Walz pardon could spare child rapist from deportation

  This act alone should put Walz in prison -  Minnesota Gov. Tim Walz approved a pardon last month for an illegal alien convicted of repeatedly raping a child, a decision federal immigration officials say could erase the convictions that made him deportable and allow him to remain in the United States.  --- Tou Lue Vang, a Laotian national who entered California in 1994 and later received legal status under former President Bill Clinton, was convicted in 2006 of first-degree criminal sexual conduct. The conviction cost him that status, and a Department of Justice immigration judge later issued a final order of removal. Nearly two decades later, Minnesota officials have moved to wipe the slate clean.  ---   Vang was convicted after repeatedly sexually assaulting a 10-year-old girl between 2002 and 2004. According to the Department of Homeland Security, he once offered the child $10 to keep quiet. When questioned by police, DHS said Vang tried to justify the abuse as cultural, allegedly telling investigators, “It is a cultural thing […] to marry and have sex with girls as young as 12.” DHS said he also claimed the 10-year-old victim was just as guilty as he was and should have been arrested.  ---  Walz approved the pardon after the Minnesota Clemency Review Commission recommended it and the state Board of Pardons signed off. Why would Walz save Trump from being hauled away?

 

You are, of course, in favor of child rape, given your voting record.

Pretty disgusting to give him a pardon. Also pretty disgusting to wait over 20 years to try to remove him. He was convicted during the Bush administration. Why wasn't he removed?

As he had already served his time, the pardon was to restore his citizenship status and save him from being deported. Walz followed the recommendations of the state parole board.

 

Whatever the morality of this may be, it's hypocritical in the extreme for MAGA to cry bitter crocodile tears of outrage when their lord and master is a proud pedophile and has raped at least 13 women.

My understanding is he was granted legal residence status after his refugee application was approved. 

 

With what he was convicted of deportation is a reasonable consequence and should have been done two decades ago.

 

 It does pose an interesting legal question: with him already having received final orders of removal, can a state pardon override a federal decision that's already in place? 

 

Under the current interpretation of the Constitution the federal government is in charge of both immigration and naturalization. 

 

Upon his conviction the federal government lawfully cancelled his legal status and ruled him subject for removal. Does a state pardon retroactively cancel that federal decision?

No, the federal law applies. A federal law or statute doesn't automatically supersede a state law, even if they're about the exact same thing, but since the issue is federal--legal residency--they're the ones who decide where he goes. The state does determine the outcome of his criminal case, but the feds can take that into account when determining his residency status.

 

While Trump has issued an executive order legalizing sex with underage girls ("The Epstein Act"), it only applies if you vote Republican. And I doubt this guy ever did.

 

And not voting Republican will soon be a reason for deportation in and of itself.
