Womp Womp Supreme Court says Trump‘s tariffs are illegal

For the record the government will have to  reimburse the businesses that paid the tarrifs but the business will have to sue the government to get paid. I note several large retailers have already started the process months ago.


The cool thing is they don't have pay consumers that 90% of those costs that were passed on to meaning tax payers will be paying the tarrifs twice. The oligarchs will be getting a big windfall or as MAGA would say a win win. Everyone knows Jeff Bezos and the Walton family are barely getting by and need our money more than we do. 

 

Oh, and the litigation itself will cost the government just as much as the refunds will. Not only do we have to pay the tarrifs twice but we will also be paying court costs and attorney's fees. This is one of the biggest CFs in US history.

 

The law is clear about tariffs and has been for a couple hundred years. Only Congress has the power to enact tariffs.  Enacting them was the hight of stupidity as it violated the Constitution and this was the inevitable result.

Maybe read Bart's dissent where he frets over how much money the government will have to pay back.

 

Here is part of it:

 

“Refunds of billions of dollars would have significant consequences for the U. S. Treasury. The Court says nothing today about whether, and if so how, the Government should go about returning the billions of dollars that it has collected from importers.”

 

 

Poor Bart upset over the mess he created when he voted not to put a preliminary injunction in place that would've protected the taxpayers interests. I suggest he have a beer in celebration of how much he cost the taxpayers.

Unfortunately congress has passed several laws over the last 100+ years delegating its tariff powers to the president. 

 

It is my belief that all of those laws are unconstitutional. Congress does not have the constitutional authority to delegate any of its powers to another branch. 

 

This decision doesn't go far enough. It still keeps some of the tariffs in place and doesn't prohibit more in the future. 

 

My understanding is this decision only affects about half of the tariffs that Trump has set.

Not doing things the right and legal way has consequences who knew? 

Going forward Trump will have to get Congressional approval for most tariffs.

Yes, and it doesn't drag Trump off to prison, which is where anyone else would wind up after stealing $200 billion.

 

I'm frankly surprised that SCOTUS even murmured a "tsk, tsk." They've been nothing but a Trump appendage. 

 

SCOTUS's decision didn't cite the Constitutional law that reserves the power to regulate commerce to Congress. That tells me that they're in agreement with Trump, that the Constitution is toilet tissue and he can violate and ignore it at will. The only decision they could have lawfully made was: "All tariffs not enacted by Congress are illegal."
