That&#8217;s the choice <strong>Florida<\/strong> Gov. <strong>Rick Scott<\/strong> (R) faces in newly discovered documents from 2014, in which the <strong>Poarch Band of <img loading=\"lazy\" class=\"alignleft size-medium wp-image-12910\" src=\"https:\/\/www.lasvegasadvisor.com\/stiffs-and-georges\/wp-content\/uploads\/2014\/03\/Rick_Scott1-230x300.jpeg\" alt=\"Rick_Scott1\" width=\"230\" height=\"300\" srcset=\"https:\/\/www.lasvegasadvisor.com\/stiffs-and-georges\/wp-content\/uploads\/2014\/03\/Rick_Scott1-230x300.jpeg 230w, https:\/\/www.lasvegasadvisor.com\/stiffs-and-georges\/wp-content\/uploads\/2014\/03\/Rick_Scott1-115x150.jpeg 115w, https:\/\/www.lasvegasadvisor.com\/stiffs-and-georges\/wp-content\/uploads\/2014\/03\/Rick_Scott1.jpeg 250w\" sizes=\"(max-width: 230px) 100vw, 230px\" \/>Creek Indians<\/strong> seeks a casino on a one-acre parcel near <strong>Pensacola<\/strong> in return of $1 billion in payments to the state, spread over five years. What&#8217;s more, the Poarch Band would surrender four parimutuel licenses in holds in the Sunshine State. But if it doesn&#8217;t get a casino, the tribe proposes to grow marijuana on the site. <strong>Pete Antonacci<\/strong>, Scott&#8217;s general counsel at the time, asked the perfectly reasonable question of whether one could build a casino on a single acre, to which the tribe replied that there was \u201cabsolutely no limitation or minimum acreage requirement in federal law that would restrict a Tribe\u2019s authority to either engage in Class III gaming or to enter into a compact.\u201d<\/p>\n<p>Antonacci replied that negotiations were premature and the Poarch Band threatened to open Class II gambling on the site, with no <!--more-->revenue-sharing for the state. And there the matter pretty much remains, while the Poarch Band seeks an advisory opinion from the <strong>Interior Department<\/strong>. This is just one of many issues bedeviling the Scott administration as it seeks to pass a new compact with the <strong>Seminole Tribe<\/strong> in the Legislature.<\/p>\n<p>State Sen. <strong>Joe Negron<\/strong> (R, <em>below<\/em>) supersized the compact in committee, turning it into <a href=\"http:\/\/ggbnews.com\/issue\/vol-14-no-8-february-22-2016\/article\/florida-senate-committee-vote-imperils-compact\" target=\"_blank\" rel=\"noopener noreferrer\" class=\"broken_link\">a veritable Christmas tree for gaming interests<\/a>. Among <img loading=\"lazy\" class=\"alignright size-full wp-image-17757\" src=\"https:\/\/www.lasvegasadvisor.com\/stiffs-and-georges\/wp-content\/uploads\/2016\/02\/Negron.jpg\" alt=\"Negron\" width=\"148\" height=\"195\" srcset=\"https:\/\/www.lasvegasadvisor.com\/stiffs-and-georges\/wp-content\/uploads\/2016\/02\/Negron.jpg 148w, https:\/\/www.lasvegasadvisor.com\/stiffs-and-georges\/wp-content\/uploads\/2016\/02\/Negron-114x150.jpg 114w\" sizes=\"(max-width: 148px) 100vw, 148px\" \/>Negron&#8217;s ornamentations were a lower tax on slot machines (30% instead of 35%) and a buyback provision for gaming permits not in use. That&#8217;s an even more aggressive expansion of the compact than took place in the House, where a modest expansion of South Florida gaming was added, and offering slot machines was decoupled from the mandatory running of horse and dog racing. The <strong>Florida Greyhound Association<\/strong> trotted out former Lt. Gov. <strong>Jeff Kottkamp<\/strong> to say that Floridians\u00a0\u201cnever contemplated that these racetracks would be converted to casinos. &#8230;\u00a0It ignores the history of Florida.\u201d<\/p>\n<p>Negron&#8217;s drastic upsizing of the compact, meanwhile, drew the opposition of one of the compact&#8217;s midwives, state Sen.\u00a0<strong>Florida Senate Regulated Industries Committee<\/strong> Chairman <strong>Rob Bradley<\/strong> (R, <em>left<\/em>) took the unusual step of writing to all committee members, warning <img loading=\"lazy\" class=\"alignleft size-full wp-image-17347\" src=\"https:\/\/www.lasvegasadvisor.com\/stiffs-and-georges\/wp-content\/uploads\/2015\/12\/Bradley.jpg\" alt=\"Bradley\" width=\"148\" height=\"195\" srcset=\"https:\/\/www.lasvegasadvisor.com\/stiffs-and-georges\/wp-content\/uploads\/2015\/12\/Bradley.jpg 148w, https:\/\/www.lasvegasadvisor.com\/stiffs-and-georges\/wp-content\/uploads\/2015\/12\/Bradley-114x150.jpg 114w\" sizes=\"(max-width: 148px) 100vw, 148px\" \/>them that Negron&#8217;s free-for-all could cause the compact to fail and open the door to litigation in return for only &#8220;a fraction of what [taxpayers]\u00a0receive from gaming operations in the present arrangement.&#8221; In other remarks, Bradley said, &#8220;We have a lot of strong personalities on this committee, so the fact we were able to get a bill out says a lot.&#8221; In his own defense, Negron said that the reduction on slot-machine taxes would be offset by the revenue generated from his proposal to allow slots in six additional counties.<\/p>\n<p>Negron&#8217;s dangled a lot of goodies in front of gaming interests. It will be interesting to see which of them he has to sacrifice to get the compact past the considerably less-expansive-minded House.<\/p>\n<p>* How do you the horsey set to agree to live with i-gaming even if they&#8217;re not participating? Offer them $60 million in free money, that&#8217;s how. But there&#8217;s a big hurdle to this <strong>California <\/strong>proposal. The $60 mil <a href=\"http:\/\/ggbnews.com\/issue\/vol-14-no-8-february-22-2016\/article\/latest-california-ipoker-bill-includes-something-for-racetracks\" target=\"_blank\" rel=\"noopener noreferrer\" class=\"broken_link\">would be contingent on i-poker revenues hitting an astronomical $400 million\/year threshold<\/a>. Industry experts estimate that, at peak, California would still be at least $40 million shy of that number Also, a hard-line faction of California tribes continues to hold out for a &#8220;bad actor&#8221; clause that would keep <strong>PokerStars<\/strong> and other &#8220;Black Friday&#8221; violators out of the Golden State.<\/p>\n<p>The vast bulk of the horseracing lucre would go toward fatter purses, with jockeys getting a pittance (2%) of the outlay. Except for a per-hand <img loading=\"lazy\" class=\"alignright size-medium wp-image-12477\" src=\"https:\/\/www.lasvegasadvisor.com\/stiffs-and-georges\/wp-content\/uploads\/2014\/01\/Internet-casino-300x168.jpg\" alt=\"Internet casino\" width=\"300\" height=\"168\" srcset=\"https:\/\/www.lasvegasadvisor.com\/stiffs-and-georges\/wp-content\/uploads\/2014\/01\/Internet-casino-300x168.jpg 300w, https:\/\/www.lasvegasadvisor.com\/stiffs-and-georges\/wp-content\/uploads\/2014\/01\/Internet-casino-150x84.jpg 150w, https:\/\/www.lasvegasadvisor.com\/stiffs-and-georges\/wp-content\/uploads\/2014\/01\/Internet-casino.jpg 620w\" sizes=\"(max-width: 300px) 100vw, 300px\" \/>&#8220;transaction fee,&#8221; online casinos would collect no revenue from poker. Even so, a union lobbyist conceded that the proposal was &#8220;probably a pretty good deal.&#8221; The <strong>Pechanga Band<\/strong> and its allies, however, still represent a formidable obstacle. Some tribes are also chafing at how daily fantasy sports legalization raced through the state legislature, which\u00a0<strong>Morongo Band of Mission Indians<\/strong> Chairman <strong>Robert Martin<\/strong> called rewarding DFS operators for breaking the law, simply because they&#8217;re popular. So is online poker but we question whether racetracks will ever see a dime from its legalization in California.<\/p>\n<p>* <strong>Las Vegas<\/strong> tourists can have a perfectly good time and never set foot on the <strong>Las Vegas Strip<\/strong>.
