Malibber2- apparently the facts of this farce escape you - give it up, you are wrong and there is nothing you can say that will change the truth.

As is said for probably the fifth time in this thread I am not offering any arguments on the facts of this case. I merely pointing out there was a gross deviation from how Grand Jury proceedings are normally conducted. I cited a Supreme Court case to bolster my legal argument other people cited Glenn Beck's website and the Nolo Self Help legal website to bolster their legal arguments. Then I suggested if they wanted to make legitimate arguments they might be better served looking at the case law of the state to see what it says about grand jury proceedings as that would be the controlling law on the subject.

Hell even Fox News got this one right:

Not much is normal about the Missouri grand jury responsible for deciding whether to charge a suburban St. Louis police officer for fatally shooting Michael Brown.

Not the length of deliberations, not the manner in which it has heard evidence, not the way in which its work could be made public.

Then the article breaks down how this case deviated from the normal grand jury proceeding. article
Like I said earlier, in all likelihood under normal curcumstances this case would never have gone to a grand jury due to lack of evidence
NYT reporter who published Wilsons address got a little karma to come back and bite her in the ass.

I'm not a lawyer but my thinking is that if there's dead person shot by another person, it's up to a grand jury to decide if there is enough evidence to indict. Isn't that the purpose of a grand jury?
Hoops is wrong in any case where there is some media attention and or a police officer shooting an unarmed individual it is going to a Grand Jury assuming the jurisdiction is one that still uses a Grand Jury.

I'm not a lawyer either, but if every shooting death went to grand jury it would be a huge waste of money and resources. It's the prosecutors job to determine if there is a crime and if there is enough evidence to convict. The prosecutor in this case knew there wasn't enough for a crime, much less the evidence to convict, but he sent it to the grand jury because of all the media coverage.

I don't think malibber is a lawyer. I think he just plays one on the internet. Dan Abrams disagrees that the grand jury procedure in this case was injurious to justice.

Henceforth, every suspect in a criminal case shall be given 25 days of grand jury presentation as to why he shouldn't be charged with a crime, in such hearing the highest ranking prosecutor in the county must act as his defense attorney. The astronomical costs of this new system shall be paid for from a special tax levied on esteskefauver and other like minded individuals who prefer this system over the one we have now.

Mal remains immersed in a bed of sour grapes. His demeanor is his downfall, and his poor fact retention ability is full proof that he isn't or never has been a student of the legal system. He is, in short, a phony. But he's also a koolaid-drinking, bleeding-heart liberal who seems not to be able to handle that his black president, his black atty. general, and his black racist idols in Ferguson got the beat down by the evidence this week.

Get used to it mal. It's all downhill for the dems and their crazy deceitful & white-hating ways from this point on.
