Dealers at <strong>Wynn Las Vegas<\/strong> <a href=\"http:\/\/www.vegasinc.com\/news\/2011\/nov\/10\/judge-overturns-ruling-favoring-wynn-tip-pooling-p\/\" target=\"_blank\" class=\"broken_link\">won a rare victory<\/a> when <strong>Clark County<\/strong> District Judge <strong>Kenneth Cory<\/strong> (<em>pictured<\/em>) spiked Labor Commissioner <strong>Michael Tanchek<\/strong>&#8216;s longstanding position <em>vis-a-vis<\/em> the tip-confiscation policy at the Strip resort. Asking for a <em>third<\/em> Tanchek opinion on the matter is a waste of time: Why expect him to renounce his informal 2006 ruling and his 2010 formal ratification of same. (Tanchek&#8217;s rationale, as articulated to aggrieved dealers: <strong>Steve Wynn<\/strong> didn&#8217;t keep the money, <em>ergo<\/em> he didn&#8217;t &#8220;take&#8221; it.) Best to just fast-forward this issue to the <strong>Nevada Supreme Court<\/strong> &#8212; as Wynn&#8217;s lawyers are undoubtedly doing right this minute &#8212; and obtain a definitive adjudication of the longstanding dispute, now entering its sixth blockbuster year. Behind all the legal citations, the case hinges on semantics. Did or did not <strong>Wynn Resorts<\/strong> obtain a &#8220;direct&#8221; benefit by redistributing tip income to cut pit bosses and boxmen in on the action. By doing so, <!--more-->the company (which was losing money at the time), did not have to pay aggrieved pit bosses more than a $5K raise &#8212; which eventually redounded the benefit of the bottom line.<\/p>\n<p><img loading=\"lazy\" class=\"alignleft size-thumbnail wp-image-7901\" title=\"king_solomon\" src=\"https:\/\/www.lasvegasadvisor.com\/stiffs-and-georges\/wp-content\/uploads\/2011\/11\/king_solomon-150x114.gif\" alt=\"\" width=\"150\" height=\"114\" srcset=\"https:\/\/www.lasvegasadvisor.com\/stiffs-and-georges\/wp-content\/uploads\/2011\/11\/king_solomon-150x114.gif 150w, https:\/\/www.lasvegasadvisor.com\/stiffs-and-georges\/wp-content\/uploads\/2011\/11\/king_solomon-300x229.gif 300w, https:\/\/www.lasvegasadvisor.com\/stiffs-and-georges\/wp-content\/uploads\/2011\/11\/king_solomon.gif 400w\" sizes=\"(max-width: 150px) 100vw, 150px\" \/>Whether or not that is &#8220;direct&#8221; is a question requiring Solomonic wisdom. At the heart of the issue is a Nevada law, <strong>NRS 608.160<\/strong>. Its co-author, ex-state Sen. <strong>Donald Mello<\/strong> has quite clearly and forcefully maintained to this writer that what Wynn did directly contravenes the intent of the law. Tanchek&#8217;s office, in return, told me &#8212; in essence &#8212; that Mello&#8217;s views didn&#8217;t amount to a sack of beans and there were no plans to call him as a witness in the 2010 hearings.<\/p>\n<p><img loading=\"lazy\" class=\"alignright size-thumbnail wp-image-7903\" title=\"roulette 2\" src=\"https:\/\/www.lasvegasadvisor.com\/stiffs-and-georges\/wp-content\/uploads\/2011\/11\/roulette-2-150x105.jpg\" alt=\"\" width=\"150\" height=\"105\" srcset=\"https:\/\/www.lasvegasadvisor.com\/stiffs-and-georges\/wp-content\/uploads\/2011\/11\/roulette-2-150x105.jpg 150w, https:\/\/www.lasvegasadvisor.com\/stiffs-and-georges\/wp-content\/uploads\/2011\/11\/roulette-2-300x211.jpg 300w, https:\/\/www.lasvegasadvisor.com\/stiffs-and-georges\/wp-content\/uploads\/2011\/11\/roulette-2.jpg 595w\" sizes=\"(max-width: 150px) 100vw, 150px\" \/>Cory&#8217;s opinion? &#8220;<em>To so hold [as Tanchek did] in the face of the demonstrable evidence of the direct  economic benefit to Wynn would be to eviscerate the meaning of \u2018direct  benefit to an employer.\u2019<\/em>&#8221; The question begged so far is whether or not this week&#8217;s verdict impacts the collective bargaining agreement that Wynn LV dealers signed with the resort. In it, the <strong>Transport Workers Union<\/strong> capitulated on every crucial bargaining point &#8212; especially the tip pool. If they&#8217;ve ratified the <em>status quo<\/em> by majority vote, can Wynn&#8217;s dealers realistically hope to wind the clock back to August 22, 2006?<\/p>\n<p><strong>And in some really good news<\/strong>, the legal system <a href=\"http:\/\/www.vegasinc.com\/news\/2011\/nov\/07\/attorneys-seek-examine-righthaven-ceo-about-compan\/\" target=\"_blank\" class=\"broken_link\">continues to tighten the vice around the scrotum<\/a> of <strong>Steve Gibson<\/strong>, <a href=\"http:\/\/www.lasvegassun.com\/news\/2010\/aug\/26\/judge-questions-righthaven-over-r-j-copyright-suit\/\" target=\"_blank\">persecutor of cat bloggers<\/a>. When his sham entity, <strong>Righthaven<\/strong>, is seized &#8212; and it appears to be only a matter of time &#8212; will there be anything left worth confiscating, other than Gibson&#8217;s infamous headset and sweater vests?<\/p>\n","protected":false},"excerpt":{"rendered":"<p>&#8230; or maybe not.
