{"id":22185,"date":"2018-08-01T07:16:39","date_gmt":"2018-08-01T15:16:39","guid":{"rendered":"https:\/\/www.lasvegasadvisor.com\/stiffs-and-georges\/?p=22185"},"modified":"2018-08-02T05:37:29","modified_gmt":"2018-08-02T13:37:29","slug":"murren-steps-in-it-again-more-casinos-join-sports-betting-arms-race","status":"publish","type":"post","link":"https:\/\/www.lasvegasadvisor.com\/stiffs-and-georges\/murren-steps-in-it-again-more-casinos-join-sports-betting-arms-race\/","title":{"rendered":"Murren steps in it (again); More casinos join sports-betting arms race"},"content":{"rendered":"<p><strong>MGM Resorts International<\/strong> has decided that it made a <em>faux pas<\/em> &#8230; not by suing victims of the Mandalay Bay Massacre but by not explaining to employees what it was doing, leaving them open, says CEO <strong>Jim Murren<\/strong>, to &#8220;media reports which were misleading <img loading=\"lazy\" class=\"alignleft size-medium wp-image-18630\" src=\"https:\/\/www.lasvegasadvisor.com\/stiffs-and-georges\/wp-content\/uploads\/2016\/08\/Jim-Murren-221x300.jpg\" alt=\"\" width=\"221\" height=\"300\" srcset=\"https:\/\/www.lasvegasadvisor.com\/stiffs-and-georges\/wp-content\/uploads\/2016\/08\/Jim-Murren.jpg 221w, https:\/\/www.lasvegasadvisor.com\/stiffs-and-georges\/wp-content\/uploads\/2016\/08\/Jim-Murren-111x150.jpg 111w\" sizes=\"(max-width: 221px) 100vw, 221px\" \/>and truly awful.\u201d Said the CEO,\u00a0\u201cI first want to express my sincere regret that we did not spend more time explaining what we were trying to accomplish.\u201d I don&#8217;t know what&#8217;s so difficult to explain about having a plethora of lawsuits dismissed. Instead of taking this opportunity to enlarge upon MGM&#8217;s legal strategy, <a href=\"https:\/\/www.reviewjournal.com\/crime\/shootings\/mgm-ceo-apologizes-to-employees-for-not-communicating-about-oct-1-lawsuits\/\" target=\"_blank\" rel=\"noopener noreferrer\">Murren simply reiterate<\/a>d what the company has already said:\u00a0\u201cWe believe this action benefits all victims by providing an opportunity for closure in a swift and fair manner.&#8221; Yes, I&#8217;m sure if litigants get their cases tossed out of court they&#8217;ll be sure to thank MGM for being &#8220;swift and fair.&#8221; Boy, does the company keep tripping over its shoelaces.<\/p>\n<p>Murren compounded his insensitivity by saying the action was taken in part for the convenience of <!--more-->MGM employees, should the cases proceed in civil court.\u00a0\u201cIf these cases proceed in this manner, victims, which include MGM Resorts employees and families\u00a0first responders and witnesses would face the need to testify over and over again, traveling throughout various court rooms across the US in trial after trial.\u201d Ah, that\u00a0<em>must<\/em> have been at the root of MGM&#8217;s decision.<\/p>\n<p>For legal expert <strong>David Levine<\/strong> it&#8217;s all about MGM saving money by resolving the case in one big trial, according to the <em>Las Vegas Review-Journal<\/em>. Levine expects MGM to win but,\u00a0\u201cIn a personal injury situation, you let the plaintiffs go first,\u201d after which MGM could present its <strong>Safety Act<\/strong> defense. The company obviously doesn&#8217;t want it to get that far, which is why it&#8217;s trying to head <img loading=\"lazy\" class=\"alignright size-medium wp-image-21998\" src=\"https:\/\/www.lasvegasadvisor.com\/stiffs-and-georges\/wp-content\/uploads\/2018\/07\/Mandalay-Bay-300x190.jpg\" alt=\"\" width=\"300\" height=\"190\" srcset=\"https:\/\/www.lasvegasadvisor.com\/stiffs-and-georges\/wp-content\/uploads\/2018\/07\/Mandalay-Bay-300x190.jpg 300w, https:\/\/www.lasvegasadvisor.com\/stiffs-and-georges\/wp-content\/uploads\/2018\/07\/Mandalay-Bay-150x95.jpg 150w, https:\/\/www.lasvegasadvisor.com\/stiffs-and-georges\/wp-content\/uploads\/2018\/07\/Mandalay-Bay.jpg 625w\" sizes=\"(max-width: 300px) 100vw, 300px\" \/>plaintiffs off at the pass by moving for a declaratory judgment <em>hors de combat<\/em>.<\/p>\n<p>Even&#8217;s Murren&#8217;s letter of explanation seems to have been judged a goof. MGM &#8212; or someone &#8212; <a href=\"https:\/\/www.casino.org\/news\/mgm-resorts-jim-murren-apologizes-poorly-communicating-lawsuit\" target=\"_blank\" rel=\"noopener noreferrer\">was quick to remove it<\/a> from <strong>Scribd<\/strong>. Both the 2,500 plaintiffs and MGM have to lob legal Hail Marys to make their case: MGM to prove that the Safety Act immunity of its security contractor extends by association to MGM itself, the plaintiffs to demonstrate negligence on the casino company&#8217;s part. At least Murren can breathe a sigh of relief that his NBA &#8220;official gaming partner&#8221; pact is pushing his latest mansplanation out of the headlines.<\/p>\n<p>* As I type this, <strong>Harrah&#8217;s Resort<\/strong> is only minutes away from starting to take sports wagers. Like <strong>Bally&#8217;s Wild Wild West<\/strong>, it&#8217;s using a somewhat thrown-together, temporary book to get the <img loading=\"lazy\" class=\"alignright size-medium wp-image-7762\" src=\"https:\/\/www.lasvegasadvisor.com\/stiffs-and-georges\/wp-content\/uploads\/2011\/10\/Harrahs-AC_2-207x300.jpg\" alt=\"\" width=\"207\" height=\"300\" srcset=\"https:\/\/www.lasvegasadvisor.com\/stiffs-and-georges\/wp-content\/uploads\/2011\/10\/Harrahs-AC_2-207x300.jpg 207w, https:\/\/www.lasvegasadvisor.com\/stiffs-and-georges\/wp-content\/uploads\/2011\/10\/Harrahs-AC_2-103x150.jpg 103w, https:\/\/www.lasvegasadvisor.com\/stiffs-and-georges\/wp-content\/uploads\/2011\/10\/Harrahs-AC_2.jpg 692w\" sizes=\"(max-width: 207px) 100vw, 207px\" \/>ball rolling. <strong>Caesars Entertainment<\/strong> regional President <strong>Kevin Ortzman<\/strong> believes sports betting <a href=\"https:\/\/www.pressofatlanticcity.com\/news\/top_three\/bally-s-wild-wild-west-launches-sports-betting-monday-harrah\/article_9679f400-6070-5715-af26-44a9b8613bd5.html\" target=\"_blank\" rel=\"noopener noreferrer\">can grow the Boardwalk<\/a>: \u201cWe have found that the majority of sports bettors are not the same as our core gamers. So this brings a whole new customer to <strong>Atlantic City<\/strong>.\u201d I&#8217;m surprised at how few Atlantic City casinos are ready to launch sports betting, having been caught napping by the <strong>Supreme Court<\/strong> ruling in <em>Murphy v. NCAA<\/em>. But some &#8212; mainly Caesars &#8212; have obviously made the reward-vs.-risk calculation that no one will care if a quick-and-dirty sports book is plunked down if <strong>New Jersey<\/strong> won, saving company money while punters wait for the high-tech version.<\/p>\n<p>That would include easily impressed Millennial <strong>Kevin Nagle<\/strong>, who says sports betting will &#8220;save Atlantic City.&#8221; (Note to Nagle: It&#8217;s <img loading=\"lazy\" class=\"alignleft size-full wp-image-8199\" src=\"https:\/\/www.lasvegasadvisor.com\/stiffs-and-georges\/wp-content\/uploads\/2012\/01\/CaesarsBallysAC.jpg\" alt=\"\" width=\"250\" height=\"166\" srcset=\"https:\/\/www.lasvegasadvisor.com\/stiffs-and-georges\/wp-content\/uploads\/2012\/01\/CaesarsBallysAC.jpg 250w, https:\/\/www.lasvegasadvisor.com\/stiffs-and-georges\/wp-content\/uploads\/2012\/01\/CaesarsBallysAC-150x99.jpg 150w\" sizes=\"(max-width: 250px) 100vw, 250px\" \/>still the third-biggest gambling market in the U.S.) Calling sports wagers &#8220;the only thing&#8221; standing between Atlantic City and doom, Nagle said, \u201cIt\u2019s going to be awesome. Sit back, drink a couple beers and watch some sports. It\u2019s fucking awesome.\u201d That&#8217;s the future of America for you, folks. Try not to panic.<\/p>\n<p>* <em>U.S. News &amp; World Report<\/em> ranked the top hotel-loyalty programs and *not one* casino company <a href=\"https:\/\/www.cntraveler.com\/story\/us-news-and-world-report-names-the-best-airline-and-hotel-loyalty-programs\" target=\"_blank\" rel=\"noopener noreferrer\">even cracked the top 10<\/a>. No <strong>Total Rewards<\/strong>, no <strong>MLife<\/strong>. Etcetera. Surely we can do better than that? How about making it a goal for 2019?<\/p>\n<p>*\u00a0Maybe it&#8217;s a generational thing but <strong>Lawrence Ho<\/strong> seems to be outpacing <strong>Sheldon Adelson<\/strong> as the trendsetter for <strong>Macao<\/strong>. <img loading=\"lazy\" class=\"alignright size-medium wp-image-16726\" src=\"https:\/\/www.lasvegasadvisor.com\/stiffs-and-georges\/wp-content\/uploads\/2015\/09\/Studio-City-300x200.jpg\" alt=\"\" width=\"300\" height=\"200\" srcset=\"https:\/\/www.lasvegasadvisor.com\/stiffs-and-georges\/wp-content\/uploads\/2015\/09\/Studio-City.jpg 300w, https:\/\/www.lasvegasadvisor.com\/stiffs-and-georges\/wp-content\/uploads\/2015\/09\/Studio-City-150x100.jpg 150w\" sizes=\"(max-width: 300px) 100vw, 300px\" \/>He&#8217;s opening the enclave&#8217;s <a href=\"http:\/\/www.casinonewsdaily.com\/2018\/07\/31\/casino-operator-melco-gets-into-lucrative-esports-market-with-dedicated-venue\/\" target=\"_blank\" rel=\"noopener noreferrer\">first e-sports stadium<\/a> in <strong>Studio City<\/strong>. Expected to open by year&#8217;s end, the stadium will broaden <strong>Melco Resorts &amp; Entertainment<\/strong>&#8216;s mass-market appeal. Not only has Melco dabbled with e-sports in the past, it is also responding to a governmental wish (<em>read<\/em>: mandate) to diversify consumer options beyond gambling.
