Can you say Recess Appointment?
There are differing opinions on whether a recess appointment can be completed.

See, f'rinstance scotusblog.com .

So what happens if Obama appoints him? Does he get seated while it works his way through the courts?
Judge Garland led the prosecution of Timothy McVeigh. So he obviously the loony sovereign state types would oppose him.
Exactly.

Senate Reps are just following the Biden Rule. Democrats have verrry short memories.
I thought I must have a short memory as I don't recall any Biden Rule. So I looked it up and what did I find

“The senate will continue to observe the ‘Biden Rule’ so the American people have a voice in this momentous decision,” he added, without acknowledging that the “Biden Rule” has little to do with outgoing presidents nominating people to the Supreme Court.

(Biden made an observation to the effect that if an outgoing president nominates someone before the summer of his last term in office, that person typically receives the Senate’s approval, but that if he or she is nominated during the summer, that person does not — meaning that McConnell even gets what could be called the “Biden Observation” wrong.)

It appears Republicans believe the power to nominate people is stripped from the powers of The Presidency in his last year in office, believes that an observation from someone is a rule and believe that Summer begins in mid-March. I suppose its better to have a short memory than to be mindless.
Bidens Observation from 1992
, But I believe that so long as the public continues to split its confidence between the branches, compromise is the responsible course, both for the White House and for the Senate. Therefore, I stand by my position, Mr. President," Biden said. "If the president consults and cooperates with the Senate or moderates his selections absent consultation, then his nominees may enjoy my support, as did Justices Kennedy and Souter, but if he does not, as is the president's right, then I will oppose his future nominees, as is my right.

The Biden Rule.

This is the sort of thing that makes me want the GOP to play dirty pool. We've been nice for so long, and the Dems have been beating us at dirty politics since 1992 and before. Joe Biden's own words prove my point.

Something tells me BM didn't bother reading what he linked. Either that or he's a moron. Or Both.

But the public does as well, evn shorter]. The public already views congress as sitting on their asses and getting no work done. Doing something like not even holding a hearing only personifies the perception. Tjrow in the shenanigans the RNC is planning for the convention will be the destruction of the party IMO.

Not that I'm thrilled with how the GOP stands today at all, but no party should implode today, not with a two party system, it would be a disaster.

I 'm conservative and have historically voted rep. but choices are getting more and more difficult. Today is a "NONE OF THE ABOVE" vote really. At least for the moment.

I'll take DD and AL right now in a heartbeat
