Unfortunately, in our legal system, there's a difference between "not guilty" and "innocent."

And unfortunately in our legal system innocent people have been found "guilty."

You are dictator for a day, how would you go about amending the laws of this land to allow for findings of and punishments for: You might not have been found guilty but you ain't innocent????

There's a lot of fault to go around here. First and foremost -- who hid the body so it would decompose before an autopsy could be done that would have determined if she drowned, or died of duct-tape suffocation, or what? And second -- the prosecution did not do a good enough job, apparently.

One of the jurors reported that they all were "sick to their stomachs" about having to find "not guilty."

BTW, the news is now saying that the authorities are going to tally up the costs of the search for a live Caylee (hundreds of thousands of dollars, I heard) and either send Casey a bill or sue her. I wonder if she can be found responsible in a civil trial, even though she was found not guilty in the criminal trial -- like OJ.
I had a similar reaction when the jury I was on returned a verdict in favor of the doctor in a med-mal case. Some wanted to "punish" the doctor simply because the plaintiff had some serious complications, and she had. But it wasn't his fault. Alas, the system doesn't allow for compensation when you'd really like to compensate someone without the other party then being unfairly harmed, which is what a negligence finding would've done to the doctor. I'd loved to have been able to draw on some fund to hand the plaintiff and her husband x bucks if it would not rebound back on the doctor. Maybe that's the type of tort reform we need.

What troubles me in all of this is the amount of time, money and attention (and I'm not talking taxpayer time and money) expended on a tragically everyday American occurrence. I will GUARANTEE you that thousands if not tens of thousands of our fellow citizens could recite the trial proceedings nearly verbatim but they haven't been in a voting booth or attended a public hearing in eons, if ever.

Anyway, the third-leg alternative to innocent or not guilty is?
Jury decision making is interesting. Many years ago I worked for some researchers in jury decisions (if you study jury decisions, you'll read about there work).

For me, there appears to be a fallacy of composition problem: each jury sees their situation not part of the whole.

In the famous jury decision for the woman who was burnt by hot coffee from McDonalds, a jury member explained their decision that what people didn't understand was how badly the woman was hurt. But size of damages are not proof of negligence.

In torts, we've used courts as an insurance scheme.

What REALLY peeves me is that Casey and her family are now going to start selling their story and their interviews and make money off of this little child's death.
So who's to blame? Anyone who watches, reads, consumes that stuff.

Neither did Lorena Bobbits 15 minutes result in cash or the Bobbit man either- Bobbit did some bad porn that was a dud.

PS Amy Fisher is on this seasons Dr. Drew Celebrity Rehab- she doesn't look anything like herself- went to porn the last 6 months/ she's got porn botox face (weird no wrinkle nor expression) tattoo thin line eyebrows and solid black eye make up. her complaint is she's "labeled" as a killer and can't earn a living...but i think she wants big bucks- not slave labor bucks like a normal joe or josette as the case may be..
