Judge <strong>Dabney Friedrich<\/strong> (<em>pictured<\/em>) ruled that the Seminoles couldn&#8217;t have OSB. But they kept taking bets. Then Judge Friedrich nixed their request for a stay. And they kept taking wagers. Now a three-judge panel of the <strong>D.C. Circuit Court of Appeals<\/strong> said no, <a href=\"https:\/\/www.casino.org\/news\/lawyer-calls-out-seminole-tribe-on-taking-sports-bets-in-florida-despite-judges-order\/\">you have to shut it down<\/a>. And, as far as we know, the Seminoles are still accepting bets. The only commitment Seminole mealy-mouthpiece <strong>Gary Bitner<\/strong> would make is \u201cThe Seminole Tribe is aware of today\u2019s Appeals Court decision and is carefully considering the steps it will take as a result,\u201d which probably include continued defiance. Which raises the question, if the Seminoles won&#8217;t abide by the <strong>Indian Gaming Regulatory Act<\/strong> (at least when it&#8217;s not to their convenience) why in the bloody blue blazes should anyone else?<\/p>\n\n\n\n<!--more-->\n\n\n\n<p>Pundits at the <strong>SBC Summit North America<\/strong>, taking place at the <strong>Meadowlands<\/strong> (a hub of sports betting) do not seem to have been amused by the Seminoles&#8217; antics. Attorney <strong>Daniel Wallach<\/strong> asked, \u201cWhy would you place your license on the line when a federal judge has unambiguously concluded that these activities are in violation of federal law?\u201d Indeed, the Seminoles admitted that some vendors were backing away from their renegade sports book, causing \u201can immediate chilling effect.&#8221; As indeed there should be.<\/p>\n\n\n\n<figure class=\"wp-block-image size-large is-style-rounded\"><img loading=\"lazy\" width=\"1024\" height=\"683\" src=\"https:\/\/www.lasvegasadvisor.com\/stiffs-and-georges\/wp-content\/uploads\/2021\/11\/Miller-1024x683.jpg\" alt=\"\" class=\"wp-image-30318\" srcset=\"https:\/\/www.lasvegasadvisor.com\/stiffs-and-georges\/wp-content\/uploads\/2021\/11\/Miller-1024x683.jpg 1024w, https:\/\/www.lasvegasadvisor.com\/stiffs-and-georges\/wp-content\/uploads\/2021\/11\/Miller-300x200.jpg 300w, https:\/\/www.lasvegasadvisor.com\/stiffs-and-georges\/wp-content\/uploads\/2021\/11\/Miller-150x100.jpg 150w, https:\/\/www.lasvegasadvisor.com\/stiffs-and-georges\/wp-content\/uploads\/2021\/11\/Miller-768x512.jpg 768w, https:\/\/www.lasvegasadvisor.com\/stiffs-and-georges\/wp-content\/uploads\/2021\/11\/Miller-1536x1024.jpg 1536w, https:\/\/www.lasvegasadvisor.com\/stiffs-and-georges\/wp-content\/uploads\/2021\/11\/Miller-2048x1365.jpg 2048w\" sizes=\"(max-width: 1024px) 100vw, 1024px\" \/><\/figure>\n\n\n\n<p class=\"has-drop-cap\">Whilst on the topic of sports betting, the SBC Summit got into the topic of sports-betting advertisements, a real hot-button issue. Compared to the heyday of daily fantasy sports, what you see during an average NFL game isn&#8217;t that hard to stomach. But the overall extent of wagering ads is causing concern for some in the gaming industry. <strong>American Gaming Association<\/strong> President <strong>Bill Miller<\/strong> (<em>pictured<\/em>) went so far as to call the current marketing wars \u201can unsustainable arms race.\u201d And, to paraphrase <strong>LBJ<\/strong>, when you&#8217;ve lost Miller, you&#8217;ve lost Middle America. \u201cIs it annoying?\u201d he asked. \u201cIs it too much? It is an unsustainable thing.&#8221; Big Gaming certainly wants to avoid regulatory intervention, this much is clear, lest something like the <strong>United Kingdom<\/strong>&#8216;s &#8220;whistle-to-whistle&#8221; ban on advertising be imposed <a href=\"https:\/\/www.usnews.com\/news\/business\/articles\/2021-12-02\/sports-betting-ads-industry-weighs-how-much-is-too-much\" class=\"broken_link\">or worse<\/a>.<\/p>\n\n\n\n<p>When someone as long-versed in sports betting as <strong>International Game Technology<\/strong>&#8216;s <strong>Joe Asher<\/strong> feels there is \u201ca backlash on the advertising going on today, and the excessive amount of it going on,&#8221; you <em>know<\/em> the industry is starting to feel fatigued. &#8220;It&#8217;s not something that lends itself to self-regulation,&#8221; he added. &#8220;I do worry about when we get to that [intervention] phase.\u201d Even a company as high profile as <strong>Caesars Entertainment<\/strong> conceded, &#8220;It&#8217;s not about shouting at people: \u2018Free money! Free money! Free money!\u2019 That&#8217;s what wears people down.\u201d <strong>DraftKings<\/strong>&#8216; <strong>Johnny Avello<\/strong> was predictably unrepentant, however: \u201cI was at the terminal in <strong>Hoboken<\/strong> yesterday and I saw DraftKings on every kiosk and every wall. And I think it&#8217;s effective. It works.\u201d (For all the money DraftKings spends on marketing, why do its TV spots have such poor production values?) At least Avello took a stand. <strong>FanDuel<\/strong> and <strong>BetMGM<\/strong> were apparently invited to make their views known but chose to hide under the blankets.<\/p>\n\n\n\n<p class=\"has-drop-cap\">Now that gambling is as American as apple pie, Mom and Old Glory, why not have casinos anchoring shopping malls in place of where, say, <strong>Macy&#8217;s<\/strong> used to be? Some are making the case that this is &#8220;perfect,&#8221; citing the success of <strong>Pittsburgh Live<\/strong> at <strong>Westmoreland Mall<\/strong> in <strong>Pennsylvania<\/strong>. \u201cWe\u2019re an anchor tenant. We\u2019re like <strong>Nordstrom<\/strong>. We\u2019re like Macy\u2019s. We\u2019re like <strong>JCPenney<\/strong>. We bring people to the campus,\u201d said General Manager <strong>Sean Sullivan<\/strong> and we&#8217;re hard put to disagree with him. Indeed, such decentralized, convenience-oriented gambling <a href=\"https:\/\/pittsburgh.cbslocal.com\/2021\/12\/03\/as-shopping-malls-lose-their-anchor-tenants-casinos-may-prove-to-be-a-perfect-substitute\/\">may be the future of the industry<\/a> as opposed to the multi-billion-dollar megaresort. <\/p>\n\n\n\n<p>\u201cThat has really been a catalyst for new leasing activities and increased traffic at the mall,\u201d said <strong>CBL Properties<\/strong> spokeswoman <strong>Stacey Keating<\/strong> regarding Pittsburgh Live. \u201cIt\u2019s been such a wonderful addition for us and it\u2019s spurred considerable new leasing. We have seen traffic increases of double digits since the casino opened.\u201d That ought to allay the fears of those who argue that casinos will leech business from their surroundings. (Limiting amenities would help.) CBL loves the idea so much it&#8217;s hosting <strong>Hollywood York<\/strong>, too, another pocket casino. The Keystone State has allotted three of its five satellite casinos already but this seems like an idea that could gain traction elsewhere.<\/p>\n\n\n\n<div class=\"wp-block-image\"><figure class=\"aligncenter size-large\"><img loading=\"lazy\" width=\"178\" height=\"249\" src=\"https:\/\/www.lasvegasadvisor.com\/stiffs-and-georges\/wp-content\/uploads\/2010\/02\/halkyard.jpg\" alt=\"\" class=\"wp-image-2291\" srcset=\"https:\/\/www.lasvegasadvisor.com\/stiffs-and-georges\/wp-content\/uploads\/2010\/02\/halkyard.jpg 178w, https:\/\/www.lasvegasadvisor.com\/stiffs-and-georges\/wp-content\/uploads\/2010\/02\/halkyard-107x150.jpg 107w\" sizes=\"(max-width: 178px) 100vw, 178px\" \/><\/figure><\/div>\n\n\n\n<p class=\"has-drop-cap\">Back when <strong>J. Terrence Lanni<\/strong> was steering the course for then-<strong>MGM Mirage<\/strong>, a map of the <strong>Las Vegas Strip<\/strong> showed sub-<strong>MGM Grand<\/strong> land earmarked for &#8220;Project Z,&#8221; an ambition that never took shape. Now, even though <strong>MGM Resorts International<\/strong> CEO <strong>Bill Hornbuckle<\/strong> says &#8220;We have enough <strong>Las Vegas<\/strong>,&#8221; CFO <strong>Jonathan Halkyard<\/strong> (<em>pictured<\/em>) effectively responds, &#8220;<a href=\"https:\/\/www.cdcgamingreports.com\/mgm-exec-hints-at-potential-of-south-strip-casino-resort-development\/\">No, we don&#8217;t<\/a>.&#8221; In an address to <strong>Morgan Stanley<\/strong>\u2019s <strong>Virtual Global Consumer &amp; Retail Conference<\/strong> he mooted the possibility of yet another south-Strip megaresort, saying that&#8217;s where the critical mass is. &#8220;That\u2019s our neighborhood down toward <strong>New York-New York<\/strong>, <strong>Excalibur<\/strong>, <strong>Mandalay Bay<\/strong> and <strong>Luxor<\/strong>, MGM Grand, and <strong>Park MGM<\/strong>. The reality is\u2014and not many people appreciate this\u2014that there\u2019s a substantial opportunity for our company to do additional development in that area,&#8221; the CFO explained.<\/p>\n\n\n\n<p>He added, &#8220;There\u2019s seven acres in front of the Excalibur. That\u2019s equal to the entire footprint of <strong>The Cosmopolitan<\/strong>. I\u2019m not suggesting we\u2019re going to build a 3,000-room tower there, but that\u2019s a significant development opportunity potentially.\u201d (Anything that obscures Excalibur is fine by us.) Or pedestrian access to the Green Monster could be improved. Or maybe both. Or maybe not. Halkyard said the Cosmo buy was &#8220;the most allocation of capital we\u2019ll be making in this market.\u201d As for <strong>Omicron<\/strong> (which the <em>National Review<\/em>&#8216;s <strong>Jim Geraghty<\/strong> likens to the name of a <em>Transformers<\/em> villain), Halkyard was at pains to ease fears. &#8220;It\u2019s not reflected in the current business we\u2019re seeing or in our bookings right now,\u201d he said.<\/p>\n\n\n\n<div class=\"wp-block-image\"><figure class=\"aligncenter size-large\"><img loading=\"lazy\" width=\"299\" height=\"200\" src=\"https:\/\/www.lasvegasadvisor.com\/stiffs-and-georges\/wp-content\/uploads\/2010\/03\/excalibur-pic2.jpg\" alt=\"\" class=\"wp-image-2701\" srcset=\"https:\/\/www.lasvegasadvisor.com\/stiffs-and-georges\/wp-content\/uploads\/2010\/03\/excalibur-pic2.jpg 299w, https:\/\/www.lasvegasadvisor.com\/stiffs-and-georges\/wp-content\/uploads\/2010\/03\/excalibur-pic2-150x100.jpg 150w\" sizes=\"(max-width: 299px) 100vw, 299px\" \/><\/figure><\/div>\n\n\n\n<p>Regarding the sustainability of the present gambling boom, \u201cWe\u2019re seeing an elevated level of spend from both rated and unrated players. Much of this is due to our marketing communications and the strength of our brand,&#8221; even if Baby Boomers are still slow to return. \u201cI think a counteracting mechanism over the next several months will be the continued return of that demographic, which would more than offset any normalization and spend levels we\u2019re getting from some of those rated and unrated guests,\u201d Halkyard said, adding that he had more confidence in the return of convention business to Las Vegas than he had in the future of <strong>Macao<\/strong>. Wow. He also had the nerve to complain about being 4,000 souls short-staffed and never mind that Big Gaming is doing this on purpose, to inflate margins. If you&#8217;re running plus-2019 levels of business (by a wide measure) with 30% fewer employees, what makes you think you can offer your guests a quality experience? We&#8217;ll wait for an answer &#8230; but don&#8217;t expect to get one.<\/p>\n\n\n\n<p class=\"has-drop-cap\">Enjoy the <strong>Tropicana Las Vegas<\/strong> while yet you can: The <strong>Oakland A&#8217;s<\/strong> <a href=\"https:\/\/www.cdcgamingreports.com\/las-vegas-as-reportedly-eyeing-tropicana-site-for-possible-strip-ballpark\/\">reportedly covet<\/a> its 30-plus acres for a stadium site. It would be strategic as all get-out, we&#8217;ll say that. Also, <strong>Scientific Games<\/strong> is <a href=\"https:\/\/www.cdcgamingreports.com\/scientific-games-has-growth-potential-according-to-analyst\/\">over the moo<\/a>n about recent business trends. Having shed sports betting and lotteries, it&#8217;s putting its eggs in the i-gaming basket.<\/p>\n\n\n\n<p><strong>Quote of the Day<\/strong>: &#8220;Life is wide, limitless.
