The difference is subtle, but important. 61% of the cases were reversed.
The ABA numbers include cases where the decision was vacated and sent back. There is a difference between the two.

The difference, . . . DonDiego included a reference* with data for the 10 years from 1999 to 2008. Table 3 is the most succinct summary demonstrating the difference among the Circuit Courts.

The factual statement is the 9th Circuit had 20% of its decisions Affirmed by the Supreme Court and 80% of its decisions Reversed/Vacated.

*Including a reference is an excellent way to either i. not post "bullshit" or ii. post "bullshit", but be able to blame someone else. DonDiego recommends the practice.


Oh, the irony. Did donde bother to read the article he wrote. I particularly liked it when the author of his article used the same phrase that came to mind. Figures don't lie, but liars figure. The article clears up the myth of the 9th but I guess Bondi was too busy scavenging for roadkill or whatever to read it. I realise the article has far too many words for the rest of you.

Due to various factors, such as size and subject matter jurisdiction, the number of appeals terminated by each court of appeals varies greatly. For instance, as shown in Table 1, in Fiscal Year 2008 the Federal Circuit terminated 1,745 cases, while the Ninth Circuit terminated 12,373; in 10 years, the Federal Circuit terminated a total of 15,781 cases and the Ninth Circuit terminated 114,199 cases. As shown in Table 2, the Supreme Court, in the past 10 Terms, has decided only 30 cases appealed from the Federal Circuit and 175 cases from the Ninth Circuit.4 Thus, the Supreme Court only reviewed 0.177% of the total number of appeals terminated by the Federal Circuit and only 0.151% of the total number of appeals terminated by the Ninth Circuit. Figure 15 (top of page 10) compares the Supreme Court’s rate of review6 for each of the courts of appeals over the last 10 years. The highest rate of review is for the District of Columbia, a mere 0.235%. The number of cases that the Supreme Court reversed as compared to the total number of appeals terminated presents an even lower percentage. Any reversal rate below 1% can hardly be considered high. So how did the Ninth Circuit get the reputation for being the “rogue circuit”? Well, “figures don’t lie, but liars figure.”

Yes, . . . he read the article, . . . but quickly, because it was too hard. And it did have a lot of words.

Did billryan do the math.
175 cases from the 9th Circuit reviewed by the Supreme Court.
35 cases affirmed.

Umm, . . . 35 divided by 175, . . . equals, umm, . . . ahhh , . . . [Uh oh ! Math is hard], . . . oh, wait ! 20%.



The ONLY thing the judge and the 9th circuit should have ruled on is whether or not Trump has the authority to impose the temporary travel bans. They did not. He does, granted by the constitution and congress. The district judge (shopped by those filing suit to make sure it would end up in the 9th circuit's lap) didn't even meet the criteria necessary to issue a temporary restraining order. This is all about politics, not the law. It is just another example of the left fighting EVERYTHING Trump does. They have made it very clear they will continue to do so every day he is in office.
