2nd amendment

 

A well regulated Militia, being necessary to the security of a free State, the right of the people to keep and bear Arms, shall not be infringed

 

14th amendment

section 1, clause 2

No State shall make or enforce any law which shall abridge the privileges or immunities of citizens of the United States

 

The right of the people to keep and bear arms is in the Constitution.

 

The 14th Amendment said the state can't make laws that abridges the privileges or immunities of the citizens.  The right to bear arms is a privilege established in the 2nd Amendment; so the states can't infringe on this.

 

Abortion does not appear in the Constitution, so it is up to the states or Congress to determine its status.

Wouldn't that be the 10th Amendment, in regards to your last sentence?  

  • The powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved to the States respectively, or to the people.

The Supreme Court as picked by Donald Trump has spoken.  And they agree with Tom.

 

Now you get to run on that as part of your record.    And as for the states who went full blown Taliban on women's health care.....good luck running on that record in November.    Nevermind Democrats think its batshit crazy....your own Republican constituents do too.

The 2nd Amendment is so outdated.  This is in regards to people owning guns to help protect the country (as a militia.....aka minutemen).  Also, this was back when they had single shot pistols and muskets, not semi-automatic weapons.

Great rebuttal.  I appreciate your response.  However, you forgot to include the rest of section 1, clause 2 of the 14th amendment.  That is "nor shall any State deprive any person of life, liberty, or property, without due process of law; nor deny to any person within its jurisdiction the equal protection. In Rowe, Justice Blackmun's interpretation that the right to privacy was incorporated in due process and allowed the right to an abortion, with limitations.  Does the U.S. Constitution protect an individual's right to privacy?  The world "privacy" cannot be found in the Constitution.  Even though it doesn't appear, the Supreme Court decided in Griswold v. Connecticut on the presumption of a constitutionally protected right to privacy. Since privacy doesn't appear in the Constitution, is it a states' right issue?  In Heller, I agree with Justice Steven's interpretation of the original intent in 1791 of the 2nd amendment and you agree with Justice Scalia's interpretation.  We have the right to disagree.  Thanks for the civil discussion.  Take care.
