No sooner had we prophetically called him a regulatory &#8220;doofus&#8221; than <a href=\"https:\/\/thenevadaindependent.com\/article\/gaming-regulator-draws-criticism-after-second-guessing-mgm-business-decisions\">news surfaced <\/a>of some most-unbecoming conduct during an NGCB hearing. Specifically, he whined at length about how his <strong>MGM Resorts International<\/strong> stock had supposedly suffered under the regimes of <strong>Jim Murren<\/strong> and <strong>Bill Hornbuckle<\/strong>. \u201c[<strong>Terrence<\/strong>] <strong>Lanni<\/strong> had it up from $7 all the way to $96.40 and then Mr. Murren comes in, the stock price drops into the low teens,\u201d Assad whinged. Why the financial performance of a company&#8217;s stock became the NGCB&#8217;s ostensible purview is anybody&#8217;s guess. <strong>Steve Wynn<\/strong>, many years back, opined that regulators should look harder at the financial probity of transactions and companies they approve\u2014and we agree. It would have spared us fiascos like the <strong>Caesars Entertainment<\/strong> LBO and the <strong>Station Casinos<\/strong> bankruptcy, among many others.<\/p>\n\n\n\n<!--more-->\n\n\n\n<p>But, as former gaming attorney and current UNLV Distinguished Fellow <strong>Anthony Cabot<\/strong> so sagely observed, \u201cRegulators shouldn\u2019t be second-guessing the business decisions of a company under their control unless it impacts their ability to effectively go forward by going broke.\u201d Amen, Brother Cabot! Not content to rail against MGM&#8217;s stock performance, Assad also wasted time musing on the underperformance of <strong>MGM Springfield<\/strong>. \u201cThe operation [isn\u2019t] doing so well,\u201d asserted Assad, although (as <strong>Howard Stutz<\/strong> quickly noted), it&#8217;s coming off its best year to date. And what&#8217;s MGM Springfield got to do with the price of tea in <strong>Nevada<\/strong>?<\/p>\n\n\n\n<div class=\"wp-block-image\"><figure class=\"aligncenter size-large\"><img loading=\"lazy\" width=\"277\" height=\"182\" src=\"https:\/\/www.lasvegasadvisor.com\/stiffs-and-georges\/wp-content\/uploads\/2018\/07\/MGM-Resorts-1.jpg\" alt=\"\" class=\"wp-image-22176\" srcset=\"https:\/\/www.lasvegasadvisor.com\/stiffs-and-georges\/wp-content\/uploads\/2018\/07\/MGM-Resorts-1.jpg 277w, https:\/\/www.lasvegasadvisor.com\/stiffs-and-georges\/wp-content\/uploads\/2018\/07\/MGM-Resorts-1-150x99.jpg 150w\" sizes=\"(max-width: 277px) 100vw, 277px\" \/><\/figure><\/div>\n\n\n\n<p>Of course, a stopped watch is correct twice a day and Assad made a good point about MGM seeking its 13th deferral of launching i-gaming in the Silver State. Nobody would say it, but there&#8217;s no money to be made by initiating i-poker (the only permitted game) in Nevadan cyberspace. Still, we have to agree with Assad&#8217;s \u201cDecisions like this give me pause in terms of why can&#8217;t upper management or Mr. Hornbuckle just make a decision after 11 years to either move forward with interactive gaming or not.\u201d Of course, this turned out to be typical NGCB hot air. The board voted unanimously (yes, including Assad) to grant the waiver. Had the not, it might have sent a message about the importance of fishing or cutting bait. But that would be asking the NGCB to behave like a serious regulatory body, which is an awfully big ask.<\/p>\n\n\n\n<p class=\"has-drop-cap\">Somehow the idea got into Gov. <strong>Joe Lombardo<\/strong>&#8216;s noggin that gaming in Nevada is over-regulated. (Which would be hilarious were it not so tragically untrue.) So he&#8217;s tasked NGCB Chairman <strong>Kirk Hendrick<\/strong> with weeding away <a href=\"https:\/\/thenevadaindependent.com\/article\/at-lombardos-request-control-board-finds-dozens-of-outdated-gaming-rules-to-eliminate\">&#8220;outdated&#8221; regulations<\/a>. It&#8217;s frankly somewhat alarming to read that the Control Board has targeted <strong>Regulation 14<\/strong>, which governs the licensing and technical standards of gaming machines. True, some of the changes are either needed or the regulatory language is anachronistic. But Lombardo wants brain surgery performed by May 1 and one has to agree with former NGCB chairwoman <strong>Becky Harris<\/strong> that a scalpel is needed in place of Lombardo&#8217;s meat cleaver. As she said, \u201cYou really have to do it with a 360-degree view and understand how removing certain sections, especially if they are significant sections, will impact the rest of the regulations.\u201d\u00a0It&#8217;s hard to do that when you have a gubernatorial <em>fatwa<\/em> hanging over your head.<\/p>\n\n\n\n<div class=\"wp-block-image is-style-rounded\"><figure class=\"aligncenter size-large is-resized\"><img loading=\"lazy\" src=\"https:\/\/www.lasvegasadvisor.com\/stiffs-and-georges\/wp-content\/uploads\/2019\/05\/MGM-Springfield.jpg\" alt=\"\" class=\"wp-image-24222\" width=\"640\" height=\"480\" srcset=\"https:\/\/www.lasvegasadvisor.com\/stiffs-and-georges\/wp-content\/uploads\/2019\/05\/MGM-Springfield.jpg 640w, https:\/\/www.lasvegasadvisor.com\/stiffs-and-georges\/wp-content\/uploads\/2019\/05\/MGM-Springfield-150x113.jpg 150w, https:\/\/www.lasvegasadvisor.com\/stiffs-and-georges\/wp-content\/uploads\/2019\/05\/MGM-Springfield-300x225.jpg 300w\" sizes=\"(max-width: 640px) 100vw, 640px\" \/><\/figure><\/div>\n\n\n\n<p class=\"has-drop-cap\">Before we leave MGM Springfield, be it known that the casino has yet again taken illegal sports bets\u2014as has <strong>Encore Boston Harbor<\/strong>. C&#8217;mon, this isn&#8217;t rocket science. How on earth could you <strong>A)<\/strong> list <strong>Harvard University<\/strong> as an &#8220;out-of-state institution,&#8221; <a href=\"https:\/\/www.masslive.com\/politics\/2023\/04\/regulators-to-weigh-penalties-for-illegal-sports-wagers-at-mgm-springfield-encore.html\" class=\"broken_link\">a hilarious mistake<\/a> and B) not recognize such a naked-eye factual error? We pause, not too long, in hopes of answer. Meanwhile, <strong>BetMGM<\/strong> is belatedly on the case. Encore took unlawful wagers on <strong>Boston College<\/strong> women&#8217;s hoops, for which no excuse seems possible. It&#8217;s time the <strong>Massachusetts Gaming Commission<\/strong> slapped some heavy fines on scofflaw casinos to get them thinking hard about &#8220;the cost of doing business&#8221; in the Bay State.<\/p>\n\n\n\n<p>Regulators are <a href=\"https:\/\/cdcgaming.com\/brief\/massachusetts-regulators-weigh-allowing-sports-betting-kiosks-at-bars-and-restaurants\/\">getting ahead of themselves<\/a>, however, by weighing putting sports betting kiosks into bars and restaurants, a real saturation of the market. While not necessarily a bad idea, it&#8217;s much too soon, given the MGC&#8217;s difficulty in policing the books that are already operating\u2014and running amuck. Fortunately, the process is only at the feasibility-study stage and requires approval by the Lege. The latter may be wary of granting it, given recent history. \u201cSports betting kiosks can deliver expanded and more convenient access,&#8221; supplicated the MGC. \u201cSports betting Kiosks [<em>sic<\/em>] can accept cash, winning tickets, and vouchers, and grant full access to all sports propositions and pari-mutuel horse racing.\u201d Yes, but can commissioners get a handle on all that\u2014pun unintended?<\/p>\n\n\n\n<div class=\"wp-block-image\"><figure class=\"aligncenter size-large\"><img loading=\"lazy\" width=\"383\" height=\"382\" src=\"https:\/\/www.lasvegasadvisor.com\/stiffs-and-georges\/wp-content\/uploads\/2013\/09\/Seal_of_New_York.svg_.png\" alt=\"\" class=\"wp-image-11543\" srcset=\"https:\/\/www.lasvegasadvisor.com\/stiffs-and-georges\/wp-content\/uploads\/2013\/09\/Seal_of_New_York.svg_.png 383w, https:\/\/www.lasvegasadvisor.com\/stiffs-and-georges\/wp-content\/uploads\/2013\/09\/Seal_of_New_York.svg_-150x149.png 150w, https:\/\/www.lasvegasadvisor.com\/stiffs-and-georges\/wp-content\/uploads\/2013\/09\/Seal_of_New_York.svg_-300x299.png 300w\" sizes=\"(max-width: 383px) 100vw, 383px\" \/><\/figure><\/div>\n\n\n\n<p class=\"has-drop-cap\">Further down the coast, in <strong>New York State<\/strong>, online sports betting engendered $163 million in revenue last month, on handle of $1.8 billion. Lord knows how much was flung back into the market in the form of promos, as the Empire State doesn&#8217;t disclose that. The revenue leader was\u2014surprise!\u2014<strong>FanDuel<\/strong> with $80 million. <strong>DraftKings<\/strong> booked a very respectable $52 million, followed by <strong>Caesars Sportsbook<\/strong> with $15 million. Also showing up on the radar were BetMGM ($10 million), <strong>PointsBet<\/strong> ($2 million) and <strong>BetRivers<\/strong> ($4 million). <strong>WynnBet<\/strong>, <strong>BallyBet<\/strong> and <strong>Resorts World<\/strong> all flew well below the radar.<\/p>\n\n\n\n<p class=\"has-drop-cap\">Sports betting isn&#8217;t getting anywhere in <strong>Missouri<\/strong>, so the industry may have to be satisfied with its <a href=\"https:\/\/ggbnews.com\/article\/kentucky-sports-betting-approved-takes-effect-june-28\/\">recent triumph<\/a> in <strong>Kentucky<\/strong>. Enabling legislation escaped from the state House, <a href=\"https:\/\/missouriindependent.com\/2023\/04\/10\/sports-wagering-bill-remains-mired-in-missouri-senate-split-over-gambling-expansion\/?eType=EmailBlastContent&amp;eId=71ded3a8-49dc-41e6-b0f9-2510ecbdc4e5\" class=\"broken_link\">only to stall<\/a> in the state Senate. As usual, it is being hamstrung by those solons who want to legitimize black-market slot routes. The main stumbling block continues to be state Sen. <strong>Denny Hoskins<\/strong> (R), who is as addicted to slot money as a baby is to its pacifier. The House bill would permit sports betting only to established casinos and to professional sports teams, among other provisions (which don&#8217;t include VLTs). The House wants a 10% tax on OSB, the Senate 15%. As for the other issues beclouding the debate, state Sen. <strong>John Rizzo<\/strong> (D), a VLT advocate laments that &#8220;It makes no sense.\u201d But in a state so benighted it will <a href=\"https:\/\/missouriindependent.com\/2023\/04\/10\/missouris-new-effort-to-punish-libraries-is-vindictive-and-harmful\/?eType=EmailBlastContent&amp;eId=71ded3a8-49dc-41e6-b0f9-2510ecbdc4e5\" class=\"broken_link\">probably defund public libraries<\/a>, it makes perfect sense.<\/p>\n\n\n\n<figure class=\"wp-block-image size-large is-style-rounded\"><img loading=\"lazy\" width=\"670\" height=\"503\" src=\"https:\/\/www.lasvegasadvisor.com\/stiffs-and-georges\/wp-content\/uploads\/2014\/08\/macau_wynn.jpg\" alt=\"\" class=\"wp-image-14268\" srcset=\"https:\/\/www.lasvegasadvisor.com\/stiffs-and-georges\/wp-content\/uploads\/2014\/08\/macau_wynn.jpg 670w, https:\/\/www.lasvegasadvisor.com\/stiffs-and-georges\/wp-content\/uploads\/2014\/08\/macau_wynn-150x112.jpg 150w, https:\/\/www.lasvegasadvisor.com\/stiffs-and-georges\/wp-content\/uploads\/2014\/08\/macau_wynn-300x225.jpg 300w\" sizes=\"(max-width: 670px) 100vw, 670px\" \/><\/figure>\n\n\n\n<p><strong><em>Jottings<\/em><\/strong>: <strong>Wynn Resorts<\/strong> stock <a href=\"https:\/\/cdcgaming.com\/macau-lifts-wynn-resorts\/\">got a boost<\/a> from <strong>J.P. Morgan<\/strong> analyst <strong>Joseph Greff<\/strong> yesterday. The longtime <strong>Macao<\/strong> skeptic turned enthusiast upped Wynn&#8217;s price target $10\/share almost solely on the strength of its Macanese performance and not at all to do with <strong>Las Vegas<\/strong> &#8230; <strong>Caesars Entertainmen<\/strong>t may be on the way out in <strong>Windsor<\/strong>. The <strong>Ontario Lottery &amp; Gaming Corp<\/strong>. is <a href=\"https:\/\/cdcgaming.com\/olg-begins-the-process-of-finding-future-operator-of-windsor-casino\/\">entertaining tenders<\/a> for the concession, which expires in 2025. Caesars may well re-bid, or it could exit and aim for a more direct hit on the <strong>Detroit<\/strong> market, possibly by purchasing <strong>MotorCity<\/strong>. No casino company can own two properties in the Motown area &#8230; <strong>Bally&#8217;s Corp<\/strong>. is keeping mum about <a href=\"https:\/\/www.playillinois.com\/new-chicago-mayor-could-bring-vgts-to-the-city\/\" class=\"broken_link\">the prospect of slot routes<\/a> in <strong>Chicago<\/strong>. Mayor-elect <strong>Brandon Johnson<\/strong> (D) favors them but they could scupper Bally&#8217;s bottom line &#8230; All&#8217;s not well at the <strong>Downtown Grand<\/strong> (<em>below<\/em>). It&#8217;s being sued by the <strong>Equal Opportunity Employment Commission<\/strong> for allegedly having \u201cfailed to provide reasonable accommodations for employees with disabilities including\u2014but not limited to \u2014 levoscoliosis, sciatica and cancer.\u201d It&#8217;s furthermore accused of <a href=\"https:\/\/cdcgaming.com\/brief\/las-vegas-federal-agency-sues-downtown-grand-for-employment-discrimination\/\">retaliating against workers<\/a> who complained &#8230; <\/p>\n\n\n\n<div class=\"wp-block-image\"><figure class=\"aligncenter size-large\"><img loading=\"lazy\" width=\"300\" height=\"200\" src=\"https:\/\/www.lasvegasadvisor.com\/stiffs-and-georges\/wp-content\/uploads\/2014\/08\/grand-pic.jpg\" alt=\"\" class=\"wp-image-14254\" srcset=\"https:\/\/www.lasvegasadvisor.com\/stiffs-and-georges\/wp-content\/uploads\/2014\/08\/grand-pic.jpg 300w, https:\/\/www.lasvegasadvisor.com\/stiffs-and-georges\/wp-content\/uploads\/2014\/08\/grand-pic-150x100.jpg 150w\" sizes=\"(max-width: 300px) 100vw, 300px\" \/><\/figure><\/div>\n\n\n\n<p>Good news, we hope, for the long-in-abeyance <strong>Cal-Neva Resort<\/strong>. Bravo, Cordish &#8230; Guess what? Casino legalization in <strong>Japan<\/strong> has been delayed yet again. Say not so!
