The only problem is, his failure to stop the mob isn't a prosecutable offense. It was an impeachable offense, but that ship sailed a while ago.
He was an incompetent asshole and millions of people died because of his callousness and stupidity. But having been the worst President in American history doesn't in and of itself make him a criminal.
There's yet another consideration. The image of him raptly watching the mob and jacking off to Fox News is something decent people find disgusting. But the 75 million find it inspiring.

My point is, yeah, but so what? He did a shitty job. He was an incompetent failure. But is that a prosecutable crime? I mean, we already fired his ass.
The failure to do anything is evidence of his motive in the seditious conspiracy and conspiracy to defraud the US crimes. It actually makes those easier to prove as it establishes the intent element for those crimes.
