DeSantis Gerymandering deemed racist and unlawful

He tried to kill a district of 360K African Americans by sending them off into 4 other districts where their voice would be dilluted and void.    The judge ruled race was a motivating factor.

But why should DeSantis be allowed to shrug his shoulders and walk away? Isn't an unsuccessful attempt to commit a crime a crime in and of itself?
