If you have a few days to spare, you can read the 111-page filing <a rel=\"noreferrer noopener\" href=\"https:\/\/vitalvegas.com\/wp-content\/uploads\/2020\/09\/2020.09.18-Vital-Anti-SLAPP-Motion.pdf\" target=\"_blank\">in its entirety<\/a>. To cut to the chase, attorney <strong>Marc Randazzo<\/strong> (a seasoned First Amendment warrior), writes that &#8220;Sahara is here on the novel theory that even though Vital Vegas stated this [&#8220;rumor is unconfirmed&#8221;] in its article, since it stated it in paragraphs following a photograph, that changes the otherwise non-defamatory article into a defamatory one. This theory is so novel and strange that it does not appear to have ever been brought in the <strong>United States<\/strong> before.&#8221; Indeed Sahara owner <strong>Alex Meruelo<\/strong> may have really stepped into a bear trap because Roeben is now free to unleash all manner of damaging information he had previously kept on the Q.T. (see page 5 of the lawsuit for a damning example, with even worse in the &#8220;Exhibits&#8221; section).<\/p>\n\n\n\n<!--nextpage-->\n\n\n\n<p>The filing is a tutorial in SLAPP lawsuits and how to defeat them, as Randazzo slaps down the Sahara&#8217;s far-fetched anti-Roeben allegations (such as that the story was knowingly false). He perforates the Sahara&#8217;s attorneys with citations of precedent upon precedent that will have them burning the midnight oil doing their homework. He has particular fun with the Sahara&#8217;s claim of having suffered &#8220;mental distress.&#8221; (Think of all the mental distress <strong>The Drew<\/strong> must suffer when we ridicule its architecture.) As for Roeben being the architect of a larger plot, &#8220;a conspiracy must have an\u00a0<em>unlawful\u00a0<\/em>objective. Providing truthful information protected under the First Amendment to the general public cannot form the basis of a conspiracy claim. No other analysis or discovery is necessary, and this claim must fail.&#8221; Indeed it must.<\/p>\n\n\n\n<p><img loading=\"lazy\" width=\"309\" height=\"200\" class=\"wp-image-3735\" style=\"width: 150px;\" src=\"https:\/\/www.lasvegasadvisor.com\/stiffs-and-georges\/wp-content\/uploads\/2010\/06\/hooters-pic.jpg\" alt=\"\" srcset=\"https:\/\/www.lasvegasadvisor.com\/stiffs-and-georges\/wp-content\/uploads\/2010\/06\/hooters-pic.jpg 309w, https:\/\/www.lasvegasadvisor.com\/stiffs-and-georges\/wp-content\/uploads\/2010\/06\/hooters-pic-150x97.jpg 150w, https:\/\/www.lasvegasadvisor.com\/stiffs-and-georges\/wp-content\/uploads\/2010\/06\/hooters-pic-300x194.jpg 300w\" sizes=\"(max-width: 309px) 100vw, 309px\" \/> In the course of a (<a rel=\"noreferrer noopener\" href=\"https:\/\/vitalvegas.com\/oyo-las-vegas-reopens-heres-the-skinny\/\" target=\"_blank\">favorable<\/a>) review of the rebooted <strong>Oyo Las Vegas<\/strong>, Roeben mentions <em>en passant<\/em> that &#8220;we hear <strong>Nevada<\/strong>\u2019s 50-person gathering limit will soon be bumped to 250 people.&#8221; That&#8217;s not much help to the big showrooms but is good news for the many more small- and medium-sized shows in town, provided they can balance higher capacity with social distancing, a tricky tightrope act if ever there was one. They have our sympathies.<\/p>\n\n\n\n<p class=\"has-drop-cap\">With revenue streams limited predominantly to gaming, casinos have been resorting to schemes like higher table limits in an effort to artificially boost revenue. Now Roeben has sussed out a new trick: triple-zero roulette. Yup, not one, not two, but three zeroes on the green felt. OK, so <strong>The Venetian<\/strong> snuck it into the market back in 2016, <a href=\"https:\/\/vitalvegas.com\/venetian-triple-zero-sands-roulette\/\">but only on one table<\/a>. <em>Caveat emptor<\/em>. Now you can find it up and down the Strip, even at low-roller joints like <strong>Harrah&#8217;s Las Vegas<\/strong>. It&#8217;s <a rel=\"noreferrer noopener\" href=\"https:\/\/vitalvegas.com\" target=\"_blank\">bad math for players<\/a>, raising the house edge a good 2.5%. The trend has also penetrated <strong>Downtown<\/strong> casinos like <strong>Terry Caudill<\/strong>&#8216;s (gotta make back that &#8216;no resort fees&#8217; money somewhere, we guess). At least the <strong>Plaza Hotel<\/strong> still hews to single-zero roulette. No wonder players rank it so highly.<\/p>\n\n\n\n<div class=\"wp-block-image\"><figure class=\"aligncenter size-large\"><img loading=\"lazy\" width=\"340\" height=\"255\" src=\"https:\/\/www.lasvegasadvisor.com\/stiffs-and-georges\/wp-content\/uploads\/2010\/06\/station1.jpg\" alt=\"\" class=\"wp-image-3383\" srcset=\"https:\/\/www.lasvegasadvisor.com\/stiffs-and-georges\/wp-content\/uploads\/2010\/06\/station1.jpg 340w, https:\/\/www.lasvegasadvisor.com\/stiffs-and-georges\/wp-content\/uploads\/2010\/06\/station1-150x112.jpg 150w, https:\/\/www.lasvegasadvisor.com\/stiffs-and-georges\/wp-content\/uploads\/2010\/06\/station1-300x225.jpg 300w\" sizes=\"(max-width: 340px) 100vw, 340px\" \/><\/figure><\/div>\n\n\n\n<p class=\"has-drop-cap\">In an empty victory for the <strong>Culinary Union<\/strong>, the <strong>National Labor Relations Board<\/strong> has moved toward upholding the outcome of a 2019 unionization vote at <strong>Fiesta Henderson<\/strong>. 57% of Fiesta workers voted &#8220;aye&#8221; but, as usual, <strong>Station Casinos<\/strong> went back on its word and refused to honor the election. \u201cI recommend that the Employer\u2019s objections be overruled in their entirety.\u00a0\u00a0The Employer has failed to meet the Board\u2019s standard and therefore has not provided evidence that raises a reasonable doubt as to the fairness and validity of the election. Therefore, I recommend that an appropriate Certification of Representative issue,\u201d wrote hearing officer <strong>Alvaro Medina<\/strong>. The reason the win rings hollow for the Culinary is that Fiesta Henderson is closed until June of next year, rendering the fate of its workforce basically moot. <\/p>\n\n\n\n<p>Station CEO <strong>Frank Fertitta<\/strong> III could easily shut it down entirely, thereby voiding the union vote. (It&#8217;s what <strong>Sue Lowden<\/strong> did when the Culinary won at what is now <strong>Santa Fe Station<\/strong>.) In spite of Absurdist situation, Culinary Secretary-Treasurer <strong>Geoconda Arg\u00fcello-Kline<\/strong> fumed, \u201cWe call on Station Casinos to immediately to negotiate and settle a fair contract for the workers at <strong>Red Rock Resort<\/strong>, Fiesta Henderson [closed], <strong>Fiesta Rancho<\/strong> [closed], <strong>Sunset Station<\/strong>, <strong>Palms<\/strong> [closed], <strong>Green Valley Ranch<\/strong>, <strong>Palace Station<\/strong> and <strong>Boulder Station<\/strong>.\u201d Station is in the wrong but the Culinary looks foolish taking a <strong>Henderson<\/strong> victory lap when 100% of the affected workers are unemployed.<\/p>\n\n\n\n<p class=\"has-drop-cap\"><strong>Colorado<\/strong> sports betting was big in August, with the state registering $128.5 million in handle, thanks to a full slate of major-league sports. Calling Colorado&#8217;s success basically premature, analyst <strong>Dustin Gouker<\/strong> wrote, &#8220;Considering the obstacles\u00a0Colorado&#8217;s\u00a0market has had to face since it launched in May, the results so far have surpassed the expectations of all but the most optimistic.&#8221; While we tend not to report sequential growth, in Colorado&#8217;s case it was 117% from July. Casinos kept $2 million, net, and would have had even higher gross revenue had they not splurged on marketing. The shifting fortunes of the <strong>Denver Nuggets<\/strong> kept bettors busy, plunking down $38 million on the <strong>NBA<\/strong>. The <strong>Colorado Rockies<\/strong> propelled $23 million in <strong>MLB<\/strong> bets and the <strong>NHL<\/strong> generated $13.5 million of action, thanks to the <strong>Colorado Avalanche<\/strong>&#8216;s playoff drive. (The postponement of major sports is providing a hidden benefit for the books, which were forcibly closed during what otherwise would have been NBA, MLB and NHL play.) <\/p>\n\n\n\n<p>With the Nuggets pressing forward and the <strong>Denver Broncos<\/strong> off to a rocky start (get well soon, <strong>Drew Lock<\/strong>), September is likely to obliterate August. Gouker concludes, &#8220;Colorado\u00a0started as a relatively open market for sportsbook operators and a well-conceived regulatory framework have made the state especially appealing.&#8221;\u00a0Look out, <strong>Indiana<\/strong>, the Rocky Mountain State is nipping at your heels.<\/p>\n\n\n\n<p><strong><em>Jottings<\/em><\/strong>: It&#8217;ll be a lonesome Yuletide on the <strong>Las Vegas Strip<\/strong>. Staple <strong>Cowboy Christmas<\/strong> <a href=\"https:\/\/news3lv.com\/news\/local\/cowboy-christmas-gift-show-joins-nfr-in-moving-to-texas\">has defected<\/a>, joining the <strong>National Finals Rodeo<\/strong>. Both will be held in <strong>Texas<\/strong> this year, although NFR has already committed to a 2021 return to Vegas &#8230; According to <strong>Las Vegas Metro<\/strong>, a woman suffered &#8220;minor injuries&#8221; in a Sept. 23 shooting at <strong>Aria<\/strong>&#8216;s valet-parking area. &#8220;Heavy police presence remains on part of the LV Strip,&#8221; reported <strong>8 News Now<\/strong>. Sadly, it&#8217;s needed. In addition to the brawl at <strong>Encore<\/strong> (video footage of which looked like a <strong>Donald Trump <\/strong>campaign ad), <a href=\"https:\/\/www.ktnv.com\/news\/crime\/vegas-pd-2-shot-near-paris-las-vegas-hotel-casino\">two people were shot<\/a> near <strong>Paris-Las Vegas<\/strong> recently. We&#8217;re no criminologist but the ongoing pandemic seems to have brought out extraordinary aggressiveness in the public. The Paris shooter has been caught but the Aria gunman remains at large &#8230; <\/p>\n\n\n\n<figure><iframe loading=\"lazy\" width=\"560\" height=\"315\" src=\"https:\/\/www.youtube.com\/embed\/ll71MQ_3gvk\" allowfullscreen=\"\"><\/iframe><\/figure>\n\n\n\n<p>Wallpaper in the <strong>Downtown Grand<\/strong>&#8216;s new hotel rooms may be <a rel=\"noreferrer noopener\" href=\"https:\/\/news3lv.com\/news\/local\/gallery\/new-augmented-reality-themed-gallery-tower-to-open-at-downtown-grand-on-tuesday#photo-1\" target=\"_blank\">the stuff of nightmares<\/a>. We applaud the creativity, even if the results are a little unsettling.
