Do you eat before paying at the supermarket

If they push the issue it comes down to whether or not they are convincing, credible, articulate people. If you read the story I read they just got of the military and moved to town a few days ago. This was their first trip to the grocery. They didn’t have any food in their new apartment yet. I suspect a judge/jury would likely come down on their side in such a case as judges and juries don’t like to convict military folks. Basically if a judge/jury buys their story the criminal case is over.

Having prevailed in the criminal case these folks could file a civil suit against the store for a whole range of stuff like false imprisonment, defamation intentional infliction of emotional distress and so on. The damages could be quite high. If you were falsely accused of something, held five hours against your will by another civilian and had your child taken away from you for a couple days you would expect to be highly compensated.

I'm just not getting the"saving the wrapper to be scanned at the register". If she fully intended to pay, the wrapper should have been somewhere in the cart and handed to the clerk at the register. Oh yeah, "hope they stick it to Safeway, get a large payout, they deserve it". For what, stealing? Regardless how you look at it, that's exactly what happened.

id also like to ask you what exactly you think makes these people "nuts" but i suspect that your view of the protest is not so much based on fact and more on an uneducated opinion.

Not to beat a dead horse...
Did she eat a sandwich while shopping?
Did she NOT pay for the sandwich at the checkout register and walk out of the store?
Regardless of the circumstances, this is stealing.
All I'm saying, when she was stopped for shoplifting/stealing, all she had to do was pay the damn $2.50, I would like to think she was given that option, b/4 the police were called.
Being detained for 5 hrs. and being falsely accused? Hell yeah I'd be pissed. But, am I missing something?
How was she falsely accused, thought she admitted to eating the damn sandwich and forgetting to pay for it. Given the chance to "own up" she should have taken it.

Generally speaking theft requires intent. That would be the issue. She says very vocally and publicly she didn't intend to leave without paying for the sandwich. It would be up to a jury to decide if she did. Given she just got out of the military and is five months pregnant it would be very difficult case for the state to prove.

That is why the store withdrew their charges. Their attorneys knew it is probable the store will be paying out a settlement the only question at this point is how much.

If DonDiego were to shoplift, . . . and he is neither admitting nor suggesting that he has ever or ever intends to shoplift, . . . he'll make sure that he is at least 5 months pregnant.
Oh, . . . and if he were to shoplift or otherwise violate the law, . . . not that he ever has or ever intends to do so, . . . he'll be carrying his DD Form 214 too.
That'll make it difficult for the State to prove any transgression.

Perhaps i should apologize for calling them "nuts" and i also should educate myself more on what it is EXACTLY,that they are protesting. I'm sorry,but just about everything i've seen so far has been a little crazy to me. There just doesn't seem to be much on the news about it and honestly i haven't really cared that much. I'll look inti it further,thank you.
