Why? Because last night a federal judge <a href=\"https:\/\/floridapolitics.com\/archives\/475589-all-bets-are-off-federal-judge-tosses-floridas-new-gaming-compact\/\">struck down<\/a> the <strong>Seminole Tribe<\/strong>&#8216;s new compact with Gov. <strong>Ron DeSantis<\/strong> (R). Basically, Interior Secretary <strong>Deb Haaland<\/strong> screwed up and approved a compact that <a href=\"https:\/\/www.heraldtribune.com\/story\/news\/politics\/state\/2021\/11\/23\/florida-sports-betting-deal-seminole-tribe-judge-overturns-gambling-compact-pari-mutuels-smartphone\/8728062002\/\" class=\"broken_link\">violates the terms<\/a> of the <strong>Indian Gaming Regulatory Act<\/strong>. (Still unresolved is the state constitutionality of the compact, which is dubious at best.) District Court Judge <strong>Dabney Friedrich<\/strong> threw out the Biden administration&#8217;s daffy interpretation that gambling in cyberspace <a href=\"https:\/\/www.tampabay.com\/news\/breaking-news\/2021\/11\/22\/federal-judge-throws-out-florida-sports-betting-compact-with-seminole-tribe\/\">is happening on &#8220;tribal lands&#8221;<\/a> so long as that&#8217;s where the servers are located, a line of reasoning the court <a href=\"https:\/\/www.usbets.com\/judge-wipes-out-legal-sports-betting-florida\/\">dismissed as &#8220;fiction.&#8221;<\/a> <\/p>\n\n\n\n<p>Wrote Friedrich, &#8220;over a dozen provisions in IGRA regulate gaming on \u2018Indian lands,\u2019 and none regulate gaming in another location. Indeed, if there were any doubt on the issue, the <strong>Supreme Court<\/strong> has emphasized that \u2018[e]verything\u2014literally everything\u2014in IGRA affords tools \u2026 to regulate gaming on Indian lands, and nowhere else.\u2019&#8221; Chastising Haaland, the judge continued, \u201cThe Secretary must reject compacts that violate IGRA\u2019s terms.\u201d As gaming law expert <strong>Daniel Wallach<\/strong> said, \u201cThe avalanche of legal authority was on the side of invalidating online sports betting. She recognized the obvious\u2014that a customer located in <strong>Jacksonville<\/strong> or <strong>Key West<\/strong> or <strong>Pensacola<\/strong> is not on Indian land when they initiate the wager.\u201d He added that &#8220;the state of Florida and the Seminole Tribe were operating in a state of delusion.\u201d (You <em>can<\/em> place tribal sports bets in <strong>Michigan<\/strong>, <strong>Arizona<\/strong> and <strong>Connecticut<\/strong> &#8230; but only if you&#8217;re on Native American land at the time.)<\/p>\n\n\n\n<!--more-->\n\n\n\n<p>In this David vs. Goliath scenario, <strong>Magic City Casino<\/strong> and <strong>Bonita Springs Poker Room<\/strong> won, and Haaland, DeSantis and the Seminoles lost. Big time. As in $2.5 billion big. It&#8217;s not just sports betting. <a href=\"https:\/\/sportshandle.com\/florida-sports-betting-halted\/\">Out go craps and roulette<\/a>. Even DeSantis had to admit that reservations-in-the-ether was &#8220;an unsettled legal issue. We anticipated that this could happen,&#8221; he added, indicating that he might now go the constitutional route and put it before the voters. Seminole spokesman <strong>Gary Bitner<\/strong> said the tribe was &#8220;carefully reviewing&#8221; the verdict and generally keeping its powder dry. (Their motion to dismiss got kiboshed by the court.) The <strong>Interior Department<\/strong>, which had weakly argued that <strong>Florida<\/strong> was taking a \u201cpermissible hybrid approach,&#8221; is expected to appeal. However, <a href=\"https:\/\/www.casino.org\/news\/federal-judge-stops-florida-sports-betting-invalidates-seminole-compact\/\">it already shot itself in the foot<\/a> by failing to sever the sports betting clauses\u2014which were the bone of contention\u2014from the compact as a whole. Whoops.<\/p>\n\n\n\n<p>If DeSantis goes to the electorate\u2014and we hope he does\u2014he&#8217;s starting at a disadvantage. Already three other petition drives <em>in re<\/em> sports betting are (<a href=\"https:\/\/www.politico.com\/newsletters\/florida-playbook\/2021\/11\/23\/tapped-out-judge-spikes-desantis-gambling-plan-495197\" class=\"broken_link\">slowly<\/a>) collecting signatures, one of the three being backed lavishly by <strong>DraftKings<\/strong> and <strong>FanDuel<\/strong>. What are the chances of the Seminoles regaining exclusive OSB rights in Florida? Not too damn good, frankly.<\/p>\n\n\n\n<p class=\"has-drop-cap\">Sports betting in <strong>New York State<\/strong> hasn&#8217;t even gone online yet and already it&#8217;s not enough for state Sen. <strong>Joseph P. Addabbo Jr<\/strong>. He&#8217;s filed a bill to add horse tracks to OSB-eligible venues. Also, OSB providers would be permitted to partner with &#8220;select affiliates&#8221; to offer on-site betting. In other words, <a href=\"https:\/\/elitesportsny.com\/2021\/11\/22\/new-bill-would-allow-online-bets-for-horse-racing-sports-betting-kiosks-at-new-york-stadiums\/\">get ready for sports-betting kiosks<\/a> at <strong>Yankee Stadium<\/strong>. If Addabbo succeeds, the Empire State will go from being one of the most uptight jurisdictions for sports wagering to one of the most wide-open. Racetracks, sports arenas, OTBs and more &#8230; it&#8217;s a veritable tsunami of sports betting. And you wouldn&#8217;t have to open an account if you use the kiosks, under the Addabbo bill. \u201cThese changes are expect to result in billions of dollars of tax revenue for the State of New York,\u201d it reads. Well, that&#8217;s a mite optimistic but we don&#8217;t fault him for trying.<\/p>\n\n\n\n<p class=\"has-drop-cap\">The siren song of OSB has also been heard by the <strong>Wampanoag Tribe of Gay Head<\/strong> on <strong>Martha&#8217;s Vineyard<\/strong>. Remember them? When last we saw them they were trying to build a Class II casino. That&#8217;s on the back burner for now, as they petition Gov. <strong>Charlie Baker<\/strong> (R) for Class III gaming plus OSB. Mind you, there&#8217;s no sports betting anywhere in <strong>Massachusetts<\/strong> at present so we&#8217;re skeptical that &#8220;Cautious Charlie,&#8221; as he&#8217;s known, would go out on a limb for the Wampanoag. Still, it would be only fair to give the Gay Head tribe something, since former Gov. <strong>Deval Patrick<\/strong> (D) froze them out of Class III status nine years ago.<\/p>\n\n\n\n<div class=\"wp-block-image\"><figure class=\"aligncenter size-large\"><img loading=\"lazy\" width=\"600\" height=\"400\" src=\"https:\/\/www.lasvegasadvisor.com\/stiffs-and-georges\/wp-content\/uploads\/2016\/04\/Taunton-casino.jpg\" alt=\"\" class=\"wp-image-18042\" srcset=\"https:\/\/www.lasvegasadvisor.com\/stiffs-and-georges\/wp-content\/uploads\/2016\/04\/Taunton-casino.jpg 600w, https:\/\/www.lasvegasadvisor.com\/stiffs-and-georges\/wp-content\/uploads\/2016\/04\/Taunton-casino-150x100.jpg 150w, https:\/\/www.lasvegasadvisor.com\/stiffs-and-georges\/wp-content\/uploads\/2016\/04\/Taunton-casino-300x200.jpg 300w\" sizes=\"(max-width: 600px) 100vw, 600px\" \/><\/figure><\/div>\n\n\n\n<p>Indeed, the Gay Head Wampanoag can make a darn good case that they&#8217;re the only eligible tribe standing, the Trump administration having disestablished the <strong>Mashpee Wampanoag<\/strong> in the wake of a corruption scandal involving former chairman <strong>Cedric Cromwel<\/strong>l. There went the long-planned <strong>First Light Casino<\/strong> (<em>pictured<\/em>) in a puff of bribery. On the other hand, the Gay Head band has stubbornly refused to apply for a building permit for its bingo hall, despite a federal court order, so will it be more tractable with its neighbors if it&#8217;s approved for a full-fledged casino? We wish them luck but this looks like a tricky bank shot.<\/p>\n\n\n\n<p><strong><em>Jottings<\/em><\/strong>: <strong>Covid-19<\/strong> cases are up in <strong>Michigan<\/strong> and <a href=\"https:\/\/www.crainsdetroit.com\/coronavirus\/mgm-grand-detroit-motorcity-casino-hotel-greektown-casino-hotel-require-masks\">masks are back in casinos<\/a>, starting today. <strong>MGM Grand Detroit<\/strong> will have the strictest policy, <strong>Greektown Hotel-Casino<\/strong> the loosest &#8230; With <strong>Crown Resorts<\/strong> on the ropes, <strong>Blackstone Group<\/strong> <a href=\"https:\/\/www.reuters.com\/business\/australias-crown-resorts-gets-62-bln-offer-blackstone-2021-11-18\/\">is going for the kill<\/a>, making a $6.2 billion offer for the troubled firm. A Blackstone purchase would undoubtedly play well with Australian regulators, bringing the promise of a new broom. Crown shares hopped 17% on the offer &#8230; <strong>Chicago<\/strong> casino proposals are <a href=\"https:\/\/chicago.suntimes.com\/2021\/11\/19\/22791407\/chicago-casino-proposals-details\">already drawing some criticism<\/a>. For instance, <strong>Rivers 78<\/strong> could impinge on Gov. <strong>J.B. Pritzker<\/strong>&#8216;s desire to use part of the site for an academic tech center. And <strong>Hard Rock Chicago<\/strong> is predicated upon a publicly subsidized transit center that Mayor <strong>Lori Lightfoot<\/strong> (D) is disinclined to build &#8230; <strong>Nevada<\/strong> regulators <a href=\"https:\/\/www.nevadacurrent.com\/2021\/11\/19\/casino-rule-change-would-allow-cashless-gambling-minus-in-person-id-check\/\" class=\"broken_link\">are being pressured<\/a> to allow ID-free, cashless play at Silver State casinos. <strong>Station Casinos<\/strong> argued against the change, calling it \u201can invitation to approve a regulation change that would contravene federal law.\u201d <\/p>\n","protected":false},"excerpt":{"rendered":"<p>Floridians, we hope you enjoyed sports betting for all of the three weeks in which it was legal in the Sunshine State.
