{"id":18773,"date":"2016-08-26T12:33:59","date_gmt":"2016-08-26T20:33:59","guid":{"rendered":"https:\/\/www.lasvegasadvisor.com\/stiffs-and-georges\/?p=18773"},"modified":"2020-05-26T06:00:05","modified_gmt":"2020-05-26T14:00:05","slug":"new-ally-for-mashpee-adelson-my-way-or-the-highway","status":"publish","type":"post","link":"https:\/\/www.lasvegasadvisor.com\/stiffs-and-georges\/new-ally-for-mashpee-adelson-my-way-or-the-highway\/","title":{"rendered":"New ally for Mashpee; Adelson: My way or the highway"},"content":{"rendered":"<p>In the latest twist of the <strong>Project First Light<\/strong> saga, the <strong>Justice Department<\/strong> has <img loading=\"lazy\" class=\"alignright size-medium wp-image-18042\" src=\"https:\/\/www.lasvegasadvisor.com\/stiffs-and-georges\/wp-content\/uploads\/2016\/04\/Taunton-casino-300x200.jpg\" alt=\"Taunton casino\" width=\"300\" height=\"200\" srcset=\"https:\/\/www.lasvegasadvisor.com\/stiffs-and-georges\/wp-content\/uploads\/2016\/04\/Taunton-casino-300x200.jpg 300w, https:\/\/www.lasvegasadvisor.com\/stiffs-and-georges\/wp-content\/uploads\/2016\/04\/Taunton-casino-150x100.jpg 150w, https:\/\/www.lasvegasadvisor.com\/stiffs-and-georges\/wp-content\/uploads\/2016\/04\/Taunton-casino.jpg 600w\" sizes=\"(max-width: 300px) 100vw, 300px\" \/>interceded on behalf of the <strong>Mashpee Wampanoag<\/strong>. It has asked a federal judge to revisit his ruling that the Mashpee lacked standing and that the <strong>Interior Department<\/strong> erred by taking the <strong>Taunton<\/strong> land into trust. Justice&#8217;s intervention hinges upon the distinction between &#8220;federal jurisdiction&#8221; and &#8220;federal jurisdiction.&#8221; At the time of 1934&#8217;s <strong>Indian Recognition Act<\/strong>, a <strong>Godzilla<\/strong>-sized stumbling block, the Mashpee were unrecognized but nevertheless under federal jurisdiction. Judge\u00a0<strong>William G. Young<\/strong>&#8216;s ruling has put an enormous crimp in the tribe&#8217;s plan to open First Light by next summer: construction is at a halt.<\/p>\n<p>\u201cWe\u2019ve been on our land for thousands of years, and all we seek is <!--more-->the right to exist here as a sovereign people.\u00a0It was promised to us soon after the first Pilgrims arrived, and it\u2019s a promise we hope the courts will honor,\u201d tribal Chairman <strong>Cedric Cromwell<\/strong> told the <em>Boston Globe<\/em>. There&#8217;s a lot more at stake than a casino. If Young&#8217;s ruling is not reversed, the tribe could lose 170 acres of reservation in <strong>Mashpee<\/strong> itself. Nothing comes easily for the tribe, whose struggle for prosperity has been hard-earned.<\/p>\n<p>* In a win-win scenario, casino profits <a href=\"http:\/\/www.tulsaworld.com\/news\/state\/prairie-land-owned-by-ted-turner-transferred-to-osage-nation\/article_0137f9f8-27b5-5e7b-b898-9573da842d2a.html\" target=\"_blank\" rel=\"noopener noreferrer\">financed the purchase<\/a> by the <strong>Osage Nation<\/strong> of 43,000 acres of ranch land near <strong>Hominy<\/strong>, <strong>Oklahoma<\/strong>. They also made <strong>Ted Turner<\/strong> &#8212; who sold the prairie acreage &#8212; $74 million richer. Both parties received a congratulatory message from President <strong>Barack Obama<\/strong>. Turner had one overriding concern about the sale. \u201cI want this land preserved for generations to come,\u201d he told Chief <strong>Geoffrey Standing Bear<\/strong>, who responded that &#8220;It will be forever.\u201d Standing Bear made good on his promise early when he ashcanned a proposal to ranch wild mustangs on the land, which would make a quick buck but &#8220;would take a heavy toll on the land.\u201d Bison are a possibility, as are cattle. The prairie was indigenous Osage land before the federal government pushed them off it in the early 20th century. As Standing Bear said, &#8220;You will not find such names among us as profit, rent or return on investment.&#8221; The Turner acreage is but a fraction of the former Osage Nation, but it&#8217;s a good start. (By the way, the <strong>American Gaming Association<\/strong> has announced that tribal gaming generated $4.2 billion in economic activity in the Sooner State, presumably using 2015 figures.)<\/p>\n<p>* There&#8217;s a new top dog in <strong>Macao<\/strong> and it&#8217;s <strong>Galaxy Entertainment<\/strong>. The local construction firm-turned-casino operator had the largest market share in the first half of <img loading=\"lazy\" class=\"alignright size-medium wp-image-17162\" src=\"https:\/\/www.lasvegasadvisor.com\/stiffs-and-georges\/wp-content\/uploads\/2015\/11\/Galaxy-Cotai-300x189.jpg\" alt=\"Galaxy Cotai\" width=\"300\" height=\"189\" srcset=\"https:\/\/www.lasvegasadvisor.com\/stiffs-and-georges\/wp-content\/uploads\/2015\/11\/Galaxy-Cotai-300x189.jpg 300w, https:\/\/www.lasvegasadvisor.com\/stiffs-and-georges\/wp-content\/uploads\/2015\/11\/Galaxy-Cotai-150x95.jpg 150w, https:\/\/www.lasvegasadvisor.com\/stiffs-and-georges\/wp-content\/uploads\/2015\/11\/Galaxy-Cotai.jpg 625w\" sizes=\"(max-width: 300px) 100vw, 300px\" \/>2016. It was also the only operator to record a gain in profitability. Its $3.1 billion haul easily eclipsed <strong>Las Vegas Sands<\/strong>&#8216; $2.6 billion, a fact that must be giving <strong>Sheldon Adelson<\/strong> fits. Of course, Sheldon will be firing back on Sept. 13, when he opens <strong>Parisian Macao<\/strong>, a $2.7 billion spin of the roulette wheel. The secret of Galaxy&#8217;s success was growth of its mass-market play by 22%. Very high hotel occupancy also helped, as did diversification of its attractions, which produced a substantial increase in revenue. Remarkably, Galaxy also managed to eke out $103 million in cost cuts without pink-slipping any staff.<\/p>\n<p>Even so, Galaxy Deputy Chairman <strong>Francis Lui<\/strong> wasn&#8217;t taking a victory lap. &#8220;The market is showing signs it has hit bottom. It is too early to definitively call [it] the bottom of the market.&#8221; Not taking any chances, Galaxy plans to shave another $37 million off its budget in the remaining half of the year.<\/p>\n<p>* Speaking of Adelson, his minions are insistent that <strong>Nevada<\/strong> taxpayers be soaked for $750 million for a <strong>[your city here] Raiders<\/strong> stadium &#8212; <a href=\"http:\/\/lasvegassun.com\/news\/2016\/aug\/25\/developers-no-negotiating-on-750-million-for-propo\/?_ga=1.57063082.125885817.1456524315\" target=\"_blank\" rel=\"noopener noreferrer\" class=\"broken_link\">or else<\/a>. Turning up the pressure, they&#8217;re <img loading=\"lazy\" class=\"alignleft size-medium wp-image-8326\" src=\"https:\/\/www.lasvegasadvisor.com\/stiffs-and-georges\/wp-content\/uploads\/2012\/01\/Sheldon-A-212x300.jpg\" alt=\"Sheldon A\" width=\"212\" height=\"300\" srcset=\"https:\/\/www.lasvegasadvisor.com\/stiffs-and-georges\/wp-content\/uploads\/2012\/01\/Sheldon-A-212x300.jpg 212w, https:\/\/www.lasvegasadvisor.com\/stiffs-and-georges\/wp-content\/uploads\/2012\/01\/Sheldon-A-106x150.jpg 106w, https:\/\/www.lasvegasadvisor.com\/stiffs-and-georges\/wp-content\/uploads\/2012\/01\/Sheldon-A.jpg 400w\" sizes=\"(max-width: 212px) 100vw, 212px\" \/>demanding that the Legislature be called into special session to expedite the deal. Sands Lobbyist Numero Uno <strong>Andy Abboud<\/strong> admitted he&#8217;d been pestering lawmakers twice, even thrice a day to get them into line. At Sands&#8217; presentation, stadium backers trotted out new renderings of a $1.3 billion, transparent-roofed stadium, just south of <strong>Mandalay Bay<\/strong>. Mayor <strong>Carolyn Goodman<\/strong> continues push for repurposing <strong>Cashman Field<\/strong> as a stadium site but isn&#8217;t finding any takers. To try and sweeten the stadium committee&#8217;s medicine, Chairman <strong>Steve Hill<\/strong> said,\u00a0\u201cThe public is not making a contribution to a privately owned stadium.\u201d Hmph. Tell that to the Marines. (Sands previously nixed a compromise that would have pushed the public contribution down to $550 million.) Tellingly, local investors are shying away from the project. Adelson, by the way, has a net worth of $29.5 billion. If he wants this stadium so badly, why doesn&#8217;t he sell some Sands stock and build the damn thing himself? As for the <em>Malosos<\/em>, they must be feeling pretty confident, <a href=\"http:\/\/www.forbes.com\/sites\/darrenheitner\/2016\/08\/25\/oakland-raiders-file-trademark-applications-for-las-vegas-raiders\/#3de0c13b584f\" target=\"_blank\" rel=\"noopener noreferrer\" class=\"broken_link\">considering that they&#8217;ve trademarked<\/a> &#8220;<strong>Las Vegas Raiders<\/strong>,&#8221; just in case.<\/p>\n<p>* It&#8217;s fourth-and-long time for <strong>FanDuel<\/strong> and <strong>DraftKings<\/strong> after they bombed with the <strong>Nevada Gaming Policy Committee<\/strong>. Among the factors working against them at this point are that daily fantasy sports isn&#8217;t lucrative enough to make the state want to play ball, as it were, and the opposition of companies like <strong>Station Casinos<\/strong> and <strong>Caesars Entertainment<\/strong>, who believe that a carve-out for DFS renders their sports books second-class corporate citizens (and more heavily taxed ones, to <img loading=\"lazy\" class=\"alignright size-medium wp-image-3755\" src=\"https:\/\/www.lasvegasadvisor.com\/stiffs-and-georges\/wp-content\/uploads\/2010\/06\/Murren-240x300.jpg\" alt=\"Murren\" width=\"240\" height=\"300\" srcset=\"https:\/\/www.lasvegasadvisor.com\/stiffs-and-georges\/wp-content\/uploads\/2010\/06\/Murren-240x300.jpg 240w, https:\/\/www.lasvegasadvisor.com\/stiffs-and-georges\/wp-content\/uploads\/2010\/06\/Murren-120x150.jpg 120w, https:\/\/www.lasvegasadvisor.com\/stiffs-and-georges\/wp-content\/uploads\/2010\/06\/Murren.jpg 320w\" sizes=\"(max-width: 240px) 100vw, 240px\" \/>add insult to injury). The DFS biggies, for their part, <a href=\"http:\/\/lasvegassun.com\/news\/2016\/aug\/26\/draftkings-fanduel-head-back-to-the-drawing-board\/?_ga=1.57063082.125885817.1456524315\" target=\"_blank\" rel=\"noopener noreferrer\">feel that accepting gambling licenses in Nevada would stigmatize the industry<\/a> in other states, maybe call its very nature into question. (A not-illegitimate concern.) Considering that DFS operators are willing to pay $50,000 a year to do business in <strong>New York State<\/strong>, their offer of $10,000 a year to <strong>Nevada<\/strong> also looks unconvincing. A possible compromise, supported by <strong>MGM Resorts International<\/strong> CEO <strong>Jim Murren<\/strong>, would create a new regulatory subcategory for peer-to-peer wagering, under which rubric DFS would be defined as a skill-based activity. Now he has to run it up the flagpole and see if anybody else in the casino industry salutes. A preview of the likely response was provided by attorney <strong>Frank Schreck<\/strong>, who said, \u201cIt clearly will take wagering dollars out of sports books. If you are going to do that, what\u2019s the offsetting benefit to the state of Nevada or the industry?\u201d Sports books have done very well for the Silver State. In a cost\/benefit analysis, outsourcing some of that revenue to DFS may come out a loser.<\/p>\n<p>* <strong>Donald Trump<\/strong>&#8216;s current ubiquity <a href=\"http:\/\/lasvegassun.com\/news\/2016\/aug\/26\/in-books-on-trump-consistent-portraits-of-a-high-d\/?_ga=1.136172593.125885817.1456524315\" target=\"_blank\" rel=\"noopener noreferrer\">has created a cottage industry<\/a> in the book business. (It&#8217;s an ill wind indeed that doesn&#8217;t blow somebody some good.) The one I most want to read is <strong>Gary Trudeau<\/strong>&#8216;s <em>Yuge!<\/em>, which validates\u00a0Trump&#8217;s remark, \u201cMy cartoon is real.
