Good points, but you left out at least one more.
When questioned about why he took and kept top secret and other classified documents in the CNN Town Hall, Trump said he had "every right" to take top secret and other classified documents from the White House. "I can do whatever I want to do with classified documents."
It is unlikely that Special Counsel Jack Smith agrees with that assessment. It is an admission that he *did* take classified documents, and if Trump is wrong about this power, as virtually every legal expert says, this admission could be further evidence that helps to convict him.
Of course, the main reason Trump will likely be indicted in the Mar-a-Lago documents case is that he obstructed justice. His harboring the docs is a separate area of jeopardy which may or may not be added to the obstruction charge. Also, what he did with the documents is unknown. Sedition may be a charge depending on what is discovered about that.
