Court outcomes regarding the federal govt. witholding of criminal justice grant funds from states / cities who don't cooperate with ICE immigration efforts have largely favored the cities to date ( most, not all). There are executive branch powers and laws already on the books, however,  that do apply for cities that harbor or protect known criminals from prosecution / or withhold info on this classification of undocumented migrants. Ultimately, like a lot of other current ongoing processes, Congress needs to enact laws with specificity to address this issue. Like a lot of other current conflicts, this one will also likely end up in front of SCOTUS. But it's  a mixed review of inputs and legs to stand on for this fight concerning the true criminal elements among the migrants; the administration has lawful accommodations on their side here for known bad guys but the laws need clarified / enacted by Congress / SCOTUS to be barb-free. That'll take time that somebody doesn't have the wherewithall to provide, probably.

You described perfectly what is illegal and that's why all of the "criminal" investigations of sanctuary cities will end up the same way as Trump's legal cases to overturn the 2020 election.

 

Sanctuary Cities by their definition do not volunteer immigration intelligence to the Federal government.    That's not synonymous with "withholding immigration intelligence from the Federal government ".     There is no law that requires local and state police to enforce federal laws....and vice versa.   That's why the FBI doesn't enforce speeding tickets in your neighborhood.   It's called separation of powers,  some cities do volunteer immigration intelligence to the Feds.  That's fine.   It's not required - hence the word volunteer.

 

now, if police or local officials  actively obstruct a Federal investigation you have a case.    Nothing of that sort has been reported to my knowledge.    Feel free to refute that statement with evidence if it exists.

By the way, tom, did you read this article you posted? I find it interesting. Some highlights:

7 months? Wow.

Remember when MAGA said it couldn't be an insurection because there weren't any weapons? The criminal code doesn't require weapons, so wrong again, and people brought many kinds of weapons, including guns.

Destroying evidence.

 

For this, he was originally sentenced to 7 years and 2 months, which seems appropriate to me.

By the way, the judge who reduced Reffitt's sentence by only 7 months?

I'm sure some evidence of that could be found, but I know of none either. I'm not sure everybody would stop screaming / raising hell if we had presented 40 refereed legal journal articles on that subject, anyway?

Well, keep in mind that Trump thinks he has unlimited power, and MAGA thinks he should have it, so existing laws and legal precedent aren't going to have much meaning during the next four years.

But the real issue here is whether they intend to cooperate with Trump's mass deportations, which will target legal and illegal immigrants alike. Horrid, festering Republican cities filled with MAGAs will be enthusiastically cooperative. Blue cities filled with decent people won't.
