I believe the reference "madman" is mostly based on the fact that he acted alone. He, as well as the unabomber, are correctly described as terrorists.

It's not either/or. I believe the "madman" reference is from early on, before the discovery of his rants, diaries, etc., that demonstrated a focused hatred and a belief in violence with a political purpose.

No, our system is innocent until proven guilty. The burden of proof is thus on the prosecution and the accused is guilty beyond a reasonable doubt.
