That case has nothing to do with this case. Trump is trying to use the Alien Enemies Act of 1798 to deport these folks. That law only applies in the case of a declared war by Congress, and then only to the nationality we are at war with. It is well settled law. I understand Trump's desperation as Joe Biden deported more people in his first month of office than Trump did. And he blew through the DHS's entire budget. If Biden's immigration policy was such a failure how come you are still swallowing for Trump who has spent a lot more money but didn't do as well as Biden?

Tren de aragua is a terrororist organization and thre US is at war with them.  There were no terror organizations in 1798 so this is new ground.  They need to be deported.

It is legally and practically impossible for a country to be at war with a terrorist organization. We may use military force against them, but it won't be a war.

 

Presidents don't get to say who or what the US is "at war" with. Only Congress can do that.

 

We are not at war with Venezuela. The only way the 1798 act could be invoked against its citizens is if we were at war with Venezuela. We are not.

 

There were in fact terrorist organizations as far back as ancient Greece and Rome. Ancient Judea in particular had many terrorist organizations resisting first Greek and then Roman rule. There were terrorist organizations in colonial America. Tom is fucking ignorant of history.

 

There has been no due process of law confirming that the individuals deported did in fact belong to that Venezuelan gang.

 

Despite Trump and stupid assholes like Tom, we still have rule of law and due process in this country.

Tom, that is not how it works. The act requires a formal declaration of war from Congress, and only applies to nation states.

 

You can't simply remove elements required for a statute to kick in because you want to.  It is up to Congress to change the law as they see fit. 


Trump's deportation policy has been a massive failure based on Trump's own standards he articulated during his campaign.  As you know, it was a signature issue for him. Face the facts Tom. Trump's deportation polices have been an epic and costly failure.

This is incorrect.  If you read the actual law (50 U.S.C. 21), it states:  "Whenever there is a declared war between the United States and any foreign nation or government, or any invasion or predatory incursion is perpetrated, attempted, or threatened against the territory of the United States by any foreign nation or government, and the President makes public proclamation of the event".  

 

Now read President Trumps proclamation invoking the Alien Enemies Act of 1798

 

Invocation of the Alien Enemies Act Regarding the Invasion of The United States by Tren De Aragua – The White House

 

The proclamation makes the case that this is indeed a 'predatory incursion', and that Tren De Aragua is a an officially designated foreign terrorist organization conducting irregular warfare against the United States and that this terrorist organization is tied to the Government of Venezuala.

 

As Commander in Chief and constitutionally responsible for US foreign policy how is this not within his power to make this determination and invoke this law?
