It can't be unless the Court agrees to hear it. Trump has already tried and failed. Also, should it get that far, they would have to rule in Trump's favor, which despite their lapdog status, they would probably be reluctant to do.
Trump, being stupid and lazy, put together a slapdash "justification" for invading American cities. That has been shot down in several lower courts, not just in Oregon. SCOTUS has historically been extremely reluctant to reverse multiple lower Court rulings.
