Her defense was she thought she had a a longer distance. That will not hold up in court. You have to be responsible for where you walk. What if a child had crossed her path? It's a stupid defense, she is just embarrassed it got on YouTube.
I work at a middle school and to pick up extra hours I work as a crossing guard at a very busy intersection between the middle school and the high school. You should see the looks of disgust I get when I tell the kids to quit texting and pay attention when they are crossing the street. I'm sure that eventually one of them is going to do it in a less busy/unattended crosswalk and get hurt. Then I'll get to say I told them so;-)
Some new smartphones allow you to turn on the camera while you text so you can see the ground and text at the same time and avoid falling into fountains at the mall.
This women got exactly what she deserved.She should be totally embarassed to even think about suing.Wonder if she is related to that stupid women who spilled hot coffee in her lap than sued McDonalds because it was hot.And won!
