I don't know, but I think that's possible if any of the conservative judges are actually 'traditionalist / literalist' in mindset. That 14th amendment wording is rather clear...to me anyway.

It seems that the backdoor approach is going to be to call immigrants "invaders" and thus invoke the clause regarding children of a hostile occupying army.
