Actually your statement is not accurate - with regard to the bail in the felony, most judges would allow a defendant to get out on bail despite the other pending legal issues, due to the charge being a low degree felony and the overcrowding of jails. HOWEVER, and this remains to be seen, a probation violation can still be issued in relation to her DUI case, and the judge who is overseeing Lohan's probation can still find that she violated her probation and put her in jail, even if she hasn't been found guilty yet on the felony theft case.
