If I was a car rental agency and was involved with a lawsuit against a renter, and the renter's reputation for telling the truth became an issue, I would definitely spend as much time as I could pointing out that the renter lied to get a cheaper rate on the rental, and is therefore probably lying about other stuff in the case too.

Just something to keep in mind when renting a car: when stuff goes bad, it's bad to be the guy who committed fraud.


I think that would be a pretty tough sell to a judge. You dont need to lie. You can truthfully say someone posted some offer codes online and you used them. You werern't asked at the time of booking to verify a Costco membership nor is it listed anywhere in the Contract as a prequisite for the agreed price.

Lawyers are infamous for using all kinds of tricks to bend the court in their favor. It wouldn't surprise me to see one take the route you are suggesting. But I cant imagine a judge would take it too seriously. But, then again, the judicial system surprises me all the time.
Yeah, there are no guarantees here. Hard to predict what a judge or jury might find important.

But again, if the case turns on whether the renter is telling the truth, such as claiming the windshield was already broken, or that the light was green, and the rental car company or the dead pedestrian's wife wants to show that the renter is a liar, the renter won't want to give them anything they can use.

Might not be worth the $50 in savings. Just know that going in.
