Is SCOTUS an actual court or just a Trump appendage?

We're finding out today--as Trump's unconstitutional attempt to attack California by not counting illegal immigrants in the census is being heard today.

 

I wonder who fed him this idea. He's not even remotely smart enough to come up with it on his own. He has had, however, an immense hard-on for California for years--since well before he oozed into the White House. I picture him sitting in the White House mumbling "IhateCaliforniaIhateCaliforniaIhateCalifornia" and an aide, looking up from shining Trump's shoes with his tongue, suggested this course of action "to really screw them liburruls."

 

Of course, the suit would have no chance in an honest court. The Constitution says that all persons should be counted. Period. Not citizens. Persons. Trump's lawyer--looking quite uncomfortable as he did so--argued that states with large numbers of illegal immigrants should be "punished" by reducing their apportionments. (I wonder if Trump even realizes that not counting such persons would reduce the representation of Texas and Florida as well.)

 

Reports today indicate that even the Trump stooge judges, such as New Nazi Girl, are meeting this argument with skepticism. We probably won't find out for a month how they actually vote. Some of the judges have indicated that they want to kick the can down the road until late January, after the end of The Dark Times.

 

Aren't you thrilled that the President is concentrating his efforts on trying to screw California rather than trivial shit like the pandemic or the economy?

Only American CITIZENS should be allowed to vote in American elections. Note: I realize that the Kitchen Sink has been very quiet the past 2 days and I know that this posting by Kevin is done solely to stir things up. His depiction of the President and his lawyers is typical of Kevin. If anyone reading Kevin's twisted take of reality places any real value in what he spreads, I suggest that they should get a reality check.

The census question has absolutely nothing to do with voting. It has to do with apportionments of funding at state and local levels. It also affects representation in Congress.

 

The Constitution does NOT say that only citizens should be counted in the census.

 

Thus do you yet again show your ignorance.

 

The Sink has been quiet because you, our principal howling baby, have been absent. I assume it was because you couldn't post bail until today.

The Constitution also does not say that non citizens can vote. Anyone reading your insulting and inflamantory postings knows who the ignorant one is.

The rules by which the Census is conducted are available, . . . not surprisingly at the site census.gov.

Yes, all people (citizens and noncitizens) with a usual residence in the 50 states are included in the resident population for the census, which means they are all included in the apportionment counts.

Until the adoption of Amendments 19 & 26, the Constitution was silent on voting--it was a power left to the states.   Until the 1920's non-citizens voted in most states.  In the 1920's the Congress passed a law requiring that only citizens could vote in federal elections, but was--and is--silent on voting in state elections.  Because states do not want to run two elections--one with a higher age restriction, or one for non-citizens or one not consistent with federal elections--states have adapted their laws to the federal standard.  The Constitution says nothing about citizens or non-citizens voting.

In the Constitution, very first edition, slaves were counted in the census, at two-thirds of a person. And they couldn't vote, could they?

 

So voting and the census count are two entirely separate issues. If you follow the Constitution.

That's why Trump's suit is unconstitutional. SCOTUS shouldn't even have consented to hear the case. But I think they're trying to please the Orange One, who packed so many of them in there in the first place.

 

Trump is probably shocked that they're not acting as total Trump-slaves and loyal lackeys but instead, are acting kinda sorta like judges. Of course, that could all be window dressing and they're intending to do Trump's bidding.

 

And MP...don't bother to refer to the Constitution when responding to Davey-poo. Not only does he not know what it is (as evidenced by his many rants against it), he can't even spell it.
