After reviewing the image and video in the article Tom linked and the video you have linked my desire to maintain intellectual honesty compels me to say that it does indeed appear as though the agent initially fired his pistol as the vehicle was moving toward him. In that moment it was reasonable for him to be in fear of serious injury.
I don't think she was trying to run him over. I think she was scared and trying to get away. But that doesn't change that he was in reasonable fear.
I still maintain that the agents made several serious errors and mistakes. They probably should not have been trying to apprehend her in the first place. She was not fully blocking the road and the agents could have drove around her. If they felt she was committing a federal crime they could have contacted the FBI. I don't think there was an immediate need for her apprehension. I also think it was foolish for the agent to place himself in front of the vehicle.
Definitely an awful situation.
