Is anyone really surprised?
Yes, its legal thanks to the recent "Citizens United" Supreme Court case championed by conservative special interest groups. The president said it was a travisty. The House Minority leader hailed it as a giant win for free speech.

And now that Pandora's Box has been opened Republicans are getting a first hand dose of the Frankenstein Monster they created. If you thought your TV was saturated with negative campaign ads in the past just wait until this year. Your voice has been muzzled so we can all hear what Sheldon Adelson has to say.

Actually among others, the ACLU filed an amicus brief SUPPORTING the courts decision so not just conservative special interest groups.

The ruling applied to corporations (profit and non-profit) as well as labor unions.

As to muzzling anyones voice it was the opposite, that it would chill free speech, which lead to the 5-4 decision and support by organizations like the ACLU.

The facts are the facts and can not be spun. So lets review.
- Citizens United is a conservative special interest group funded by conservative political action money. This is the group that took the case to the Supreme Court - not the ACLU.
- The case met a split decision in the Supreme Court with the usual partisan split in our "non-partisan" Supreme Court.
- The decision was met with scorn from the president and Democrats. The decision was hailed by Republicans in Congress.

I have no doubt you can find special interest groups of all shapes and colors that support the ruling. And for the record I dont like George Soros drowning out my voice any more than Adelson. But the Citizens United ruling was not a bi-partisan effort championed proportionately by both sides of the aisle. Far from it. Republicans own this one - and they were happy to own when the ruling passed. Not so much today.

So when you hear Mitt Romney and Newt Gingrich cry about all the sewer money thats attacking them from the PACs - remember who opened the door to the sewer. It wasn't the ACLU.

You know me better then to think I am trying to spin anything.

Yes Citizens United brought the case, the action was against them. This is not unusual. But groups who are considered either independent or more liberal both supported the case and the ruling. And you are incorrect. An amicus brief is filed with intent to help a court decide a case. It is taken into account by the court in its decision. So while the ACLU did not bring the case to the court it filed in support and its legal brief was taken into consideration by the court.

And it had nothing to do with bi-partisanship. The facts are the Supreme Court did find, on First Amendment grounds, that the laws used, specifically the Bipartisan Campaign Reform Act of 2002 (commonly known as McCain-Feingold) that Citizens United freedom of speech was curtailed. Further, while the court could have issued a narrow ruling, it said it applied widely to corporations, profit and non-profit, as well as labor unions.

And while it initially favored one side of course the other side would object. However it is much like campaign finance laws. When one side was usually far behind on fund raising they objected how unfair it was hence the campaign finance reform which allows a presidential candidate to qualify for matching Federal funds under certain restrictions. Once the other side caught up we see what happened there.

As to a split decision, yes, it was, I acknowledged as much. But had it gone 5-4 the other way then it would have been the Dems celebrating and the Republicans crying foul.

It is not up to the Supreme Court to rule based on fairness but on the law. In the case I cited, in Skokie, was it fair for what is the American Nazi Party to traumatize the citizen's of Skokie who were predominately Jewish and had a good number of Holocaust survivors? The Supreme Court decided that the rights of free speech outweighed what may have been "right" or "fair". They even said use of the Swastika was as a symbol of speech.

In Texas vs Johnson (1989), on a split vote of 5-4 the US Supreme Court struck down laws aimed at criminalizing flag burning stating it was a form of protected speech. This was upheld in US vs Eichman in 1990 by 5-4. I am sure many felt this was a partisan decision.

In the end it matters not who likes or dislikes this ruling. What matters is the Court found that provisions of the McCain-Feingold act violated freedom of speech and it was struck down. If folks dont like the result they can try drafting a new law, amend the current one and resubmit or lobby for a Constitutional Amendment.
