There is no "common sense" clause in the Constitution.  If there were, you would have to look at what was considered common sense in the 1780s which would be radically different than what we consider common sense in 2026.

The 14th amendment Citizenship Clause as written is unequivocal...

 

It's been challenged in court several times and those were all rejected. There are legitimate arguments such as intended application when originally written vs more current society /culture eras, birth tourism, definition of 'jurisdiction' and others. Any efforts to include these considerations will require new law via  constitutional amendment; the 14th amendment " is the law" whether we approve or not, and the text is quite clear. An executive order isn't enough to overturn it, imo.

 

This is all a portion of the desire of US citizens to see overall immigration reform from our esteemed government /Congress during an era where the scoundrels can't even pass a budget bill due to polarization.

So it looked like there were 5.5 million registered voters, and a possible 9.5 million living outside of the US in 2022, and 2024.  Agian they are looking forward to new births, so anyone already born here would be grandfathered in.  I know some people here are in favor of judicial hearings to deport people here illegaly, would anyone object to a judicial hearing to grant citizinship to a baby born here on vacation. or tempary visa

Why even present something that is unconstitutional? We have to follow the Constitution full stop.
