What actually happened: the accused assailant was arrested and released to the custody of federal authorities. This is actually very common when a person is suspected of a federal as well as a state crime. The state defers prosecution.

Here is another thug, with an extensive criminal record who was already out on bail from an arrest a week earlier. He was released again the same day, with no bail.
