If Hillary Becomes President and Names.....

....Bill Clinton as her Vice President, and she dies in office, who will become President?

Obviously Bill has served 2 terms as President already. Could he possibly serve a third term, or would the Speaker of the House become President? Just something I thought about last night and I haven't gotten a good answer yet! What do you guys think?

Last line of the Twelfth Amendment:

. . . no person constitutionally ineligible to the office of President shall be eligible to that of Vice-President of the United States.

Bill Clinton is constitutionally ineligible for the office of President. He cannot become Vice-President.

That's not entirely correct. The VP must be a person eligible to take the Office and Clinton, having served two terms isn't eligible.
He would be allowed to run for VP.There is more to it then just the 22nd Amendment. At least that's what we learned in college.

The important verb in the 22nd is "elected." It does not specify who is ineligible to serve as president. Since there is more than one way to become president, that matters.

Some scholars support that position, while others argue that the clear intent is that no individual shall serve more than two Presidential terms by any route, and intent matters, too.

As a practical matter, the Courts have never ruled one way or the other, because the situation has never arisen. When and if it does, the Courts will undoubtedly be called upon to rule, very possibly all the way up to the Supreme Court. Until that happens, perhaps the fairest thing to say in answer to BAGIANT’s question is that no one really knows the answer.
