p>\n<p>The <em>Los Angeles Times<\/em> has also weighed in on behalf of legalized regulated DFS &#8212; and Internet gambling in general. Describing the likes of Sorrell as &#8220;way behind the curve,&#8221; the <em>LAT<\/em> tries to nudge <strong>California<\/strong> <a href=\"https:\/\/www.lasvegasadvisor.com\/stiffs-and-georges\/wp-content\/uploads\/2016\/01\/Kamala_Harris.jpg\"><img loading=\"lazy\" class=\"alignright size-medium wp-image-17640\" src=\"https:\/\/www.lasvegasadvisor.com\/stiffs-and-georges\/wp-content\/uploads\/2016\/01\/Kamala_Harris-200x300.jpg\" alt=\"Kamala_Harris\" width=\"200\" height=\"300\" srcset=\"https:\/\/www.lasvegasadvisor.com\/stiffs-and-georges\/wp-content\/uploads\/2016\/01\/Kamala_Harris-200x300.jpg 200w, https:\/\/www.lasvegasadvisor.com\/stiffs-and-georges\/wp-content\/uploads\/2016\/01\/Kamala_Harris-100x150.jpg 100w, https:\/\/www.lasvegasadvisor.com\/stiffs-and-georges\/wp-content\/uploads\/2016\/01\/Kamala_Harris.jpg 220w\" sizes=\"(max-width: 200px) 100vw, 200px\" \/><\/a>Attorney General <strong>Kamala Harris<\/strong>\u00a0(<em>right<\/em>) off the fence. Arguing that the DFS genie is hopelessly out of the bottle, the <em>LAT<\/em> editorial board opines, &#8220;The smart approach is to regulate the leagues, ideally within the context of a comprehensive approach to online gaming. That way the state can protect consumers against fly-by-night sites while requiring companies to use sophisticated technology to block minors and problem gamblers, pay fees that can be used for oversight and enforcement, and guard consumers against insiders competing unfairly for jackpots, as both FanDuel and DraftKings were accused of allowing last year,&#8221; adding, &#8220;None of those protections is assured online today.&#8221;<\/p>\n<p>We agree.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Woe betide the &#8220;Borgata Babe&#8221; who loses or gains more than 7% of her body weight.
