Obviously, degree and intent should matter in any criminal prosecution. Griner could not possibly have intended to engage in "drug trafficking," the offense with which she was charged. The punishment she received was grossly disproportionate to her actual offense. That's true no matter what the two scum, Miller and Trump, say.
