In my book, accusing someone of being a pedophile or a convicted rapist in the public square equates to 'Fighting Words'.. I did notice that no liberal here has ever called Kevin on his criminal liable against Miller....accusing David of criminal acts like rape.  Silence is complicity.

That is because calling people names no matter how reprehensible is not a crime at best it a civil tort claim.  Given the frequent exchanges between the two with name calling back and forth, I suspect the Judge would tell both of them to grow up and get the f out of the courtroom.

I am not sure how it works in the jurisdiction Kevin lives in but if he lived in my jurisdiction he could file for a restraining order and they are granted without question for 30 days. The forms are usually available online or at the courthouse.

A hearing would be set in that 30 day window and David could show up to dispute it. If he didn't, it would become permanent. The main take away is a restraining order would force David to leave the sink as he couldn't comment on Kevin's posts nor could he invoke Kevin's name in any other post.  

I am not suggesting that, just letting you know how it would likely play out.

You are absolutely wrong about that.  Falsly and maliciously accusing someone of a crime in the state of Nevada IS a crime.  Calling someone a convicted rapist and a pedifphile is about as bad as it gets.  it's differnt then calling someone an idiot or turd.

Although you are probably right.  About a .0001% chance that Kevin would ever punch someone.  I couldn't see this guy fighting his way out of a paper bag.

Although I suspect yours was more speculative and not malicious, where Kevin made a direct statement accusing David of actually committing violent felonies.   Now, if David did threaten Kevin, and I accused you libeling David then I would be guilty of libeling you.  But I said IF.  This is getting too complex for my pea brain.

Wow! That's a gross misdemeanor. Throw the book at him. Good luck finding a prosecutor willing to spend time on a misdemeanor case like this, especially when the so-called victim in this case is guilty for committing the same offense under the statute as well. This would never be prosecuted in the real world. The prosecutor would tell the victim he or she is better off in Civil Court as they could recover monetary damages and that even with a successful criminal conviction it would be unlikely the perp served any jail time.

Since David routinely calls everyone a liar he disagrees with, what do you think could David be facing a couple of thousand misdemeanor charges by a prosecutor looking through the threads here?

Truthfully, unless the LVA server sits in Nevada, it is unlikely David or Kevin has a case because for Nevada law to govern the liable has to have been committed in the state of Nevada.

Every person publishing a libel in this state may be proceeded against in any county where such libelous matter was published or circulated, but a person shall not be proceeded against for the publication of the same libel against the same person in more than one county.

I suspect this law wouldn't hold up under a free speech challenge. Think of all the untrue things about people Trump has said while in Nevada holding a rally.  Do you advocate the state opening up a case against Trump to go after the untruths he told about other people?
