Gambling Jackpots w/ Mandatory State Taxes Withheld

I'm trying to determine which States withhold taxes from W-2G jackpots and of this group, how many are essentially lost forever for non-residents vs. filing out of state returns and getting your money back?

I seem to recall that MS withholds 3% which you say sironaya to if you're non-resident.

I realize this isn't the case in NV since they don't have a state income tax.

The specific states that I'm interest in knowing about include IN, IL, MO, KS, CA, MS & LA....anything else is bonus info.

I tried a Google search but there didn't appear to be a one stop shop for this info.

Dan: I've had a few W2-G jackpots in CA and no CA income tax was withheld.

Hey Dan,

Jean Scott's book, Tax Help For Gamblers has a section called, "How All 50 States Handle Gambling Wins/Losses". the book was published in 2007 but I suspect that things haven't changed all that much. I don't have a copy of the book but you can probably buy it at the LVA office or through their website.
I won a $1931 jackpot it Shreveport, Louisiana a few years ago. They withheld $115 (6%) for state taxes (I'm a resident of Texas). I was able to get most of it back by filing as a non-resident.

Louisiana and Mississippi do. Arizona does not.
Years ago I got back taxes withheld in Mississippi casinos. Our tax guy filed a Mississippi return as well as the Fed and Arkansas returns.

You just file a return for the state in which the taxes are withheld. Your tax person can help you with that.

I thought Mississippi had changed their rules some time back????
In West Virginia, with a valid ID and SSN, withholding is optional. But no proof of ID, and we must withhold 28% federal and 6 1/2% state tax.
IN - Yes 3.4%
IL - Yes
IA - Yes 5.0%
MO - Yes 4.0%
OH - Yes 6.0%
KS - Most are Indian that don't withhold, don't know about new state owned that went in recently.
MS - Yes
LA - Yes 6.0%
AZ - No

This was all accurate at one time, some may have changed.
I had a 1099 at Harrahs in NKC Missouri a couple months ago and the w/h is still 4%
