Here's the applicable part of the signing statement:

"The executive branch must have the flexibility, among other things, to act swiftly in conducting negotiations with foreign countries regarding the circumstances of detainee transfers."

And if you want to argue the legitimacy of signing statements, I'll have a young Reagan administration attorney, Sam Alito, school you on signing statements and Congressional overreach. Or maybe it will be James Madison. Either way, it won't turn out well for you.

His use of the signing statement is a flimsy excuse for doing this deal behind Congress' back; knowing full well if he notified Congress, the facts would come out and it would not have gone thru.

The excuse was a concern for bergdahl's health, which doesn't look to be the case

Another example of the most transparent administration being secretive.

President Obama's claim Tuesday that the U.S. would "be keeping eyes" on five hardened Taliban leaders traded for Sgt. Bowe Bergdahl's freedom was immediately challenged by a Middle East official quoted as saying they'd actually be allowed to move freely -- and even "go back to Afghanistan if they want to."

The source, identified as a senior Gulf official, reportedly told Reuters that the five Taliban members would not be treated like prisoners while staying in Qatar, where they were released. Rather, they'd be allowed to "move around freely" in the country and then be allowed to travel outside Qatar after one year.

Perhaps The Obama has changed his mind on the matter. Or, . . . perhaps, . . . The Obama was against the policy of Signing Statements because he "[believed] in the Constitution and would obey the Constitution" when he was in Congress, . . . and The Obama is for the policy of Signing Statements to "[do] an end run around Congress" when he is in the White House.

No, . . . wait ! That cannot be. This President was going to be different, . . . wasn't he?
