The Twitterverse briefly arose in <strong>#BoycottMGM<\/strong> outrage, but it died down by day&#8217;s end and MGM <img loading=\"lazy\" class=\"alignright size-medium wp-image-21998\" src=\"https:\/\/www.lasvegasadvisor.com\/stiffs-and-georges\/wp-content\/uploads\/2018\/07\/Mandalay-Bay-300x190.jpg\" alt=\"\" width=\"300\" height=\"190\" srcset=\"https:\/\/www.lasvegasadvisor.com\/stiffs-and-georges\/wp-content\/uploads\/2018\/07\/Mandalay-Bay-300x190.jpg 300w, https:\/\/www.lasvegasadvisor.com\/stiffs-and-georges\/wp-content\/uploads\/2018\/07\/Mandalay-Bay-150x95.jpg 150w, https:\/\/www.lasvegasadvisor.com\/stiffs-and-georges\/wp-content\/uploads\/2018\/07\/Mandalay-Bay.jpg 625w\" sizes=\"(max-width: 300px) 100vw, 300px\" \/>stock price was unruffled. The company did, however, obliquely acknowledge that &#8216;MGM sues victims&#8217; makes a bad headline and tried t0 explain its hair-splitting legal strategy:\u00a0\u201cWe have filed what is known as an action for declaratory relief. All we are doing, in effect, is asking for a change in venue from state to federal court. We are not asking for money or attorney\u2019s fees. We only want to resolve these cases quickly, fairly and efficiently.\u201d (And in MGM&#8217;s favor, of course. Hence the forum-shopping in the <strong>Ninth Circuit<\/strong>.)<\/p>\n<p>By filing the suit, MGM placed itself in a <!--more-->no-win PR situation, as crisis-management expert <strong>Eric Rose<\/strong>\u00a0elucidated.\u00a0\u201cThey couldn\u2019t explain the lawsuit in a sound bite, and therefore they are suffering the consequences with bad headlines. It makes it look like they are going after the victims. It is going to hurt their brand.\u201d<\/p>\n<p><em>Las Vegas Review-Journal<\/em> reporter <strong>Todd Prince<\/strong> <a href=\"https:\/\/www.reviewjournal.com\/business\/casinos-gaming\/social-media-uproar-follows-lawsuit-against-victims-with-boycottmgm\/\">delved into the pages<\/a> of MGM&#8217;s legal filing and found some damaging verbiage.\u00a0\u201cIf defendants were injured by Paddock\u2019s assault, as they <img loading=\"lazy\" class=\"alignleft size-medium wp-image-7735\" src=\"https:\/\/www.lasvegasadvisor.com\/stiffs-and-georges\/wp-content\/uploads\/2011\/10\/murrens-head-223x300.jpg\" alt=\"\" width=\"223\" height=\"300\" srcset=\"https:\/\/www.lasvegasadvisor.com\/stiffs-and-georges\/wp-content\/uploads\/2011\/10\/murrens-head-223x300.jpg 223w, https:\/\/www.lasvegasadvisor.com\/stiffs-and-georges\/wp-content\/uploads\/2011\/10\/murrens-head-111x150.jpg 111w, https:\/\/www.lasvegasadvisor.com\/stiffs-and-georges\/wp-content\/uploads\/2011\/10\/murrens-head.jpg 442w\" sizes=\"(max-width: 223px) 100vw, 223px\" \/>allege, they were inevitably injured both because Paddock fired from his window and because they remained in the line of fire at the concert,&#8221; the lawsuit reads. Yup. MGM went there. <a href=\"https:\/\/lasvegassun.com\/news\/2018\/jul\/17\/mgm-sues-strip-mass-shooting-victims-argues-it-isn\/?utm_source=mostpopular&amp;utm_medium=banner&amp;utm_campaign=mostRead\" target=\"_blank\" rel=\"noopener noreferrer\">It blamed the victims<\/a>. Gosh darn them, why did they have to remain in the line of fire, creating all these\u00a0lawsuits for MGM? For the short term, MGM will look Too Big To Care. However, other than the lingering stigma at <strong>Mandalay Bay<\/strong> itself, we don&#8217;t expect the backlash to generate much more than a blip in the 3Q18 filing.\u00a0MGM&#8217;s seen worse. Don&#8217;t forget this is the company that came within hours of a <strong>CityCenter<\/strong> bankruptcy.<\/p>\n<p>MGM&#8217;s <a href=\"https:\/\/www.nbcnews.com\/storyline\/las-vegas-shooting\/mandalay-bay-owner-files-complaint-against-victims-las-vegas-shooting-n892081?icid=related\" target=\"_blank\" rel=\"noopener noreferrer\">defense hinges<\/a> on the\u00a0<strong>Support Anti-Terrorism by Fostering Effective Technologies Act<\/strong>. The company&#8217;s event-security subcontractor was certified by the <strong>Department of Homeland Security<\/strong>, pursuant to the Safety Act. However, since the <strong>FBI<\/strong> has been disinclined to classify shooter <strong>Stephen Paddock<\/strong> as a terrorist, there could be a flaw in MGM&#8217;s reasoning. According to one news report, &#8220;The request is both a <img loading=\"lazy\" class=\"alignright size-full wp-image-12994\" src=\"https:\/\/www.lasvegasadvisor.com\/stiffs-and-georges\/wp-content\/uploads\/2014\/03\/Mandalay-Bay-pic.jpg\" alt=\"\" width=\"300\" height=\"207\" srcset=\"https:\/\/www.lasvegasadvisor.com\/stiffs-and-georges\/wp-content\/uploads\/2014\/03\/Mandalay-Bay-pic.jpg 300w, https:\/\/www.lasvegasadvisor.com\/stiffs-and-georges\/wp-content\/uploads\/2014\/03\/Mandalay-Bay-pic-150x103.jpg 150w\" sizes=\"(max-width: 300px) 100vw, 300px\" \/>way of streamlining the more than 2,000 individuals who have brought lawsuits or threatened to bring lawsuits against MGM, and also an attempt to prove to a judge that it followed the letter of the law and shouldn&#8217;t be held responsible.&#8221;<\/p>\n<p>Victims&#8217; attorney <strong>Robert Eglet <\/strong>retorted, &#8220;This is the first time that we&#8217;re aware of that anyone has raised the Safety Act and tried to basically get out of responsibility for their negligence by trying to use the Safety Act.&#8221; One news report opines that &#8220;While this &#8216;lawsuit&#8217; by MGM will be perceived as an aggressive, offensive maneuver, it\u2019s the opposite. It\u2019s really a request to determine the extent of MGM\u2019s proposed defense.&#8221; Contractor <strong>Contemporary Services Corp<\/strong>. <a href=\"https:\/\/www.cnbc.com\/2018\/07\/17\/mgm-resorts-files-suit-against-more-than-1000-route-91-victims.html?__source=sharebar%7Cemail&amp;par=sharebar\" target=\"_blank\" rel=\"noopener noreferrer\">probably needn&#8217;t worry<\/a> about being pushed under the bus, given its DHS certification.<\/p>\n<p>Adds <em>LVA<\/em> publisher <strong>Anthony Curtis<\/strong>, &#8220;MGM is technically &#8216;suing&#8217; the defendants, but not in the familiar &#8216;personal injury&#8217; sense. That is, MGM is not accusing the victims of carelessly causing MGM harm, nor are they demanding money from the bereaved. This case will not culminate in emotional testimony from shooting victims before a jury. It\u2019s likely that this case will be decided by a judge, with little or no testimony required at all.&#8221; We can see where that would gratify MGM &#8212; and engender resentment among the victims.<\/p>\n<p>In better MGM news, the opening of <strong>MGM Springfield<\/strong> has been <a href=\"http:\/\/casinostylemagazine.com\/article\/history-repeats-itself\/\" target=\"_blank\" rel=\"noopener noreferrer\">moved forward a month<\/a>, set for August 18. <strong>Friedmutter Group<\/strong>&#8216;s design work sounds exciting: &#8220;The reimagined architecture will include whimsical design elements with tributes to local denizens <strong>Dr. Seuss<\/strong> and <strong>Emily Dickinson<\/strong>, among others &#8230;\u00a0The company will restore the <strong>United Electric<\/strong> lobby with its terrazzo floors, marbled walls and stained-glass dome.&#8221; The future of <strong>Springfield<\/strong> is going to owe a great deal to its past. It will be $960 million well spent.<\/p>\n<p>* <strong>Marc Lasry<\/strong>, venture capitalist and &#8220;george&#8221; <strong>Democratic Party<\/strong> donor, has kept a low profile since being run out of <strong>Atlantic City<\/strong> by <strong>Carl Icahn<\/strong>. But he&#8217;s back in the news again, buying <strong>Navajo Generating Station<\/strong> and the coal mine that sustains its noxious fumes. Lasry&#8217;s modus operandi is to purchase &#8220;distressed assets.&#8221; Anybody who&#8217;s been the owner of <strong>Trump Entertainment Resorts<\/strong> is definitely an expert on what constitutes a distressed asset.<\/p>\n<p>* The <strong>University of Nevada-Las Vegas<\/strong>&#8216; <strong>Fertitta Football Complex<\/strong> has run into &#8212; surprise, surprise &#8212; cost overruns. The school is going to use the complex as is an figure out how to finish it later. Will <strong>Lorenzo Fertitta<\/strong> and family pony up the $5 million shortfall? <a href=\"https:\/\/www.reviewjournal.com\/sports\/unlv\/unlv-football\/unlv-falls-short-of-funds-to-finish-fertitta-football-complex\/\" target=\"_blank\" rel=\"noopener noreferrer\">They&#8217;re not talking<\/a>.<\/p>\n<p>* <strong>Dan Gilbert<\/strong> never got around to building that permanent casino in downtown <strong>Cleveland<\/strong>. But he <a href=\"http:\/\/casinostylemagazine.com\/article\/history-in-the-making\/\" target=\"_blank\" rel=\"noopener noreferrer\">built himself a nice corporate headquarters<\/a> in <strong>Detroit<\/strong>.
